The term protection of consumers' interests falls into descriptive catego-ries and is used to characterize a set of actions aimed at consumer protec-tion facing threats against his/her rights and interests. However, the de-scription of this concept has significant effects. Depending on the sphere of interests and the adopted perspective of observing phenomena and the cur-rent socio-economic situation, the point of view is changing into a set of ac-tions which are important for the consumers’ interests. The idea of protecting consumers' interests appeared already in the nine-teenth century under the conditions of the emerging market economy. The first steps to protect buyers against dishonest trader practices were under-taken by the developing cooperative movement. Consumer movement, like many social movements, was born in the period of rapid growth of industrial-ization in the second half of the nineteenth century. At first, the strongest development was in the USA. Then, the protection of consumer’s interests was developed at the level of the United Nations and became one of the European Union's priorities. It is worth mentioning that European integration has set the problem of protecting consumers' interests in a new light. We should also emphasize that due to the fact that the consumer is a weaker party in the market game, his/her interests are not threatened along with the tightening of relations within the European Union. The development of the European market, but also of the global one, changes only the goal and the direction of the threats against consumer’s interests. Among the prerequisites of protection of consumers' interests, there are usually three groups: economic, legal and social. Economic reasons relate to the massiveness of trade in goods and the monopolization of the market and the so-called consumer atomization and abuse of marketing instru-ments, as well as globalization of the economy, which is associated with decreasing and limiting the role of the state on market. The social founda-tions of protection arise from the need to protect life and achieve human rights. Here, in particular, care for health and standard of living, consumer safety, care for the natural and social environment and the level of consum-er awareness are considered important. The premises for the legal protec-tion of consumers' interests arise, inter alia, from the compulsory situation in which consumers find themselves, the lack of proper preparation for estab-lishing a contractual relationship, representing the smaller property potential, as well as limited possibilities in terms of time and resources that can serve to satisfy their needs. One should also add limited communication of legal regulations and poor knowledge of the principles of shaping the content of the legal relationship established by the consumer. Therefore, the legal pre-requisites for protection concern areas of activity in which the law is not ad-justed according to the conditions of a market game. The source of unfavorable phenomena for the consumer − degrading it in the legal, economic and sociological sphere − is the mass character of trade. This fact results in the loss of important sovereignty for the consum-er. The market economy creates many economic and social problems. Technical progress, mass production, degradation of the natural environ-ment, huge wealth of market offer of goods and services, flood of infor-mation, intense promotional activities of companies are a threat against con-sumer sovereignty and his/her interests. It is also worth pointing out the reasons for the weakness of the consum-er as a market participant. The consumer is urged to meet his/her needs, which often means that he/she is ready to accept the conditions proposed to him/her. He/She also has a weaker position with respect to the group of producers and sellers in terms of economy, time and mental resi- lience. Moreover, the consumer does not have such knowledge of commod-ity, technical, economic and legal matters as producers or traders. He/ She has a threefold role as: recipient of promotional activities of enter- prises, buyer of goods and services, and user of purchased products. Appreciating the importance of the issues of consumer’s interests protec-tion under the current socio-economic circumstances, taking into account the ongoing globalization processes and ever closer European integration, attempts have been made to characterize and assess consumer protection standards in Europe. This book will provide the reader with the necessary information on the topic of the European Union, as well as for the latest consumer empower-ment on contemporary integrated European market. The book is written by European researchers, for whom the problem of consumer rights protection plays a particularly important role and who want to improve the awareness of threats that consumers face on the modern market. The primary target audience of this book will be students who study busi-ness and management and who will be responsible in future for the devel-opment of durable and long-term relationship with consumers. The book will be also useful for consumers on the European market. Academic research-ers as well as practitioners from the business field should be interested in this book. This book should help them to rethink what they do, how they are doing, to encourage them to create effective relationships with consumers and protect their rights. The entire work is divided into three parts. The first part provides an in-troduction to the topic and focuses on the understanding of consumers, their market behaviours as well as the consumption on the European market. This part includes chapters describing different roles played by the con-sumers, their market behaviours, consumer decision making process as well determinants of consumer behaviours. This part also includes descrip-tion of the concept of consumption and of the consumers’ values. Finally, the reader can find an analysis of the importance of consumer awareness phenomenon. Part two presents selected aspects of contemporary compa-nies’ behaviour and issues related to threats against the consumer created by companies on contemporary European market. Furthermore, the authors tackle the problem of competition as well the companies’ ethical and non-ethical beahviors.This part also includes several chapters dedicated to companies’ practices requiring consumers’ protection and consumer awareness and their impact on businesses. And finaly, part three is dedicat-ed to consumers and their protection standards in Europe. One can read about the problems regarding consumer policy on European market, includ-ing models and organizational structure. In addition to it, there are chapters describing consumers’ rights, institutions of consumer rights protection, dif-ferent law and regulations related to classical and digital market, tangible goods, and services sector. The last part ends with several issues related to building consumer awareness. The book itself has been the outcome of a project named Enhancing quality in innovative higher education about consumer awareness – Con-sume-aware, co-funded by the Erasmus+ Programme of the European Un-ion. This project was created by eight partner universities from the Dukenet International Network, including: University of Economics in Katowice – pro- ject leader, Howest University of Applied Sciencies, University of Bucharest, Université Savoie Mont Blanc, Seinäjoki University of Applied Science, Bu-dapest Business School, University of Trento, and University of ISIK. Responsible borrowing means a thorough reflection on the need to become indebted, full transfer of true information affecting creditworthiness, comprehensive analysis of the credit agreement, and refraining from avoiding the repayment of loan obligations. The main purpose of the article is to verify the hypothesis that Polish legislators make only the lenders fully responsible for excessive borrowing on the consumer loan market. The following research methods were used: critical analysis of the subject literature and economic analysis of the respective legal provisions. On the basis of the analyses conducted, areas were identified in which the legislator should use the appropriate legal instruments stimulating responsible borrowing. Among them the following were listed: the consumer’s obligation to prove the absence of overdue payments and the consumer’s notifiation of becoming acquainted with the terms of the loan agreement.

The rapid development of digital financial technologies in Ukraine leads to the emergence of new risks and to significant consumers’ losses in the financial market. The aim of the study is to develop strategic directions of state policy of consumer protection in the digital financial services market considering the best world practices and features of the financial system of Ukraine.System scientific analysis was used to study the possibilities of implementing international quality standards for digital financial services in Ukrainian legislation. The method of statistical analysis of data was used to form the imperial basis of the study.Based on the global experience and taking into account the peculiarities of Ukrainian fintech market the state policy should consist of three strategic directions: 1) create a system of legal regulation of the mechanism of protection of consumers’ rights of digital financial services; 2)introducing a risk-oriented approach to regulating the digital financial services delivery processto consumers; 3) strengthening of digital financial literacy and public awareness. Such state policy will form a reliable system of consumer protection in the digital services market in Ukraine.

Consumers are very important participant of the financial market, generating high demand for its products and services. However, as non-professional clients, they require a special legal protection, securing their interests in contractual relations with financial institutions. The European Commission, as well as the national legislation of the Member States of the European Union seek to provide it for consumers, although it manages to varying degrees of success. The EU has no regulations, which for example might oblige member states to establish institutions of insured protection. Changes are also required when it comes to the protection of clients of failed investment companies, also in Poland, especially the amount of cover and the date of compensation payment. In Poland, there is a lack of a comprehensive law, aimed at the problem of inaccurate advertisement, misleading the customers. Conclusion of a fragmentary legislation in a number of different legal acts, certainly does not promote the elimination of unfair behavior of advertisers. Finally, there is too many 'abusive clauses' in contracts concluded with consumers, acting to their detriment. The aim of the study is to present the key elements of the consumer protection system, combined with the indication of the EU and the Polish legal basis, regulating the related issues and arising in connection with system operations the dilemmas. The individual client's protection system includes: guarantee schemes protecting customers of failed financial institutions; activities to eliminate information asymmetry, manifested by an increase in information obligations of financial institutions for their clients; prohibition of the use in contracts concluded with consumers prohibited contractual provisions, called "abusive clauses" by the professional side of the transaction; non-judicial institutions which settles disputes between clients and financial institutions, protection of personal data. The paper remains narrative and draws on the conceptual analysis of the current state of affairs supported by deduction and induction as core methodology (original abstract)

Aim/purpose – The purpose of the paper is to identify the main areas of customers’ threats concerning using financial services and the in-depth review of European industry- -specific consumer regulations concerning current accounts and payments. Design/methodology/approach – Desk research including in-depth analysis of industry- specific consumer regulations referring to current accounts and payment services having the character of EU directives and regulations, European Commission reports, and documents. Findings – The paper shows that consumers’ interests are threatened even when they use basic financial services as current account and combined payment instruments. The analysis based on of desk resources has revealed that the regulations give effect to customer protection only if they strictly correspond to defined areas of threats and particular types of risks. Research implications/limitations – The experience of the recent financial crisis proved that the asymmetry of knowledge and information was one of the crucial reasons disrupting customers’ position on financial markets. Research findings will help to identify gaps in regulations and develop the quality of further initiatives aimed on informing customers about the implementation of regulations and improving their financial literacy level. Originality/value/contribution – The payment products are rarely discussed in the literature in the context of consumers’ protection and financial regulations. This paper contributes to the debate by providing an overview of financial consumer protection issues concerning retail payments.

Legislative activities aimed at intensifying consumer protection have been observed in this area for several years. In this respect, public law institutions adopted in this system play the leading role. W publikacji omówione zostały wybrane aspekty instytucjonalno-prawnej ochrony konsumentów na szczeblu ponadnarodowym – unijnym. W dalszej części artykułu wskazano na instytucje unijne, bezpośrednio związane z tworzeniem standardów prawnej ochrony konsumentów. Nazwane zostały ponadto instytucjonalne modele ochrony konsumentów w wybranych państwach Unii Europejskiej. Ostatnia część artykułu pełni rolę konkluzji i zawiera rozważania na temat istoty oraz znaczenia instytucjonalnej ochrony konsumentów we Wspólnocie.
The article is based on the analysis of the legal acts, literature concerning the subject and information found in the official website of the institution of protection. The work elaborates the scheme of institutional consumer protection developed in the European Union. Selected aspects of institutional and legal consumer protection matters were discussed. The institutions directly concerned with the creation of the consumer protection standards have been pointed out. Moreover, some of the institutional schemes of consumer protection in the selected States in EU were named. The final part of the article is the conclusion that elaborates the matter of importance of institutional consumer protection in the European Union.

The former socialist/communist rule kept Romania almost isolated from the Western World during about half a century (1945-1989). All about 7000 Romanian former state-owned companies (which were operational at the end of 1989) were obliged, by Law, starting the years ‘60, to organize their own so-called „CTC (Technical Quality Control) Department”, in order to only inspect the quality of their products. In 1992, two years only after the fall of Ceausescu’s dictatorship, in Romania were published both the first Romanian edition of famous ISO 9001 standard (in 1987, when ISO published its first international issue, the former Romanian regime did not allow the translating of it in Romanian!) and the first Consumer Protection Act in Romania’s history. This paper introduces - from both historical and professional insider’s perspective - the most important facts, challenges, issues and outcomes of these very important events, happened over two decades ago.
Poprzednie komunistyczne/socjalistyczne zasady trzymały Rumunię w izolacji od świata zachodniego, przez ponad pół wieku (1945-1989). Około 700 rumuńskich przedsiębiorstw państwowych (które działały pod koniec 1989 roku), były zobowiązane, przez prawo, od lat 60-tych do organizacji własnych oddziałów zwanych Technicznymi Oddziałami Jakości, w celu przeprowadzania kontroli jakości swoich produktów. W roku 1992, dwa lata po upadku reżimu Ceausescu, w Rumunii opublikowana została pierwsza norma ISO 9001 (w 1987 roku, kiedy ISO opublikowała swoją pierwszą międzynarodową normę, rząd w Rumunii nie wyraził zgody na jej tłumaczenie) a także Consumer Protection Act - pierwszy w historii Rumunii. Niniejszy artykuł przedstawia - zarówno z perspektywy historycznej jak i zawodowej - najważniejsze fakty, wyzwania, problemy i rezultaty tych ważnych wydarzeń, które miały miejsce ponad dwie dekady temu.

Przez ostatnią dekadę tempo wzrostu gospodarki cyfrowej istotnie przekraczało postęp w tradycyjnych sektorach. Literatura ekonomiczna podkreśla pozytywny wpływ e-commerce na produktywność pracy, siłę nabywczą konsumentów i PKB. Zbiór badań opisujących politykę gospodarczą wspierającą handel internetowy jednak jest skromny. Konsekwencje zaniedbań widoczne są w Unii Europejskiej – kraje członkowskie zanotowały porażkę we wdrażaniu agendy cyfrowej z uwagi na małe obroty międzynarodowe w handlu internetowym oraz niskie uczestnictwo małych i średnich przedsiębiorstw (MSP) w rynku cyfrowym. Celem badania jest ilościowa analiza czynników wspierających rozwój e-commerce na podstawie panelu gospodarek UE w latach 2010–2015. Autorzy wskazują istotną rolę inwestycji w infrastrukturę ICT oraz działań prowadzonych dla ochrony konsumenta. Taki wniosek implikuje zasadność dostosowania przepisów związanych z bezpieczeństwem zakupów przez słabsze gospodarki do liderów. Autorzy odrzucili hipotezę wskazującą, że niesprzyjające czynniki geograficzne i demograficzne mogą permanentne spowolnić rozwój handlu elektronicznego. Badanie wskazuje również na niewielki związek czynników strukturalnych np. poziomu PKB per capita, wskaźników skolaryzacji czy umiejętności informatycznych z łącznym udział e-commerce w handlu detalicznym. Autorzy zidentyfikowali również strategię digitalizacji zaaplikowane przez rządy Irlandii i Czech jako najbardziej skuteczne w UE m.in. z uwagi na sukces wdrożenia handlu internetowego w sektorze MSP.
During the last decade the digital economy has expanded at a faster rate than traditional sectors. There is a strong consensus that e-commerce has a positive impact on labour productivity, GDP growth and consumer purchasing power. However, factors determining successful adoption of online commerce remain insufficiently studied. The consequences are clearly visible in the European Union whose countries failed to achieve the targets of the Digital Agenda 2015, with insufficient cross-border trade and inadequate participation of small to medium-sized enterprises (SMEs) in the digital market. The aim of this paper is to fill the research gap with an EU28 panel study describing the impact of policy factors on online sales from 2010 to 2015. The authors have found that internet network coverage and adequate protection of consumer rights are significant and equally important factors influencing online turnover. This implies the need to harmonise national policies between EU laggard countries and digital market leaders. Furthermore, our research rejects the hypothesis that geographical and demographic factors could create a permanent negative bias on online sales volume. The study also provides evidence that the impact of structural macroeconomic variables (i.e. country income measured by GDP per capita, education, and ICT skills) on final e-commerce turnover is limited. Finally, the authors have established that the national policies of Ireland and the Czech Republic are more effective than those of other EU countries, which is most likely due to increased support of SME engagement in online activities.

Given a choice between two systems of contract rules, a court or legislature may have a normative obligation to adopt the rule that is more susceptible to coding and automation. This paper explores the ramifications of that normative proposition through the lens of multiple contract doctrines that traditionally involve “messy” judgments or multiple interacting judgments regarding which human beings are – arguably – capable of making finely nuanced analyses. Using the common law doctrine of unconscionability and Polish Civil Code Article 385 on unfair terms in consumer contracts, this paper explores the differences between contract rules that require human analysis versus those that can be applied with strong reliability by automated processes. Finally, the paper analyzes some of the potential pitfalls of this normative proposition in light of technological, economic, and moral/ethical concerns.
En donnant le choix entre deux systèmes de règles contractuelles, un tribunal ou une législature peut avoir l'obligation normative d'adopter une règle qui est plus susceptible de codification et d’automatisation. Cet article analyse les conséquences de cette proposition normative à travers des différentes doctrines contractuelles qui impliquent traditionnellement des jugements “désordonnés” ou des jugements multiples dépendant de la profondeur de l’analyse. En faisant la référence à la doctrine de “common law” de l’inconscience et à l’article 385 de Code Civil polonais concernant les clauses contractuelles abusives dans les contrats conclus avec les consommateurs, cet article explore les différences entre les règles contractuelles qui exigent une analyse humaine et celles qui peuvent être appliquées avec une grande fiabilité par des processus automatisés. Enfin, le document analyse certaines difficultés potentiels de cette proposition normative à la lumière des préoccupations technologiques, économiques et morales / éthiques.
