    The paper is a critical analysis of the index of norms and mechanisms protecting the collective rights of indigenous peoples established at the United Nations. The norms and mechanisms for the rights of indigenous peoples have been studied from two viewpoints: firstly, through the prism of how the norm of ‘the right to self-determination’ is created and implemented within the framework of international cooperation; and secondly, as collective rights, which are both a form of implementation of the individual human right and its complement. The United Nations Declaration on the Rights of Indigenous Peoples has been analysed with the use of the legal and dogmatic method. The conclusion provides an assessment complemented by de lege ferenda postulates.

    Opis:
    The article analyses current international documents that define the criteria of state terrorism. It has been demonstrated that the political decisions taken by the President of Russia Vladimir Putin in relation to Ukraine fall under the criteria of the Geneva Declaration on Terrorism. The scientific interpretation of state terrorism is explored here separately. Furthermore, the root cause of state terror in modern Russia is explained. The authors emphasise that Putin’s rule of modern Russia is no different from the way Peter I ruled the Moscow state, which was based on terror and violence. It is no coincidence that Vladimir Putin, after having visiting in June 2022 an exhibition dedicated to Peter I, compared himself to the tsar. It has been established by the authors that in the 16th century the departure from the tradition of Western-type civilizational development and the decline of the achievements of own culture were oddly combined in the territory of Muscovite Rus with society’s rejection of the basic principles of Asian order and culture. Elements of people’s democracy (freedom) were not entirely replaced by Asian despotism. Instead, a specific phenomenon of purely Russian ungovernability – popular rebellion and despotic arbitrariness – was formed. It is emphasized that the national consciousness was enslaved by both the Leninist and Stalinist administrative and political systems, where anti-Ukrainian rhetoric prevailed. It has been established that the Russian-Ukrainian war provides a historic opportunity for Ukraine to root out pro-Russian political forces and at the same time to hold Russia accountable for international crimes committed by its troops on the territory of an independent state on the direct instructions of Vladimir Putin.
    Artykuł analizuje aktualne dokumenty międzynarodowe określające kryteria terroryzmu państwowego. Wykazano, że decyzje polityczne podejmowane przez prezydenta Rosji W. Putina w stosunku do Ukrainy mieszczą się w kryteriach Deklaracji genewskiej w sprawie terroryzmu. Odrębnie rozpatrywana jest naukowa interpretacja terroryzmu państwowego. Wyjaśniono podstawową przyczynę terroru państwowego we współczesnej Rosji. Podkreślono, że rządy Putina w dzisiejszej Rosji nie różnią się od rządów Piotra I w państwie moskiewskim, które opierały się na terrorze i przemocy. To nie przypadek, że W. Putin po zwiedzeniu wystawy poświęconej Piotrowi I w czerwcu 2022 r. porównał się do cara. Autorzy ustalili, że w wieku XVI odejście od tradycji rozwoju cywilizacyjnego typu zachodniego i schyłek dorobku własnej kultury w dziwny sposób połączyły się na ziemiach Rusi Moskiewskiej z odrzuceniem przez społeczeństwo podstawowych zasad ładu azjatyckiego i kultury. Elementy demokracji ludowej (wolności) nie zostały całkowicie zastąpione przez despotyzm azjatycki. Zamiast tego ukształtowało się specyficzne zjawisko czysto rosyjskiej niemożności rządzenia – powszechny bunt i despotyczna samowola. Podkreśla się, że świadomość narodowa była zniewolona zarówno przez leninowski, jak i stalinowski system administracyjno-polityczny, w którym dominowała antyukraińska retoryka. Ustalono, że wojna rosyjsko-ukraińska jest historyczną okazją dla Ukrainy do wykorzenienia prorosyjskich sił politycznych i jednoczesnego pociągnięcia Rosji do odpowiedzialności za międzynarodowe zbrodnie popełnione przez jej wojska na terytorium niepodległego państwa na bezpośrednie polecenie W. Putina.

    This article analyzes the problems of enforcing international law in terms of fundamental principles of international law, sovereign states and the United Nations. The issue of law enforcement is a problem not only in individual states, but also with in the United Nations. The whole process of peaceful settlement of disputes through the courts in particular, is therefore irrelevant if the final decision, which the state does not want to submit to and fail to enforce. On the other hand, law enforcement mechanisms and capacities of WTO represent complex system of procedural norms of coercion, which could serve as an example for the innovation of UN law enforcement procedures.

    Opis:
    Since it assumed competences in the area of security and defence, the EU has become a complete regional organization in the sense of the Chapter VIII of the UN Charter. This article explains the current situation, following the recognition of the EU’s special status by the United Nations and the entry into force of the Treaty of Lisbon. The future implementation of the mutual defence clause can improve the relevance of the European role as a security actor in the global framework of the UN and add a new task to its traditional peace-keeping, crisis management, and conflict prevention operations. In addition, the EU is an important political actor in the implementation of UN Security Council (UNSC) resolutions, especially those concerning the sanctions against individuals considered as belonging to terrorist organizations. By refusing the implementation of a UNSC resolution that fails to protect human rights, the EU can contribute to the evolution of the UN Charter legal order and be a political force to be reckoned with in the Security Council. The EU orientation, as reflected in its values, including respect for international law, can both reinforce the legitimacy of some UNSC resolutions and improve the credibility and specificity of the EU as an international actor.

    The purpose of the paper is to highlight the activities of the representatives of the Republic of Poland in the UN Security Council in the status of a non-permanent member in 2018-2019, in particular regarding the resolving of the Russian-Ukrainian conflict. The method of content analysis of state program documents, Internet portals of the government of the Republic of Poland and the United Nations, and scientific literature was used in the implementation of the goal. The problem-chronological method made it possible to trace the history of the participation of the Republic of Poland in the UN. The methodology is based on the principles of historicism and objectivity. The scientific novelty of the research lies in the new understanding of the role of Polish diplomacy in the UN Security Council after the occupation of Crimea and the start of Russia's hybrid war in Donbas. The analysis made it possible to formulate the following conclusions. The Republic of Poland – one of the founding states of the UN – tried to be an active member of the organization, including by participating in the work of its main bodies. Poland was elected a non-permanent member of the Security Council six times. The main priorities of Polish diplomacy at the UN Security Council in 2018-2019 included: respect for international law, protection of civilians in armed conflicts, peace and security in Eastern Europe. Much attention was paid to the issue of the Russian-Ukrainian conflict, which, thanks to the Polish side, did not disappear from the body's agenda and was discussed in various contexts. The Polish delegates consistently reminded about the negative impact of the violation of international law and agreements by the Russian Federation, the situation in the occupied territories of Crimea and Donbas, and in the Black and Azov seas. They tried to present the consequences of the occupation of Crimea and the war in Donbas not only as a problem of regional security, but also as a global challenge to the international legal order. The Polish state made a significant contribution to the formation and strengthening of the international coalition in support of Ukraine in countering the aggression of the Russian Federation. An obstacle to an effective resolution of the Ukrainian issue was primarily the specificity and composition of the UN Security Council, where non-permanent members play only a limited role, and one of the permanent members is an aggressor country. The example of the debate surrounding the resolution of the Ukrainian issue once again proves the deficit of UN deep reform

    У статті висвітлюється діяльність Організації Об’єднаних Націй і Ради Безпеки ООН під час російсько-української війни 2014-2023 рр. та активність української дипломатії із захисту незалежності й територіальної цілісності України. Аналізуються, зокрема, процеси ухвалення та голосування на сесіях Генеральної Асамблеї ООН та засіданнях Ради Безпеки щодо питань, пов’язаних з агресією РФ проти України, та вказується на їх неефективність. Наголошується на необхідності реформування всієї діяльності ООН відповідно до сучасних викликів глобального світу в умовах формування нової, багатополюсної системи міжнародних відносин. Особлива увага приділяється гострій проблемі трансформації найвпливовішого органу Організації Об’єднаних Націй – Ради Безпеки, її структури та механізмів ухвалення рішень, в основі яких ще з 1945 р. залишається принцип розподілу на постійних і непостійних членів та наділення перших – США, СРСР (а сьогодні його незаконної спадкоємиці РФ), Китайсь¬кої Народної Республіки, Франції та Великої Британії – правом вето, що вже не відповідає нині¬ш¬нім реаліям, адже ексклюзивне володіння правом вето провід¬ними грав¬цями світової політики є прямим порушенням принципу рівноправності держав-членів ООН. Також розглядається активна діяльність зовнішньополітичного відомства України під час війни Росії проти України. Йдеться не лише про реалізацію ним складних поточних завдань розширення дієвої проукраїнської коаліції у світі, відновлення загальної поваги до Статуту ООН та рівності прав незалежних держав і народів, але й про перспективи повоєнного облаштування устрою в Європі та світі за активної участі України. Підсумовується, що українська дипломатія у складних умовах воєнного стану і кризи ООН та усієї системи міжнародної безпеки досить гідно виконує свою відповідальну місію із захисту національних інтересів України в сучасному глобальному світі.
    The article highlights the activities of the United Nations and the UN Security Council during the Russian-Ukrainian war of 2014-2023 and the activity of Ukrainian diplomacy in defending Ukraine's independence and territorial integrity. The author analyses, in particular, the voting processes at the UN General Assembly and Security Council meetings on issues related to the Russian aggression against Ukraine and points out their ineffectiveness. The author emphasises the need to reform all UN activities in accordance with the current challenges of the global world in the context of the formation of a new, multipolar system of international relations. Particular attention is paid to the acute problem of transforming the most influential body of the United Nations - the Security Council, its structure and decision-making mechanisms, which have been based on the principle of division into permanent and non-permanent members since 1945. The principle of division into permanent and non-permanent members and veto power for the former - the United States, the USSR (and today its illegal successor, the Russian Federation), the People's Republic of China, France and the United Kingdom - no longer corresponds to current realities, as the exclusive possession of veto power by the leading players in world politics is a direct violation of the principle of equality of UN member states. The article also examines the active work of the Ministry of Foreign Affairs of Ukraine during the Russian war against Ukraine. It is not only about the realisation of the complex current tasks of expanding an effective pro-Ukrainian coalition in the world, restoring universal respect for the UN Charter and the equal rights of independent states and peoples, but also about the prospects for post-war arrangements in Europe and the world with Ukraine's active participation. It is concluded that Ukrainian diplomacy, in the difficult conditions of martial law and the crisis of the UN and the entire international security system, is quite adequately fulfilling its responsible mission of protecting Ukraine's national interests in the modern global world.

    The promotion of gender equality and women's empowerment has been a goal of the United Nations Organization and its specialized agencies, within each one's particular scope of competencies. The World Maritime University (WMU), a postgraduate maritime university founded by the International Maritime Organization (IMO), has put in place its own policies to promote the participation of women in the maritime transport sector. The main idea behind this case study analysis is to look at how WMU's policies on gender equality and women's empowerment have evolved over time; their impact on student and employee body, curriculum, conferences and seminars; and propose areas for improvement. This research is aimed at gaining a deeper understanding of an ongoing process by exploring enrolment and hiring statistics, documents and related articles over a period of 34 years (from 1983 to 2017).

    The United Nations Convention on Contracts for the International Sale of Goods (the so-called Vienna Convention, CISG) is considered one of the most important and influential private law acts of the past decades. The most compelling evidence of the impact of the CISG is the European private law. It is especially evident in case of consumer sales law of the European Union. The Consumer Sales Directive (99/44) and, to some extent, even the Directive on Consumer Rights (2011/83/EC) were based on principles and institutions derived from the CISG. The most important influences are of course the objective liability of a debtor and the institution of conformity of the goods; however, even the basic terms (such as “conformity of goods” and “non-conformity of goods”) are defined per analogiam. And even though European legislator did not borrow from the CISG its’ concept of the fundamental breach of contract, the further cases of CISG’s impact are seen in cases of Nachfrist and remedies available to the parties of a contract. Since European consumer sales law is one of the most important spheres of EU interests and influences national civil law systems, CISG may easily be described as the model and backbone of future private law harmonization.

    Organizacja Narodów Zjednoczonych jest międzynarodową organizacją działającą na rzecz pokoju międzynarodowego, promującą go oraz służącą swoją bezstronnością w rozwiązywaniu konfliktów. Na forum Rady Bezpieczeństwa, najważniejszego organu ONZ, społeczność międzynarodowa szuka rozwiązań dla wybuchających i trwających konfliktów oraz implementuje te rozwiązania. Weto, którym dysponują stali członkowie Rady Bezpieczeństwa może skutecznie paraliżować pokojowe wysiłki innych członków czyniąc ONZ nie zawsze efektywną instytucją. Przykładem stosowania weta przez stałego członka Rady Bezpieczeństwa, wbrew oczekiwaniom innych członków ONZ, jest ochrona, której USA udziela Izraelowi niedopuszczając do przegłosowywania niekorzystnych dla Izraela rezolucji. Wspieranie Izraela przez USA na forum ONZ umożliwia mu prowadzenie, kosztem Palestyńczyków, ekspansywnej polityki na Bliskim Wschodzie. Taka polityka, zarówno USA, jak i Izraela, czyni konflikt izraelsko-palestyński niemożliwym do rozwiązania. Celem rozważań w niniejszym artykule badawczym jest właśnie przedstawienie wspierającej Izrael polityki USA w ONZ oraz konsekwencji takiego działania. Poniższa analiza systemowa pokazuje, że wetowanie niekorzystnych dla Izraela rezolucji Rady Bezpieczeństwa przez USA ma istotny wpływ na trwanie konfliktu izraelsko-palestyńskiego stanowi przeszkodę dla społeczności międzynarodowej w wysiłkach na rzecz pokoju na Bliskim Wschodzie.
    The United Nations is an international organisation acting for international peace, promoting it and serving with its neutrality in conflict resolution. In the C forum, the most important body of the UN, the international community is looking for solutions to the bursting out and lasting conflicts as well as it implements those solutions. Veto, disposed by the permanent members of the Security Council, may effectively paralyse peaceful efforts of other members making the UN not always an effective institution. An example of the application of veto by a permanent member of the Security Council, contrary to expectations of other UN members, is the protection provided by the US for Israel, preventing voting down resolutions unfavourable for Israel. The support given to Israel by the US in the UN enables it carrying out, at the expense of Palestinians, an expansionist policy in the Middle East. Such a policy, both of the USA and Israel, makes the Israeli-Palestinian conflict unresolvable. An aim of considerations in this research article is just to present the US policy supporting Israel in the UN as well as consequences of such an activity. The below specified systems analysis shows that vetoing the unfavourable for Israel resolutions being made by the Security Council by the USA has a material impact on persistence of the Israeli-Palestinian conflict and is an obstacle for the international community in efforts for peace in the Middle East.

    Opis:
    The International Court of Justice (ICJ) is a principal judicial organ of the United Nations. The main task of ICJ is to settle disputes submitted to it by the states and is also entitled to give advisory opinions which are given on the motion of some United Nations organs and specialized agencies. The expression that ICJ is a “principal judicial organ of the United Nations” doesn’t mean that it is the only one judicial organ within the framework of the United Nations. The United Nations Administrative Tribunal (UNAT) was established by the legal force of the General Assembly resolution 351 A(IV) of 9 December 1949 r. The main purpose of the UNAT was to decide legal employment disputes between United Nations staff and the Organization. In 1955 the Statute of UNAT was amended and the Committee on Application for Review of Administrative Tribunal Judgement was competent to seek advisory opinion form ICJ and this opinion was binding. However Committee only in three cases requested the ICJ to give advisory opinion. Those opinions concerned inter alia the competence of ICJ to respond to the question, the right of Committee to submit such motion, the principle of equality of arms. In spite of that since of the 1st of July 2009 the new system of administration of internal justice was established – the United Nations Dispute Tribunal and the United Nations Appeal Tribunal, which consider the appeals against judgments rendered by the United Nations Dispute Tribunal, the issues discussed in advisory opinions of ICJ on the matters of appealing against a judicial decision of UNAT are still highly topical, especially in the context of the maintained in force competence of ICJ to review judgement of The Administrative Tribunal of the International Labour Organisation.

    Opis:
    This article aims to answer the question of the admissibility of withdrawal from the United Nations Organization. Since the Charter of the United Nations as a foundation act of the Organization does not contain any specific provisions in this regard, the author decides to refer to the general law of treaties and, based on it, to conduct a relevant analysis. Therefore, availing himself of the provisions of the Vienna Convention on the Law of Treaties, the author aims to demonstrate and characterize possible conditions which under customary international law allow the possibility of a unilateral withdrawal from a treaty. In the first place, the author refers to the intentions of the parties to the Charter of the United Nations at the time of its drafting and then to the nature of the treaty itself. As a result of the analysis, he comes to the conclusion that neither the intentions of the parties, nor the nature of the Charter of the United Nations can provide reasonable grounds for acknowledging the possibility of withdrawal from the UN as compliant with international law.
    Przedmiotem niniejszego artykułu jest próba odpowiedzi na pytanie o legalność wystąpienia z Organizacji Narodów Zjednoczonych. W związku z tym, że Karta Narodów Zjednoczonych, jako akt założycielski Organizacji, nie zawiera odpowiednich postanowień w tym zakresie, autor postanawia odwołać się do ogólnych reguł prawa traktatów i na tej podstawie dokonać stosownej analizy. Posiłkując się regulacjami Konwencji wiedeńskiej o prawie traktatów, przybliża i charakteryzuje te przesłanki, które na gruncie prawa zwyczajowego pozwalają domniemywać istnienie możliwości jednostronnego wypowiedzenia umowy międzynarodowej. Autor odnosi się w pierwszej kolejności do intencji towarzyszących stronom Karty Narodów Zjednoczonych w momencie jej opracowywania, a następnie do natury wspomnianego traktatu. W następstwie poczynionych ustaleń dochodzi do wniosku, że ani zamiar stron wyrażony w trakcie prac przygotowawczych, ani natura Karty Narodów Zjednoczonych nie dają wystarczających podstaw do uznania, że akt wystąpienia z ONZ pozostaje w zgodzie z normami prawa międzynarodowego.
