Opis:
The problem of transformations of the definition “Interpretation in international law” is analyzed in the article. Particularly acute and ambiguous is the question of differentiation of the concepts “interpretation” and “explanation”, which are used n the domestic theory of international law. In Western literature, mostly, the term “interpretation” is used (from the Latin interpretatio). It is determined that two concepts, which Ukrainian lawyers often see as identical or synonymous, the national experts in international law often consider to be rather problematic. From the point of view of the Ukrainian legislation, the concept of “interpretation” is legal, and lawyers use in legal practice and theory such terms as interpretation of the law, interpretation of the legal act, legal interpretation, interpretation of the rules of law, interpretation of the norms of international law. The author notes that this not only does not introduce categorical unambiguity and clarity, but rather complicates the integration of Ukrainian legal science and the science of the theory of international law in the European scientific system.

This article explores the legal principles that govern the interpretation of “secondary instruments” in international law. A “secondary instrument” under international law is, for the purposes of this article, a written document adopted by a body empowered by a treaty to take action with respect to the treaty, but which is not itself a treaty. Such instruments find increasing application in international law. The article specifically examines the interpretation of secondary instruments arising in five settings in international practice: the United Nations Security Council, the International Maritime Organization, the International Seabed Authority, the International Whaling Commission, and conferences/meetings of the parties under multilateral treaties. This selection of practice will serve to illustrate principles of interpretation across a range of international institutional settings for the purpose of determining the rights and obligations of state-parties to a treaty regime.

This article is devoted to current practices concerning the application of general principles of law in the light of their function in the international legal system. As a means of the application and interpretation of both treaty and customary law, general principles of law perform a crucial function in the system of international law, which is understood as set of interrelated rules and principles – norms. Te role played by general principles of law in the international legal order has been discussed by academia for years now. Initially they were used to ensure the completeness of the system of international law. However, at the current stage of development of international law, when many of them have been codified, they are usually invoked by international courts for the interpretation of treaties and customary law and/or the determination of their scope. This means that despite their ongoing codifcation they do not lose their character as general principles and are still applied by international courts in the process of judicial argumentation and the interpretation of other norms to which they are pertinent. References by international courts to general principles of law perform the allimportant function of maintaining the coherence of the international legal order, which is faced with the twin challenges of fragmentation and the proliferation of international courts.

This article analyses the practice of the Polish administrative courts with respect to application of the Vienna Convention on the Law of Treaties, based on a case study of the judgment of the Voivodship Administrative Court in Warsaw of 6 May 2014 (case no. II SA/Wa 117/14), which concerned the recognition of distance learning degrees awarded by Ukrainian universities pursuant to the 1972 Prague Convention. It is argued herein that the reasoning of the court suffers from four major drawbacks: 1) it is at variance with the text, object and purpose of the Prague Convention; 2) it does not take into account the practice in the application of that treaty; 3) it misinterprets the silence of the preparatory work to the Prague Convention on certain issues; and 4) it is inconsistent with international judicial decisions as regards the interpretation of the “special meaning” of one of the terms used in the Convention.

Opis:
The China Sea connects as many coastal states as it divides due to the economic and strategic challenges it represents. It also embodies an area of confrontations between the Great American and Chinese strategies. Identifying with precision the differences that arise requires an interest in the symbolic dimensions that surround them. This angle of analysis provides an opportunity to observe the functioning of international law and inevitably leads to a discussion of the emerging international order. The literature on the situation in the China Sea abounds. The paper’s singularity is to approach it under the prism of international law as revealing the psychology of an actor. To carry out this research, the authors use a pragmatic and critical approach to international law. The thesis defended shows that, contrary to a positivist and judicial approach to international law, elements exogenous to the law, the history, and the psychology of an actor, influence the interpretation of existing norms.

The presented article identifies and offers solutions to problems related to interpretation of international investment treaties, which have been authenticated in two or more languages. It focuses on situations when the provisions of investment treaties cause interpretational doubts because their wording is not identical in the official languages of the particular treaty. The scope of the analysis is narrowed down to the provisions concerning the jurisdiction of tribunals, which is justified due to practical implications of jurisdictional considerations in the course of arbitral proceedings. The first part of the article explains relevant applicable general principles of treaty interpretation as expressed in the 1969 Vienna Convention on the Law of Treaties. The second part is a case study, which analyses the problems faced by tribunals in the Kilic Insaat v. Turkmenistan, Berschader v. Russia and Daimler v. Argentina cases. The conclusions presented in the article may serve as a tool in the practice of investor – state arbitration, when implementation of specific provisions of international investment treaties occurs in the course of arbitral proceedings.
W artykule poruszono problematykę interpretacji międzynarodowych traktatów o popieraniu i ochronie inwestycji, które zostały sporządzone w dwóch lub więcej językach. Treść traktatów o popieraniu i ochronie inwestycji powoduje wątpliwości interpretacyjne, ponieważ brzmienie poszczególnych postanowień tychże traktatów w dwóch lub więcej językach, w których zostały sporządzone, nie jest identyczne. Zakres analizy artykułu został zawężony do postanowień  dotyczących jurysdykcji trybunałów arbitrażowych, co jest uzasadnione doniosłością tych kwestii z perspektywy przebiegu postępowania arbitrażowego. W pierwszej części artykułu wyjaśniono zasady interpretacji traktatów prawa międzynarodowego uregulowane w Konwencji wiedeńskiej o prawie traktatów z 1969 r. Druga część artykułu stanowi analizę przypadków, w których poruszana problematyka była przedmiotem analizy trybunałów arbitrażowych, na przykładzie spraw Kilic Insaat v. Turkmenistan, Berschader v. Russia oraz Daimler v. Argentina. Wnioski wysunięte w artykule mogą być wykorzystane przy stosowaniu postanowień traktatów o popieraniu i ochronie w praktyce postępowań arbitrażowych na linii inwestor – państwo.
