Opis:
Spoofing involves masking the identity of a person, group or organisation, by manipulating addresses, identifiers or other data used to identify a user or system. This can range from falsifying IP addresses, phone numbers and email addresses to generating persuasive, fake signals capable of disrupting the reception of legitimate GPS signals by receivers. The article aims to analyse the criminal liability of spoofing attacks, with a focus on CLI spoofing. Additionally, the article will identify the most common methods used by perpetrators of spoofing attacks. This will be followed by an examination of the statutory measures implemented in Poland to mitigate the effects of spoofing attacks, which are considered as reasons for criminal responsibility. The article confirms the research hypothesis that effective reduction of CLI spoofing requires not only legislation that introduces criminal liability for spoofing, but also appropriate legal regulations that impose certain obligations on telecommunications entrepreneurs, efficient international cooperation, and comprehensive education in the fields of cybersecurity and cyber hygiene.

The article focuses on the possibility of excluding criminal liability of artists for their conduct which bears the attributes of an offence against religious feelings and which is a manifestation of their artistic expression. The existing conceptions of a non-legal justification based on art are analysed. The article also deals with the importance of the right enjoyed by journalists to publish negative appraisals of creative, professional and public acts, and its impact on the assessment of the punishability of a conduct that insults religious feelings. Also, reference is made to the possibility of evoking a justification by the injured party’s consent in the case of an offence against religious feelings, especially in a situation when the victim comes into contact with the offensive content deliberately and voluntarily. The dogmatic considerations are supplemented with a presentation of court rulings that are relevant to the study.

Misuse of power is a crime that threatens the proper functioning of state institutions, undermining trust in the system of power, and creates a particular sense of injustice among the citizens who come into contact with it. Service in the Police puts before each officer a number of duties, resulting from the provisions of law contained in acts, regulations as well as decisions and orders of superiors. Few professions are so ethically demanding and so full of moral conflicts. No other profession requires making moral judgements about the behaviours of other people, and using in response to these behaviours appropriate social reactions, based on moral reasons. The crime of abuse of function involves the exceeding of powers or failure of a public officer to perform his duties, and such abuse of power must be to the detriment of a public or private interest. Acting to the detriment means that the offender's conduct poses a threat to any public or private good. The crime of abuse of power consists in the action of an entity having specific duties and powers in the public sphere, where that action consists in exceeding the powers or failing to fulfil the obligations to the detriment of a legally protected good. In each case a number of activities are required to establish the source of the right or obligation of a public officer to take specific actions, to define the addressee and the content of the right or obligation, and in the event that the public officer is under an obligation to act, also to determine the moment of updating the obligation. Furthermore, an indication of the part of the actual conduct of the offender which was directly related to a specific prohibition or order and a demonstration that the actual conduct of a public officer was contrary to that prohibition or order. Exceeding the powers by a public officer should be considered a specific type of factual and formal event, when there is a breach of an official order or prohibition binding on this person.

As self-driving evolves day by day, the accidents attributed to such technology will increase as well. If the legal environment does not prepare for these cases, the ‘liabilityvacuum’ caused by the diverging court practices could lead to the rejection of the self-driving vehicles both by the consumers and the legislators. I am approaching the various questions posed by this technology from a continental standpoint, therefore the research examines the liability of the natural persons behind the technology. If we can provide possible answers to these issues, then the criminal liability of legal persons – an unfamiliar concept from the standpoint of the majority of the continental criminal law regimes – does not have to be applied to answer the central questions. If the national rules can determine the obligations of the natural persons travelling in a self-driving vehicle, their criminal liability can be decided accordingly and there is no need to create new offences.

The process of advancement of artificial intelligence (hereinafter: AI) seen in recent years results in breakthroughs in many areas of human life, such as medicine, agriculture, and science. However, despite its many advantages and benefits, it also inevitably creates room for abuse. This is particularly true of child pornography, where AI systems are increasingly being used to generate nude images of minors – both existing in reality and fictional. These cases, given much attention in the public debate, cause doubts as to whether existing normative solutions are suitable to combat this new phenomenon. The article aims to answer the question of whether the existing law makes it possible to successfully prosecute perpetrators who use AI systems to generate child pornography (including that depicting fictional characters). In addition, it also offers an analysis of the criminal liability of the developers of the AI systems used in this process and of the hosting providers managing the websites used to distribute such pornographic content.

Somnambulism is one of the sleep disorders described in the literature, which is classified as NREM sleep parasomnia. It is also referred to as noctambulism or more commonly as sleepwalking. At the same time, incidentally, certain sleep disorders can be associated with the unconscious performance of activities and even acts leading to material damage, body injury or even loss of life of another person or people. Therefore, the aim of this paper is to present the difficulties in establishing criminal liability in the event of committing offenses in alleged sleep-related unconsciousness, when an episode of sleepwalking may constitute exemption from criminal liability. Information from the current medical and legal literature, both in English and Polish, was used when considering somnambulism in terms of criminal liability.
Jednym z zaburzeń snu opisywanym w literaturze jest somnambulizm, zaliczany do parasomni snu NREM, nazywany również sennowłóctwem lub bardziej potocznie lunatyzmem. Jednocześnie, incydentalnie, pewne zaburzenia snu mogą wiązać się z nieświadomym wykonywaniem czynności a nawet czynów prowadzących do wyrządzenia szkody materialnej, uszczerbku na zdrowiu czy wręcz pozbawienia życia drugiej osoby lub osób. W związku z tym, celem prezentowanego opracowania jest przedstawienie trudności w ustaleniu odpowiedzialności karnej w przypadku popełniania czynów zabronionych w domniemanej nieświadomości sennej, kiedy epizod somnambulizmu może stanowić o wyłączeniu odpowiedzialności karnej. W rozważaniach na ten temat posłużono się informacjami z aktualnego piśmiennictwa medycznego, prawnego oraz literatury zarówno polskiej, jak i anglojęzycznej.

The article sets out the nature, the history and the general structure of the crime against humanity and provides a comprehensive analytical commentary of the elements of such crimes as a problem of international law. The contextual element determines that crimes against humanity involve either large-scale violence in relation to the number of victims or its extension over a broad geographic area (widespread), or a methodical type of violence (systematic). This excludes random, accidental or isolated acts of violence. In addition, Article 7(2) (a) of the Rome Statute determines that crimes against humanity must be committed in furtherance of a State or organizational policy to commit an attack. The plan or policy does not need to be explicitly stipulated or formally adopted and can, therefore, be inferred from the totality of the circumstances. In contrast with genocide, crimes against humanity do not need to target a specific group. Instead, the victim of the attack can be any civilian population, regardless of its affiliation or identity.

Odpowiedzialność karna za nieprzeszkodzenie samobójstwu w polskim prawie karnym Streszczenie Artykuł został poświęcony problematyce nieprzeszkodzenia samobójstwu w polskim prawie karnym. Zagadnienie to ma charakter interdyscyplinarny i bardzo złożony. Ramy niniejszego opracowania pozwoliły na prezentację jedynie wybranych kwestii szczegółowych, takich jak: pojęcie nieprzeszkodzenia samobójstwu, prawo podmiotowe do samobójstwa oraz kwalifikacja prawna nieprzeszkodzenia samobójstwu. W świetle zaprezentowanych rozważań przyjęto, że zagadnienie odpowiedzialności karnej za nieprzeszkodzenie samobójstwu, rozumiane szeroko, jako niepodjęcie akcji ratowniczej w trakcie realizowanego już zamiaru pozbawienia się życia, jak i nieodwrócenie skutków takiego zamachu, kształtuje się odmiennie w zależności od statusu podmiotu dopuszczającego się zaniechania. Chronionemu z perspektywy jednostki prawu do życia odpowiada po stronie ogółu obowiązek ochrony życia, tj jednostka ma prawo do życia, wszyscy inni mają natomiast obowiązek, by je chronić.

The relevance of the article is attributed to the swift evolution of the social and state system. With the advancement of the political, economic, and social dimensions of existence, there is a growing need to consider public opinion and enhance public legal awareness in the medical domain. The purpose of the study is to apply correlation analysis in comparing legal sciences and medical sciences, combining them, and subsequently utilizing applied legal dialectics within the realm of medical law knowledge. To achieve this goal, dialectical and logical methods, as well as general scientific methods such as observation and generalization, were employed. Globalization processes are supranational in nature, and under conditions of driving factors are subject to constant development. The medical field is not an exception and is influenced by other sciences, including legal doctrine, informatics, and economics. Clinical research in the medical field is subject to international influence and development, unification and legal regulation. Internationalization processes are making innovative adjustments to the development of medical science, introducing advancements such as artificial intelligence, personalized medicine, predictive medicine, preventive medicine, participatory medicine, and precision medicine. Consequently, personalized patient data is designated as sensitive and necessitates additional legal regulation. Additional attention is paid to the issue of criminal liability of medical workers as special subjects of professional activity. The results of research are reflected in the established search routes of the possibility of improving legal awareness of medical personnel in the context of practical professional activity. Such practical ways can serve as: the creation of informative material of legal content, adapted to the understanding of persons who are not specialists in the field of law, instead, they are professionals of high intellectual level of medical services. The practical importance of the results of creating information and legal content of the medical industry can be reflected in the results of advanced training by medical personnel, in addition, in the elements of self-education of doctors – researchers, private doctors – specialists, etc. Analytical study of the statistical informative material of the medical industry is reflected in legislative and normative legal acts, taken into account in the case law of the national level, taking into account the decisions of the European Court of Human Rights.

The article discusses the issue of legal liability of managers set out in the Polish competition and consumer protection law, resulting from the Act of 16 February 2007 on competition and consumer protection (Dz. U. (Journal of Laws) of 2021, item 275) (hereinafter: Competition Act). The starting point for my reflections is the provisions of the Competition Act providing for financial liability of persons in managerial positions for infringing prohibitions resulting from competition law (Article 106a of the Competition Act). In Polish law this type of liability is subsidiary to the liability of undertakings. It was also introduced to the Competition Act relatively recently, after the principles of undertakings’ liability for infringements of competition law had been formed and developed. My goal is to present the scope of managers’ liability and present conclusions resulting from the recent, still rather innumerable, case law of the Polish Competition Authority (President of Office for Competition and Consumer Protection, UOKiK). Due to the quasi-criminal nature of Article 106a, I propose my own reflections on the development of managers’ liability considering whether the law and judicial decisions recognize adequate standards of their rights.
