Opis:
This article is entirely devoted to the issue of discharge from ser-vice in the Police under Article 41(1)(1) of the Police Act. Exemption on this legal basis requires that a medical committee must issue a medical certifi cate to the police offi cer, which states that he/she is totally incapable of serving in the Police. This must be a fi nal decision. Issuing a fi nal ruling requires the superior in charge of personal matters to discharge the police offi cer from offi cial duties in the Police, before he/she is dismissed from service. During the period of dismissal from offi cial duties, the police offi cer retains the right to full salary despite not performing service duties.

Opis:
The police process huge amounts of personal data without which they would not be able to carry out their basic tasks. The data processed by the police have a very different nature and scope. Data processing in such large quantities and in such a wide range is associated with great responsibility for its safety. Maintaining a high level of security becomes a challenge when, at the same time, it is necessary to take care of the rights of data subjects. The article contains an overview of administrative decisions issued by the Inspector General for Personal Data Protection (currently: the President of the Personal Data Protection Offi ce) relating to police activities. The issues of the implementation of the rights of data subjects are discussed in three areas, i.e.: sharing information from police resources, deleting data from the National Police Information System, and verifi cation of identity documents.

Firearms, ammunition, incapacitating sprays, and certain tools and devices with the potential to pose a risk to health or life, may only be possessed with a weapons licence issued by a competent authority. Firearms licences are both issued and revoked as administrative decisions. A revocation decision must meet the general requirements for this type of administrative act, and also specify the applicable legal grounds. When a negative decision is issued, resulting in a right being taken away (such as firearms licence revocation), special consideration should be given to the grounds, making it clear why the authority chose to take such a decision. Pursuant to the generally applicable administrative procedure laws, a statement of factual grounds should, in particular, specify the facts the court considered proven, including the underlying evidence, provide the reasons why the court dismissed other evidence as implausible, and inconclusive, and state the legal reasons for the decision, including references to the relevant laws.

The aim of the work is to verify the hypothesis that the institution of suspending a police officer from official duties is a very important element of administrative and legal protection of all Police officers in Poland. The service relationship under which a Police officer performs activities entrusted to him by the state is an administrative legal relationship. Performing official duties resulting from the content of the administrative and legal relationship between a police officer and the state is the duty of every officer. However, the Police Act provides for the institution of suspending a policeman from official duties, which makes it possible to prohibit a policeman from performing official duties for a specified period of time. The paper discusses two types of suspension in official duties, i.e. obligatory and optional suspension. Attention was also paid to the effects of suspension in official duties on the policeman's service relationship. The dual nature of the institution in question was emphasized. This institution serves to quickly deprive a policeman of the opportunity to perform his official duties until the criminal or disciplinary charges against him are clarified. First of all, however, it has a protective nature for the officer, as it allows him to remain in service despite such allegations being made against him.
