    The subject of the article is professional secrecy in practicing the legal profession in American law, with the indication of some differences resulting from separate laws of different states, and in the European Union – taking into account a few exemplary countries. Its sources were described – both legal and ethical, as well as the definition and construction. Confidentiality has been included in the objective and subjective aspect, taking into account different views in the doctrine as to its scope. Bearing in mind the basic right from which professional secrets derive – the right to privacy – the article also includes some of its aspects related to confidentiality.

    Opis:
    This article is intended to introduce the Reader to the definition of professional secrecy as defined by Polish Organization and Functioning of Pension Funds Act (OFPF Act) and to highlight the essence of the most extensive legal protection of professional secrecy related to the activities of pension funds, which is the penal law protection.
    Karnoprawna ochrona tajemnicy zawodowej związanej z działalnością funduszy emerytalnych opiera się na dwóch dyrektywach: dyrektywie subsydiarności oraz dyrektywie proporcjonalności. Pierwsza z nich opiera się na zasadzie, iż z sankcji karnych należy zrezygnować wszędzie tam, gdzie ten sam efekt może zostać osiągnięty za pomocą samoregulacji gospodarczej, przedsięwzięciami gospodarczymi oraz unormowaniami administracyjnymi. Druga natomiast oznacza że kryminalizowane powinny być tylko takie patologiczne zachowania gospodarcze, które w szczególnie wysokim stopniu zagrażają ponadindywidulanym dobrom gospodarczym. Specyfika karnoprawnej ochrony tajemnicy zawodowej dotyczącej działalności funduszy emerytalnych odbiega nieco od obowiązku zawodowej dyskrecji w klasycznym kształcie, wynika ona bowiem nie tyle z samej działalności zawodowej wykonywanej przez konkretne osoby, co ze szczególnego rodzaju działalności prowadzonej przez jednostkę organizacyjną (fundusz emerytalny). Niemniej jednak obowiązek dyskrecji ciążący na ustawowo wskazanych podmiotach ma związek z wykonywaniem przez nich zawodu, a zatem jest objęty tajemnicą zawodową.

    Opis:
    Autism is a disorder that becomes today the subject of many interdisciplinary studies. You can talk about a wide spectrum of autism. It concerns adults, but also children. In the article special attention is paid to autism during preschool and early school age. It should be noted that the term "autism" has enough short history as it appeared in the 40s of the twentieth century. This concept can be understood in three main areas: 1) breaking social ties or limited ability to enter into interpersonal relationships; 2) abnormal communication; 3) stiffness behaviour, restricted repertoire of activities and interests connected with to the lack of imagination. Another element of the article is the presentation of the core symptoms of autism. It is worth noting that autism is reflected by the diversity of its syndromes. It was important to pay special attention to autism. The specificity of childhood autism must be taken into account in the selection of methods situations and psychotherapeutic techniques. The point is that the effectiveness of the therapy does not undermine the fundamental norms and moral principles. One of the basic principles is the trust and respecting professional secrecy. In this context, there is a very important proposal for the therapists and other professionals working with autistic children to constantly work on raising not only professional skills, but also care about raising the moral qualifications.

    The subject of the article is the types and characteristics of guarantees created to protect legal professional secrecy in the USA. It is inseparable from its character and role in the performance of the legal profession. The right to privacy is not without significance for the subject of the article, which is the fundamental value and the core of the relationship between the lawyer and the client. These guarantees are one of the most important factors in the legal protection of professional secrecy – crucial not only for the client, the lawyer himself, but also for the entire legal protection system. In particular, attention was paid to the main issues concerning legal secrecy in the Amendments to the US Constitution, which indirectly create a protective system for it.
    Przedmiotem niniejszego artykułu są rodzaje oraz charakterystyka gwarancji stworzonych w celu ochrony prawniczej tajemnicy zawodowej w USA. Jest to nierozerwalnie związane z jej charakterem i rolą w wykonywaniu zawodu prawniczego. Nie bez znaczenia dla tematu artykułu jest prawo do prywatności, które stanowi podstawową wartość oraz trzon w relacji pomiędzy prawnikiem a klientem. Gwarancje, o których mowa są jednym z najważniejszych czynników ochrony prawnej tajemnicy zawodowej – kluczowej nie tylko dla klienta, samego prawnika, ale także dla całego systemu ochrony prawnej. Zwrócono przede wszystkim uwagę na główne kwestie dotyczące tajemnicy prawniczej w Poprawkach do Konstytucji Stanów Zjednoczonych, które pośrednio tworzą dla niej system ochronny
