Opis:
The study presents problems of the youngest branch of botany – forensic palynology. It briefly discusses the phenomenon of pollen spectrum – how to analyze it and the scope of its application. Examples of investigative and judicial practices illustrate the usefulness of the palynological method in legal argumentation, with a special emphasis on the usefulness in criminal proceedings. The author also argues for the scientific nature of pollen-spore method and techniques used in it.

The aim of this publication is to present the equipment enabling the collection of comparative material for otoscopic and cheiloscopic identification which was constructed by the company STANIMEX (Ltd.). The authors emphasise that if you have otoscopic and cheiloscopic traces and want to identify a person who may have left the trace, you should collect comparative material of appropriate quality. In addition, interesting data has been presented, provided by the Scientific Development Department of the Central Forensic Laboratory of the Police, concerning, for example, the number of positive and negative identifications.

This essay examines the concept of metacollecting in the context of prosopographical studies. Using meteorite collection as a study case, it demonstrates the need for the development of a comprehensive collection attribute database, which does not only include collectors’ names but also forensic information, such as the handwriting style and printing process used in the production of labels, inventory numbers, etc. After a description of a pilot prosopography study on the history of meteorite collecting, the concept of “collection-objects” is introduced and a socio-historical collection index (SHCI) is proposed to help curators determine the socio-historical a priori value of a meteorite specimen in disregard of its scientifific or monetary value. A high SHCI often represents a factual chain-of-custody, which can be used as input in prosopography.

It is common to use terms like cybercrime and cybersecurity interchangeably. The distinction between the subject scope of both terms in the case of forensic science clearly indicates the direction of the tasks carried out in the areas of tactics and technology. In contrast to cybersecurity, the preventive function of forensic science is to create solutions that strengthen the resistance of information systems to actions that violate the confidentiality, integrity, accessibility, and authenticity of processed data or related services offered by these systems. Ensuring such resilience should be perceived in the context of the activities of entities performing public tasks with the use of cooperating IT devices and software by processing, storing, sending, and receiving data via telecommunications networks using a terminal device appropriate for a given type of telecommunications network.

Computer forensic, despite its significant role in the practice of justice, has not yet – at least in Poland – widely accepted methodology. The article contains review of computer forensics’ standards, frameworks, tools and best practices and includes an attempt to describe and systematize the most important terms and definitions appearing in the scientific and professional literature of the subject.

Modern forensics is a science that has been dynamically developing in recent years, which is related both to the general development of science and technology and to the needs of the judiciary and law enforcement agencies. The main feature of forensics is its interdisciplinarity. All the facts presented cause that the identity of modern forensics is changing. It is, in a way, a natural process. However, it poses a great danger of disintegrating this science. The article presents a discussion on the constantly changing paradigm of forensics, its goals and tasks. Such important theoretical issues have a large impact on forensic practice, primarily on expert opinions, teaching forensics and knowledge of forensics by lawyers.
Współczesna kryminalistyka jest nauką dynamicznie rozwijającą się w ostatnich latach, co wiąże się zarówno z ogólnym rozwojem nauki i techniki, jak i z potrzebami wymiaru sprawiedliwości i organów ścigania. Podstawową cechą kryminalistyki jest jej interdyscyplinarność. Wszystkie przedstawione fakty sprawiają, że tożsamość współczesnej kryminalistyki ulega zmianom. Jest to poniekąd proces naturalny. Rodzi on jednak wielkie niebezpieczeństwo dezintegracji tej nauki. W artykule przedstawiono dyskusję na temat stale zmieniającego się paradygmatu kryminalistyki, jej celów i zadań. Tak ważne zagadnienia teoretyczne mają duży wpływ na praktykę kryminalistyczną, przede wszystkim na opiniowanie biegłych, nauczanie kryminalistyki i znajomość kryminalistyki przez prawników.

Artykuł porusza tematykę badania urządzeń mobilnych uszkodzonych w wyniku zalania. Urządzenia te w obecnych czasach towarzysza nam niemalże bez przerwy i gromadzą wiele informacji, z tego powodu są cennym i często niezastąpionym rzeczowym źródłem dowodowym. Odczytane dane mogą pełnić szczególna role w procesie karnym, ich pozyskanie ze sprawnych i niezablokowanych urządzeń nie powinno przysporzyć większego problemu dla wprawnego informatyka śledczego. Nieco więcej wkładu pracy wymagane jest przy pozyskiwaniu danych z urządzeń, które zostały uszkodzone, np. umyślnie lub w wyniku nieszczęśliwego zdarzenia.
This article is devoted to the issue of examination of mobile devices damaged by water. Nowadays, these devices are with us almost all the time and gather a lot of information, making them a valuable and often irreplaceable source of factual evidence. Read -out data can have a very important role during criminal proceedings and it should not be too difficult for a skilled computer forensic investigator to retrieve data from a functioning and unlocked device. Slightly more work is required to extract data from devices that have been damaged, e.g. intentionally or as a result of an accident.

Email is one of the primary sources of numerous criminal activities, on the Internet, of which some threaten human lives. Email analysis is challenging due to not only various fields that can be forged by hackers or the wide range email applications in use, but also due to imposed law restrictions in the analysis of email body. Despite this being a relatively new area, a number of both open source and proprietary forensic tools, with varying possibilities and versatility, have been developed aiding use by practitioners. In this paper, we review existing email forensic tools for email header analysis, as part of email investigation, with emphasis on aspects related to online crime while still considering legal constraints. Through our analysis, we investigate a common case of cybercrime and examine the breadth of information one may gain solely through email forensics analysis. Additionally, a roadmap for email forensic analysis is presented, combining features and functionality already available, to assist the process of digital forensic analysis.

Opis:
There seem to be a lot of differences between archaeology and forensic science but, when we take a closer look, we may find out that some methods and goals may be similar, especially on the ground of exhumation of graves. Since the early 90s, in Poland, archaeologists more often started to take part in investigations covering mass murders and crimes against humanity committed during the Second World War. It occurred that their methodology is providing best results in this kind of work. At first, archeologists started only as consultants but then they were given a possibility to lead their own field of excavations in that area of interest. Moreover, it led to creating a new subdiscipline called forensic archaeology. It is hard to tell the difference between archaeological and forensical field methods of exhuming graves. Archaeological literature is way more precise in describing that topic, whereas police experts are thought to provide general procedures of securing a crime scene. The most obvious differences between the two fields in question are visible in the methods of documentation. However, there is no doubt that the specialists in each of the disciplines have learned a lot from each other since they decided to cooperate in some specific cases.

Computer forensics is a key science and competency in meeting the growing risks of cybercrime, as well as for criminal investigation generally. In order to provide irrefutable evidence of a potential crime, a specialist in the incident response team (e.g. an IT forensics specialist) must secure the digital evidence in accordance with the correct procedure. There are no strict guidelines on how to do this. It is known that the authenticity and fidelity of data must be preserved. This article will collect good practices developed by specialists in the field of computer forensics. The process of securing the evidence material from a digital data sources for later analysis will be presented.

This article deals with the issue of masking the homicide by its perpetrator. The considerations made hereby are an attempt to bring the problem of the behavior of the homicide culprit at the crime scene, as well as outside of it, which are aimed at avoiding criminal liability for the committed crime. Unlimited human imagination leads to a multitude of ways in which criminals can behave in order to try to hinder or prevent their detection by law enforcement agencies. In addition, it should be noted that on the basis of the Polish Penal Code, the perpetrators who mask their offences do not bear criminal liability.
W artykule omówiono zagadnienie maskowania przestępstwa zabójstwa przez jego sprawcę. Przeprowadzone rozważania stanowią próbę przybliżenia problematyki dotyczącej sposobów postępowania sprawców zabójstw, zarówno na miejscu popełnienia przestępstwa, jak i poza nim, mających na celu uniknięcie odpowiedzialności karnej za popełnioną zbrodnię. Nieograniczona wyobraźnia ludzka przekłada się na mnogość sposobów zachowania przestępców, mających na celu utrudnienie lub uniemożliwienie ich wykrycia przez organy ścigania. Ponadto należy zauważyć, że na gruncie obowiązującego Kodeksu karnego sprawcy, którzy maskują popełnione przez siebie przestępstwo, dopuszczają się tzw. samopoplecznictwa, za które nie ponoszą odpowiedzialności karnej.

Forensics and criminalistics at the end of 20th century won a lot of public attention thanks to popular TV series, such as CSI: Crime Scene Investigation. It has fueled new programs in forensics worldwide. Paper presents practical approach to teaching criminalistics at the Department of Criminalistics, University of Warsaw. Brief description of differences in defining forensics and criminalistics are followed by presenting the development of hands on criminalistics class called CSI: Warsaw. Benefits and downsides of implementing such approach are discussed.
