In this paper, we provide answers to the currently open question of workers' participation in the employer's decision-making process from the perspective of location and the role of trade unions and workers' councils in this process, covering the entire period from the Socialist Federal Republic of Yugoslavia to the Republic of Croatia. Both bodies are charged with protecting, promoting, and advocating the rights of workers, but their place, position, and manner of acting are very different from the basis of labor law. With the aim of understanding the similarities and differences of both bodies, the observation of the social phenomenon was approached from an ideological, theoretical and practical point of view and through the ontological meaning of "why something is the way it is" and the emergence of unions and workers' councils. Through a scientific and professional understanding of trade unions and workers' councils and their normative-legal regulations, their ideological and theoretical aspect of social phenomena in practice is determined. Consistent with the above, the authors answer the following question in the paper, "To what extent are unions and workers' councils complementary, and to what extent do they affect the achievement of a common goal with respect to the protection of workers' rights?". In order to answer the question, the authors have applied the method of induction and deduction in the determination of terms from the field of labor rights, especially trade union/works council law, on the basis of which they have then analyzed their similarities and differences by describing and concretizing them, and then applied the method of comparison and the normative-dogmatic method to individual institutes through the labor law regulations of the Socialist Federal Republic of Yugoslavia and the Republic of Croatia in the period from 1973. to 2019. Based on the previously drawn conclusions, in the further consideration the method of analysis and synthesis was applied to randomly selected research related to labor law institutes in the period from 1978. to 2021., namely: Berberović J. (1990); Brajić, V. (1987); Ćupurdija M., Subašić, S. (2019); Ćupurdija M., Subašić S. (2017); Ćupurdija, M. Subašić S., (2013); Ćupurdija M. (2013), Trade unions as a factor of labor law in the Republic of Croatia; Ćupurdija M. (2013) European social dialog as a prerequisite for social security, Ćupurdija M. (2009); Gotovac V., (2007); Herman V., Ćupurdija M. (2011); Herman V., Ćupurdija M., (2010); Marinković Drača D. (2004); Ravnić A., (2004); Šokčević S., (2006); Učur M., Zlatović D., Moslavac B., Malenica I., Ćupurdija M., (2021); A while ago. M. Moslavac B., (2020) and Weiss D. (1978). The thesis was confirmed that there are significant differences between the trade union and the works council in terms of organization, working methods, but also in the area of organization, participation in labor disputes and, finally, participation in collective labor disputes against employers. From the above, it is clear that there is a need for further research in the area of improvement of labor law, namely in the extension and clearer definition of the scope of each body, the protection of workers and the application of the principle of efficiency.

Przedmiotem artykułu jest przedstawienie i analiza z polskiej perspektywy propozycji Rady Unii Europejskiej dotyczącycej kierunków zmian regulacji ubezpieczeń społecznych odnośnie do dostępu (formalnego i rzeczywistego) platform workers do ochrony socjalnej, możliwości utrzymywania, gromadzenia lub przenoszenia uprawnień oraz odpowiedniości poziomu ochrony (w tym wysokości świadczeń) w kontekście specyficznych uwarunkowań związanych z wykonywaniem pracy platformowej, a sformułowanych w zaleceniu Rady z dnia 8 listopada 2019 r. w sprawie dostępu pracowników oraz osób samozatrudnionych do ochrony socjalnej.
The subject of the article is to present and analyze, from the Polish perspective, the proposals of the Council of the European Union regarding the directions of changes in social security regulations regarding the coverage (formal and effective) of platform workers to social protection, the possibility of preservation, accumulation or transferring rights and the adequacy of the level of protection (including the amount of benefits), in the context of the specific conditions related to the performance of platform work, as formulated in the Council Recommendation of 8 November 2019 on access to social protection for workers and the self-employed.

Opis:
The article is devoted to the origin of the concept of the workers’ participation in the management, and then to its implementation in the EU and in Poland. The history of implementing common principles of workers’ self-management in the EU is quite complex; the participation model, the so-called Mitbestimung introduced after World War II in Germany (the act was passed in 1976) was then slowly and in a limited range (informing and consulting) introduced on the basis of the EU Directive of 1977 into the legislation of particular member states. Implementation became quicker when the EU decided to establish, as one of variants, the so-called European Company. In this model the European company committee was provided for. The directive was implemented in Polish legislation by the act of 2002; in companies acting in more than one country there is an obligatory company committee. Similarly, there should be a company committee in the so-called European Company and European Economic Interest Grouping. The European Company is an alternative legal form of company, the same on the territory of the whole EU. The history of workers’ participation in management in Poland, broadly discussed in the article, is much more complex. It started in 1981, under the pressure of the “Solidarity” trade union, with introducing the acts on the state company and the workers’ self-management in the state company. These acts, although they are included in the participation current, broadly outlined the rights of the workers’ committee and of the workers’ (delegates’) general meeting, actually granting them part of the rights to make decisions, that in fact belong to the owner (e.g. dividing the profit, sometimes electing the manager). The intention of these solutions was to introduce a reformed model of an independent company in a still planned economy, and they started a broad current of discussion on efficiency of these solutions and limitations of workers’ participation not only in managing, but also in ownership after 1989. The model of the state company of 1981 (actually, in the practice of the 1980’s significantly reduced by the martial law authorities) turned out to be a temporary one and under the conditions of market economy was substituted by a form that made it possible to introduce direct or indirect privatization. However, it is characteristic that Poland has, independent of the EU, its own ample experience and traditions in solving the problem of workers’ participation in management. The author, who in the 1980’s was a workers’ self-management advisor, synthetically compares arguments for and against introducing solutions that include workers’ participation in company management, and decidedly defends the limited participation model in the EU’s version introduced in Poland by the act of 2006.

Artykuł opisuje działalność Bundu w latach 1897-1939 na terenie powiatu radzyńskiego. Pierwsza część artykułu przedstawia najważniejsze zagadnienia związane z działalnością Bundu przed 1918 r., w tym charakterystyczną dla tego okresu działalność strajkową. Dalsza część artykułu opisuje specyfikę działalności Bundu w okresie międzywojennym, w tym działalność Bundu w miejskich instytucjach samorządowych oraz w gminach żydowskich. Pokazuje także wpływ Bundu na instytucje kulturalno-oświatowe i organizacje młodzieżowe. Ostatnia część artykułu to opis działalności Bundu podczas uroczystości i demonstracji robotniczych.
The article describes the activity of the Bund in the years 1897-1939 in Radzyń Podlaski county. The first part of the article presents the most important issues related to the activities of the Bund before 1918, including the strike activity characteristic of this period. The next part of the article describes the specificity of the Bund’s operation in the interwar period, including Bund’s activities in municipal self-government institutions and in Jewish municipalities. It also shows the influence of the Bund on cultural and educational institutions and youth organizations. The last part of the article is the description of Bund's activity during the workers’ ceremonies and demonstrations.

Objectives In Poland, there are numerous cases of injuries caused by sharp instruments annually, still significantly more than in other European Union countries. The aim of this study was to analyze work-related injuries among healthcare workers in a selected hospital before and after the implementation of safety-engineered devices (SED). Material and Methods Retrospective analysis of medical documentation regarding occupational needlestick and sharps injuries (NSSI) in a tertiary referral surgical hospital in 1998–2018. The study group consisted of nurses and doctors who had been injured and reported the incident. The frequency of injury reports, injury rate, and characterization of circumstances surrounding NSSI are presented. Results Over the period of 20 years, a total of 257 NSSI incidents were reported. The average injury rate was statistically significant for nurses (p = 0.004) and was higher before the introduction of SED. Moreover, the number of injuries among nurses showed a downward trend during the study period. However, for doctors, there was no statistically significant difference in the median puncture rate (p = 0.099), and the number of injuries showed an increasing trend. Conclusions In this study, the authors’ have demonstrated not only the occurrence of injuries and punctures in the daily work of medical personnel but also the potential for their reduction through the use of safety equipment at every workstation where healthcare services are provided using sharp medical instruments.

The paper discusses working conditions of workers employed on drilling and extraction platforms as provided for in the Act on maritime labour of August 5, 2015 (henceforth Maritime Labour Act) from the viewpoint of the their compliance with the European Union and international law. The author examines the problem of classification of drilling and extraction platforms as non-convention vessels in the provisions of the Maritime Labour Act. The analysis leads to a conclusion that, in the light of the Maritime Labour Convention adopted in Geneva by the General Conference of the International Labour Organization (ILO) on February 23, 2006 (henceforth the MLC) and the Act of September 18, 2001 – the Maritime Code, drilling or extraction platforms shall be regarded exclusively as seagoing merchant vessels and as such are covered by the MLC provisions. Workers on drilling or extraction platforms, which at the same time are seagoing ships, should be considered seafarers in the meaning of the Maritime Labour Act. The subject of the analysis covers also regulations concerning the organization of working time, in particular referring to workers employed on drilling and extraction platforms, with respect to its compliance with the EU labour law and the MLC. The regulation of working time of workers on drilling or extraction platforms as provided for in the Maritime Labour Act should be regarded as incompliant with the provisions of the Council Directive 1999/63/EC of June 21, 1999 and the MLC in the scope in which it permits extension of weekly working time to 84 hours and abandoning of the Labour Code provisions stipulating the minimum weekly rest period. The author concludes that the provisions of the Maritime Labour Act have not implemented the Directive 2003/88/EC of the European Parliament and of the Council of November 4, 2003 concerning certain aspects of the organisation of working time (Directive 2003/88/EC). Finally, the author touches upon the issue of judicial protection and asserting labour rights of workers employed on drilling and extraction platforms. The considerations lead to a conclusion that labour courts have the constitutional grounds for applying the MLC with respect to the working time based on primacy of that international regulation over the respective provision of the Maritime Labour Act. Concluding, the author indicates also that the constitutional rule of social dialogue was infringed during in the law-making process concerning the Maritime Labour Act.

Wiosną 1940 r. Niemcy rozpoczęli tworzenie sieci obozów pracy na terenie powiatu zamojskiego i biłgorajskiego. W tym czasie działały one w ramach tzw. planu „Otto”, którego celem była budowa rowu przeciwczołgowego na linii demarkacyjnej ze Związkiem Radzieckim. Obozy powstały w miejscowościach Bełżec, Cieszanów, Dzików, Lipsko i Płazów. Bełżec stał się głównym obozem w połowie sierpnia 1941 roku. Mieściła się tam Centralna Rada Obozowa, która była instytucją pomocową dla robotników żydowskich. Również Rada Żydowska w Lublinie oraz nieliczne Rady Żydowskie z innych miejscowości starały się otoczyć opieką robotników żydowskich. Warunki życia w obozach, ciężka praca fizyczna, sadyzm załogi niemieckiej i niedostateczne wyżywienie powodowały epidemie tyfusu i czerwonki. Skutkiem tego była m.in. duża liczba zgonów. Obozy w ramach planu „Otto” funkcjonowały do jesieni 1940 roku.
In the spring of 1940, the Germans started to establish network of labour camps in the administrative district Zamość and Biłgoraj. At that time, they operated within the so-called Plan Otto: the goal of the Plan was building an antitank trench at the demarcation line with the Soviet Union. The camps were set up in the villages of Bełżec, Cieszanów, Dzików, Lipsko and Płazów. Bełżec became the main camp in the mid-August of 1941. There was loca-ted the Central Camps’ Council, which was an aid institution for Jewish workers. Also the Jewish Council in Lublin and few Jewish Council from other places tried to take care of Jewish workers there. The life conditions in the camps, heavy physical work, sadism of German crew and insufficient food supply resulted in epidemics of typhus and dysentery. The result of that was, among others, serious number of deaths. The camps within the Otto Plan operated until autumn 1940.
