Opis:: Chinese authorities have taken decisive steps to tackle violations of intellectual property (IP) rights in the People’s Republic of China (PRC). The National People’s Congress (NPC) adopted a new amendment to China’s criminal law on December 26, 2020. These regulations entered into force on March 1, 2021. The article aims to draw attention to the recent developments and ways to fight against the IP infringement in China. The study focuses on the IP courts in China and then analyzes the recent amendment to Chinese criminal law. Therefore, it is based on the descriptive and dogmatic methods. The article seeks to answer the question of whether the regulations are effective and significantly prevent the spread of IP infringements in China. It brings us to the conclusion that China’s accession to the WTO was a turning point that influenced the development and the improvement of domestic IP regime. Hence, China became a country with complex, multifaceted, and contentious environment regarding IP rights. One of the most significant changes concern the establishment of IP courts across China. It is too early to determine whether these solutions are effective due to the ongoing COVID-19 pandemic in China.

Opis:: This article provides a comprehensive analysis of Bruce Lee’s case by presenting the intellectual property rights mechanisms in the People’s Republic of China. The aim of this paper is to bring attention to the trademark law as well as to shed new light on infringements of personality rights, in particular portrait rights, in trademarks. This begs the question as to what kind of legal action should be undertaken by Bruce Lee’s heiress to protect her rights. Moreover, the article touches upon the conflict between the public interest and trademarks and tries to answer the question how to balance private holders’ rights with the public interest. In order to provide some hypothetical scenarios, the study focuses primarily on Bruce Lee’s case background and the new amendments to trademark law in China, bringing the authors to final deliberations on Bruce Lee as part of modern culture belonging to mankind as a whole. Therefore, our research aims to find a solution to the challenging problem of reconciling intellectual property rights protection mechanisms with the common cultural heritage.
Artykuł zawiera analizę kazusu Bruce’a Lee przedstawiając ostatnie i zarazem przecierające nowe szlaki mechanizmy ochrony prawa własności intelektualnej na terytorium Chińskiej Republiki Ludowej. Celem artykułu jest zwrócenie uwagi na prawo znaków towarowych, jak również nowe spojrzenie na naruszenie praw osobistych, w szczególności prawa do wizerunku w znakach towarowych. Nasuwa się zatem pytanie, jakie czynności prawne powinny zostać podjęte przez spadkobierców Bruce’a Lee, aby chronić ich prawa. Co więcej, w artykule porusza jest również kwestia interesu publicznego w prawie znaków towarowych, a także autorzy poszukują odpowiedzi na pytanie, w jaki sposób zrównoważyć prawa prywatnych właścicieli z interesem publicznym. W celu przedstawienia hipotetycznych scenariuszy, artykuł w pierwszej kolejności odnosi się do samego kazusu oraz nowelizacji prawa znaków towarowych w Chinach, w dalszej zaś części do rozważań na temat Bruce’a Lee jako elementu składowego kultury współczesnej, należącej do całej ludzkości. Celem niniejszego artykułu jest więc znalezienie rozwiązania dla trudnych przypadków, w których celem staje się pogodzenie mechanizmów ochrony praw własności intelektualnej ze wspólnym dziedzictwem kultury.

Opis:: Abstract. An elevation in plasma cardiac troponins is an indicator of increased perioperative risk in orthopaedic and vascular surgery, however, data on liver transplantation (LTx) are scarce. The aim of the study was to evaluate the prevalence of cardiac troponin I (cTnI) elevation in the perioperative period of LTx, and its potential relationship with 1-year mortality. Material and methods. Analysis included 79 patients with liver cirrhosis. During LTx all patients underwent hemodynamic measurements. cTnI level was determined before the operation, 24, 48 and 72 hours afterwards. One-year mortality was assessed. Results. 12.7% patients died, all during in-hospital period. cTnI level on day 1. was identified as the most promising marker of increased death risk with optimal cut-off value of 0.215 ng/mL (the sensitivity of 60.0%, specificity of 87.0%, positive predictive value of 40.0%, negative predictive value of 93.8%). The most important predictor of cTnI increase was the duration of the LTx procedure followed by amount of packed red blood cells transfused, basic stroke volume index, and cardiac output index. In conclusion: value of cTnI level assessed 24 hours post-surgery was a reliable predictor of death following LTx with optimal cut-off value of 0.215 ng/mL. The surgery time was the most important predictor of cTnI elevation.
