The draft Sejm’s position regards an application of the National Council of the Judiciary, addressed to Constitutional Tribunal, in which the Council applied for determination of conformity to the Constitution of some provisions of the Act on National Council of the Judiciary. It was stated that some provisions, indicated in the application, do not conform to the Constitution, inter alia regarding the possibility to appeal from some resolutions of the National Council of the Judiciary, or allowing to suspend the power of the President of the Republic of Poland to appoint a judge. Moreover it was claimed that the rule referring to appointing a judicial member of the National Council of the Judiciary by the Sejm conforms to the Constitution.

Opis:
One of the elementary conditions of democratic society includes, among others, an active and powerful civil society which acts as an intermediary between the state and citizens. Moreover, the functioning and effective civil society represents the way to influence the public governance. The aim of the article is to research the scope of the relationship between civil society and public governance in the particular post-communist country – the Slovak Republic, where preconditions for establishing a civil society were completely different than in Western democracies. Moreover, the article examines, with the help of analysis and synthesis methods, the contribution that an efficient civil society can make to the democratization process and good governance.

Opis:
The paper aims to present the basis for administrative enforcement of non-pecuniary obligations – an issue not yet discussed in the legal doctrine, or the judgments of administrative courts. The main assumption of the work was that any administrative execution must be sourced in an individual administrative act, which is the basic and most important form of action of public administration. Orders and bans implemented by way of an administrative act and not voluntarily performed become subject of administrative enforcement. A wider analysis of the discussed issue shows a high degree of similarity in the approach to this legal institution in the German and Polish legal systems. The noted differences concern specific solutions of the general administrative proceedings and certain specific legal institutions present in both systems.
Treść artykułu dotyczy nieporuszanego dotąd szerzej w polskiej doktrynie prawa i orzecznictwie sądowoadministracyjnym tematu podstawy egzekucji administracyjnej. W założeniu opracowanie ma być próbą wykazania, że podstawową – modelową podstawą wszczęcia i prowadzenia egzekucji jest indywidualny akt administracyjny. Stanowi on bowiem pierwszą i najważniejszą formę działania administracji publicznej. Nakazy i zakazy nałożone tą drogą, a niewykonywane w sposób dobrowolny, podlegają egzekucji administracyjnej. W wyniku jednak szerszej analizy wskazanej problematyki należy dojść do przekonania, że omawiana instytucja w porządkach prawnych Niemiec i Polski jest co do zasady tożsama. Odrębności dotyczą przede wszystkim specyfiki rozwiązań w obszarze stosowanych odpowiednio uregulowań ogólnego postępowania administracyjnego oraz niektórych szczegółowych instytucji funkcjonujących w obu porządkach prawnych.

The book written by Anna Stawarska-Rippel is dedicated to one of the most important problems concerning the evolution of Polish civil proceedings in the 20th century. She describes the basic rules of Polish civil proceedings, showing their evolution in compara- tive perspective. Austrian, Swiss, German, French regulations are shown to illustrate the motives of the Polish legislator before World War II. Soviet regulations were introduced into Polish law after the war. Not all of them should have been abolished after the fall of communism in 1989. The book written by A. Stawarska-Rippel is a valuable contribution into the research on the history of Polish civil proceedings. It is also important for those who work on recodification of Polish civil proceedings now.

The public policy is a modern concept of political science which has appeared in the middle of the XX century and there is in a condition of continuous updating that specifications. In search of the universal definition of public policy authors are guided generally by philosophical and axiological, spatial and functional options of a scientific explanation of this phenomenon. Philosophical and axiological definition of public policy since Renaissance defined key problems which became the subject of the analysis for modern researchers of this direction. Philosophical reflections on a concept of the fact what is "public", "private", "sphere" and so on. have laid the foundation of a meta-analysis of studying of public policy and have defined conceptual borders for further theoretical searches. Functional interpretation of category "public policy" is rather wide and versatile it is provided in works of researchers of many methodological approaches and theories which connect it with the decision-making process and political and managerial processes. Managerial measurement of public policy allows determining intuitional and technological capabilities of actors of the political process in making public decisions. Close connection of a policy and the state conformable with the ideas of representatives of institutional and neoinstitutional approaches that considered a public policy both as dependent and as independent variable at the same time at the center of scientific research permanently there was an analysis of communication of institutes and society. The criticism of neoinstitutionalism led to a defensive line of authors of this direction and, as a result, before the appearance of new theories in 90's of the XX century, which explain a concept of a public policy taking into account the current trends. First of all, it concerned a study of new institutes and a new role of traditional political institutes in formation of a public policy. The system theory has brought adjustments in essence of the characteristic of public policy. According to the logic of system approach, the modern public policy is complete, dynamic system which is independently updates, organizes and develops. It consists of the interconnected and interacting elements which unite in steady unity with the external environment by means of many factors and conditions of interaction with external. Inclusion by scientists of different schools in the analysis of public policy of such actors as groups of interests, civil society, expert-analytical communities, political parties, has allowed to detail the considered concept. Display in a concept of public policy of not hierarchical communications and structures has become possible because of coalition approach and the theory of political networks. The public policy by means of the theory of networks is considered as concrete types of mediation of interests of different actors (state і non-state) and as the specific form of government. Use of reality of public policy by means of a spatial concept gives the chance to analyse different types of interactions of the individual and collective actors both institutionalized, and not institutionalized in the course of implementation of the power and influence on it in specific political environment which is a complicated developing system with it's ow laws and borders. The public space at all levels (global, regional, national) is constantly changeable structure which is formalized and filled with meanings under the influence of actors. As a result of the retrospective analysis of approaches which operationalize public policy was provided the author's vision of this phenomenon. Public policy is understood as the reasonable interaction of the public actors (institutionalized and not institutionalized, formal and informal) which by means of own resources, functional mechanisms, cultural and valuable and precepts of law, have an opportunity to reveal, implement, analyze and control valid socio-political problems. Since 90's of the XX century, scientists adapt conceptual sense of public policy of the national contexts on the basis of that experience of the state and cultural and valuable changes. The main problem, in this case, is that the above-stated categories not always answer the contents, especially in the conditions of transitional systems. For formation of idea of essence of public policy in the transformed countries it is necessary to use such explanations of these categories which would consider absence of full-fledged civil society and communication between all actors of political process. Specification of categories according to political reality can be the way out. So, the concept public policy is permanently transformed because of changeable political reality that puts representatives of different schools of sciences before a problem of fixed search of new explanations of its content. For the objective reasons, the methodology of political science appeared incapable of giving the answer to a question independently: what is public policy? This opportunity appears only on condition of participation of such sciences as economy, sociology, managing sciences, state administration, systemology, etc.

This article deals with corruption and trust in the public administration of nine countries of the former Western bloc and neutral states, which underwent different institutional development compared to post-communist countries, which were susceptible to corruption due to a strongly centralized public administration with complex decision-making processes and the considerable power of officials. Despite the different institutional development of the public administration in Western countries, these countries are not always perceived by the public as trustworthy and not corrupt. This article reveals that in countries like Switzerland, Norway, and Finland, civil servants are perceived by the public as rather trustworthy and not corrupt, whereas in countries like Spain and France, the opposite is true. Using statistical methods, this article also demonstrates that the perception of the involvement of civil servants in corruption and their unequal treatment of citizens diminishes their trust in the eyes of the public. The experience of respondents with bribery on the part of civil servants reduces confidence in the public administration in only two states. In the other seven, this variable was statistically insignificant.

Public administration minimizes or eliminates threats affecting the security level. Crisis management activities are described in the Act on Crisis Management, which defines in the area of crisis management: competent authorities, their tasks and rules of operation, planning documents and financing of activities. The county self-government has its own and commissioned tasks of above communal nature, related to the removal of direct threats to public safety and order, defense, flood protection, including equipment and maintenance of the county flood prevention and fire protection and prevention of other extraordinary threats to human life and health and the environment. The cooperation of public administration within the framework of fusion on the county level has an impact on the efficiency of managing the security system organized at this level.

The article explores reasons of the abandonment by the Polish legislator of the public law model of the civil service. The discussed reasons were classified into two categories: normative and non-normative premises. The first group discusses the impact of international law on the activities of the Polish legislator and the disproportionately large number of publications on the doctrine of labor law as compared to the administrative law. In the second category, three groups of impact on the legislator’s activities are discussed, i.e. the political perspective (here: systemic, point-based, and episodic impact), clerical, and social perspectives. In conclusion, a return to public-law solutions is proposed.

The subject of the analysis is the issue of the legitimacy of introducing the civil service model in Polish local government administration. Local self-government authorities have been functioning in Poland since the Second Polish Republic (baseding in this respect on various regulations of the partitioning states and France from the period of the Duchy of Warsaw and the validity of the Napoleonic Code). In the too “pink” and overly optimistic perception of the model of Polish local government, attention should be paid to the areas of omissions and visible failures. For such a failure in the light of the functioning of the territorial self-governments of the Second Polish Republic was the failure to establish voivodeship selfgovernments (apart from two units from the former Prussian and German partitions) and the failure to extend the state civil service (according to the model from February 1922) from state administration to self-government administration. Especially after 1994 (the second self-government election), we had to deal with a kind of appropriation of self-government administration structures by strengthening political parties and local coterie centered around village heads or mayors.

Civil service is a key human resource for government administration. Members of the civil service corps are responsible for the professional, reliable, impartial, and politically neutral performance of state tasks. Requirements in terms of qualifications and the scope of tasks in civil service should be correlated with an adequately high remuneration. The aim of the article is to analyse the renumeration of the members of civil service corps from the legal perspective and administration practices. The article presents legal issues related to the regulation of civil service remuneration and the results of the performed analysis of payments. It has been shown that legal regulations do not ensure adequate payment for functionaries and enable a significant diversification of remuneration of people in similar positions.

The period stretching from 1974 till now has been characterized as the most stable period of the political and administrative history of Greece. However, the appropriate organizational culture which can contribute to the creation of a strategic vision for Greek public administration has not yet been shaped. Therefore, the public sector is not efficient and productive. On the contrary, bureaucratic pathogenies are particularly prevalent. These pathogenies have been rendered even more intense during the economic crisis and the recent pandemic. It is necessary that the modern culture of public administration be focused on effective cooperation, the satisfaction of both citizens and administrative executives’ expectations, respect for the individuality and development of public sector executives, the enhancement of public services’ good reputation, assessment, communication and finally the implementation of the principles of ethics, integrity and legitimacy. The culture of a modern public administration should be based on the principles of new public management and electronic government. This article is based on the study of secondary sources, more specifically institutional texts, international and national organizations’ reports, studies, historical texts, as well as civil servants’ views. The conclusions are particularly significant and can spark off the change of the organizational culture in public administration.

In the context of democratic discourse, civil society is given a decisive role in the formation of power and influence on power. However, between the authorities (state and self-governing) and public organizations, as representatives of the interests of civil society, mostly subject-object relations are established, where the subject is the government. The article is devoted to finding an answer to the question: can the model of subject-subject relations between the government and civil society, where both social institutions are equal participants in the political process, have practical application? Analysis of social changes in Western Europe and Ukraine gives grounds to support the point of view of those scholars who consider civil society the basis of the state, a factor that gives a specific character to each state formation, regardless of the generality of democratic processes. At the same time, attention is drawn to the heterogeneity of civil society, which is a barrier to its consolidation and strengthening of subjectivity. There is a noticeable increase in competition between the state and civil society in terms of influencing society, as well as the manipulation of public movements by public authorities to achieve political goals. However, a fairly high level of public confidence in public organizations and the potential for their advocacy allow the use of public influence to activate the population and strengthen the position of civil society in relations with the authorities.

This article discusses the issue of state cooperation with non-governmental organizations in public diplomacy. This has been explored in relation to the liberal perspective in international relations, which very clearly highlights the importance of NGOs as an influential participant in world politics. The article contains an analysis of the international system, categorizes the roles and functions of NGOs in international relations. It shows concepts on contemporary understanding of power and a clear focus on reinforcing and using components of soft power, including public diplomacy, in moden international relations. Methodological aspects are deepened by an analytical layer exploring Civil Society 2.0 Program, what is an example of an effective combination of diplomatic efforts between the state and NGOs to achieve common goals.
