Opis:
Many modern legal systems declare, that protection of human dignity plays an important role in its construction. Therefore, a question may be asked if the concept of dignity is similar in different legal systems. The following paper presents the results of the research on human dignity concepts in reasoning of national (Polish and German Supreme Courts) and international courts (ICC, ECHR). Both national systems provide a constitutional protection of human dignity, Rome Statute, which constitutes the ICC, prohibits behaviours infringing dignity (model of Geneva Conventions), whereas the European Convention of Human Rights does not include the term “human dignity”, only prohibition of torture or “inhuman or degrading treatment”, what is understood as protection of dignity. On the basis of the research there could be stated, that each legal system has developed its own concept of human dignity, although all concepts have a similar core, as nearly all ways of understanding “protection of human dignity” are combined with a commitment to respect each person. This kind of respect could be assumed as a basis of human dignity protection.

Purpose: The paper presents selected psychological concepts supporting the professional work of a coach as well as supporting representatives of other helping professions. The aim of the article is to indicate how many psychological sources are already present in coaching practice and to describe those which are most important for its practice. Design/methodology/approach: Coaching is a new form developmental approach to working and interacting with other people. In the article, I use the method of comparative analysis. Findings: According to the authors, it is an unjustified conclusion to connect coaching with only the humanistic-behavioral approach. Consequently, the authors’ aim is to convince the reader that coaching uses many psychological and psychotherapeutic approaches, while the aim of this text is to organize them and to indicate how various concepts can support coaches and other helping professionals. The first part of the article explains the concept of coaching and its relation to philosophy, psychology and psychotherapy. This is followed by a description of the psychological concepts and methods, with an indication of their possible application in coaching. Research limitations/implications: The research is limited to the analysis of the impact of broadly understood humanistic knowledge on the quality of the coach’s work and coaching as a modern/new form of helping profession. Practical implications: This text proves that coaching uses psychological concepts/positions and philosophical theories. These become a specific theoretical and scientific basis for coaching. Social implications: Coaching is a subdisciplinary practical discipline drawing from humanistic knowledge: psychological and sociological. Originality/value: Coaching is a new form of the helping professions. The article explains the concept of coaching and its relation to philosophy, psychology and psychotherapy. This is followed by a description of the psychological concepts and methods, with an indication of their possible application in coaching.

Opis:
The goal of the paper is to present the changes occurring in the concept of human nature in the modern heterodox economics as the effect of social trends, which are responsible for altering the way of understanding the world, which translates into real changes. Virtualization of life, greater sensitivity to human and environmental issues, increased contacts with other cultures and religions, greater sensitivity to the existing social injustice are some of those factors. These changes in world-view are inter-related with the changes in understanding of the individual – the economic subject of the economic theory. This affects the way of viewing the economic actor within selected modern economic heterodoxy: ecological, evolutionary, humanistic, feminist, and behavioral economics.

Opis:
The sustainable policy is more and more getting a central political concern and the politicians and economists look for the ways of introducing it in an effective way. Religions could provide institutional support, as soon as neoclassical economics doesn't deliver such one. The neoclassical economics by treating expenditures on environment protection only as an additional cost, diminishing the efficiency can't ensure the necessary motivation to realize such a policy. Religions could provide lacking institutional support to the neoclassical framework, which by treating the expenditures on environment protection only as an additional cost, diminishing the efficiency can't ensure the necessary motivation to realize such a policy. Religions due to their particular concepts of human nature, may fill this gap by impacting on people's attitude towards various aspects of human life, including problems, which are the concern of sustainable development policy. The goal of the paper is to discuss the influence of the concepts of human nature in selected world religions on the sustainable policy. This task is realized by showing how concept of human nature, perceived in their three dimensions - worldview, social world, individual world (body, soul, and mind) affects the way of thinking about sustainable policy issues. Furthermore the question is raised, of how the voice of the world's religions could be better used in the conduct of this policy. It may be used by working together on the meta-religious level looking for the common features and building common statements to sustainable policy matters.

Opis:
The aim of the article is presentation of two concepts of human individuality which have arisen in modern Polish philosophy of Mieczysław Gogacz and Stanisław Judycki. It is an attempt to look at the problem from two different philosophical perspectives: Thomistic metaphysics and phenomenological epistemology. Metaphysical approach is searching for an answer to the question about human individuality in their ontic structure, whereas phenomenological approach focuses on the analysis of a direct experience. As reason of individuality, Gogacz indicates potential intellect (passive) subjected in a substantial form (soul). Judycki maintains that this reason is the concept of God, according to whom He creates a soul of every human being as radically different from all other human souls, unique. Presented theories develop from a different way of understanding a human being. Gogacz’s theory has a substantial character, refers to the concept of a human of Aristotle, Boethius and St. Thomas Aquinas. Judycki’s concept is a relational approach, modified by elements of substantialist philosophy. He refers to relational approach of Plato, Saint Augustine and Descartes as well as substantialist theories of Aristotle and St. Thomas Aquinas. Thomistic and phenomenological approaches to individuality introduce fundamentally different and essential substance to philosophy concerning human beings.

Opis:
The article is devoted to the study of the correct application of the evaluative concepts contained in the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms. Attention is drawn to certain difficulties in the application of the evaluative norms in the Convention: despite their objective necessity and usefulness, they create a room for the law enforcement entity’s own discretion up to subjectivism in resolving specific cases; they serve as an objective obstacle to the unification of the case law of the ECtHR and this creates preconditions for unequal implementation of ECtHR judgments in the national legal order; they cause the risk of errors in the application of the provisions of the Convention by the competent authorities of the Contracting States. It is established that the application of legal norms containing evaluative concepts is challenging not only owing to the specific properties of the evaluative concepts themselves, but also due to the peculiarities of adjudication by the ECtHR when applying the evaluative norms. The relevant case law of the ECtHR as well as examples of national legislation are analysed in support of these theoretical conclusions. Since the lack of uniform application of the evaluative norms of the Convention causes divergent use of the ECtHR’s judgments in the domestic judicial system, it is advised to follow a number of rules for reasoning of decisions by the domestic court. These rules will serve as a certain guarantee against ambiguous implementation of ECtHR judgments at the national level.

This article presents theoretical concepts and methodological tools from multimodal (inter)action analysis that allow the reader to gain new insight into the study of discourse and interaction. The data for this article comes from a video ethnographic study (with emphasis on the video data) of 17 New Zealand families (inter)acting with family members via skype or facetime across the globe. In all, 84 social actors participated in the study, ranging in age from infant to 84 years old. The analysis part of the project, with data collected between December 2014 and December 2015, is ongoing. The data presented here was collected in December 2014 and has gone through various stages of analysis, ranging from general, intermediate to micro analysis. Using the various methodological tools and emphasising the notion of mediation, the article demonstrates how a New Zealand participant first pays focused attention to his engagement in the research project. He then performs a semantic/pragmatic means, indicating a shift in his focused attention. Here, it is demonstrated that a new focus builds up incrementally: As the participant begins to focus on the skype (inter)action with his sister and nieces, modal density increases and he establishes an emotive closeness. At this point, the technology that mediates the interaction is only a mundane aspect, taken for granted by the participants.

The main predicament presented in this article lies in the complexity found in the internal structure of the human being when one searches for key elements that define its essence and uniqueness. The overview begins with empirical research as exemplified in psychology, continues in presenting chosen theories in modern philosophy, with an accent on the phenomenological method, and subsequently puts forward the synthesis of them both in psychotherapy. The last part is dedicated to theology as a distinct way to uncover what the essence of being human is, as based on divine Revelation; the latter is the only one of the presented sciences to be explicitly aware of the source of the mystery at the basis of being human. This article attempts to compare the research end results of chosen approaches by demonstrating their relationship to the most hidden aspects of being human. The analysis is organized around the concept of recognizing and accepting the place of mystery in the understanding of what are the most essential elements in the human being. As a result, psychology is conceptualized as a science that does not allow mystery; theology, however, is found to underline the presence of mystery in relationship to our divine origins.

In this follow up paper, the ribovirocell concept from the first part of the study is linked to the ontological realm of human reality before, during and in the aftermath of COVID19. During this fluid space-time, human reality is multi-faceted and often very complicated. The authors present a division of the reality into fundamental reality and situational reality. Fundamental reality is based on the (physical) laws of nature such as the speed of light as a fundamental physical constant. This reality spans beyond the course of time as perceived by humans, which is beyond the duration of a single or multiple human lifespans and beyond the duration of the COIVD19 pandemic. Next to fundamental reality and overlapping with it, exists the situational reality, which humans experience directly themselves during their lifetime(s). Actions of humanity and of individual human beings contribute to the shaping of the situational reality. Examples of the situational reality can be e.g. experiencing atrocities that humanity has committed, humanity’s actions to prevent such atrocities in the future, as well as human progress in eliminating poverty/inequality in the world. At least, some aspects of human lives take place at the boundary between the fundamental and situational reality. The COVID19 pandemic is linked to the concepts and the boundary between the fundamental and situational reality that human’s experiences, such as speed of pandemic impact and shifting nature of reality. The ribovirocell state of one’s self is linked to the way to apply the speed as a threshold concept for resilience in the coronavirus space-time and the post-COVID19 world
