The article addresses the theoretical issues of the protection of the state interests in the Ukrainian law. The protection of the state interests, being an objective necessity from the perspective of the development of the state and the civil society, requires legal measures to be applied by the state. The core aspect in the analysis of the process of the protection of the state interests by such measures is the theoretical understanding of the state interests concept, including their definition and the requisite qualifications. Based on the approaches of the domestic as well as of the international law on human rights the state interests are proposed to be viewed as objective interests, public in nature, comprising the underlying general social needs, acknowledged by the state. The state interest include, further, the appropriate legal means by which such interests are capable of being protected. Such measures should be relevant to the respective state interests as well as to the specific social relationships in which such measures are to be applied.

Opis:
The state is subject of interest to many scientific disciplines: constitutional and international law, sociology, philosophy, administrative and political sciences, social psychology, economics, political and economic history, military sciences, regional studies and, of course, political geography and geopolitics. In the course of history, from ancient to modern times, the state was defined in very different ways. The author comes out in his deliberations from the analysis of the elements that make up the various definitions of the state. Then he reviews the classification of functions that the modern state fulfills and analyzes the way in which they are implemented in various countries around the world, trying to answer the question, is the state necessary for citizens and for what? Finally, the author draws attention to the frequent undertaking of the subject matter of the functioning of the state in the world’s belles-lettres in epic works and in dramas both in the past and nowadays. The last issue raised in the paper is the analysis of the functioning of unrecognized countries, mainly European ones, and what are the consequences of their exclusion from the international community influencing the life of their inhabitants, economy and functioning of their societies.
Państwo jest przedmiotem zainteresowania wielu dyscyplin naukowych: prawa konstytucyjnego i międzynarodowego, socjologii, filozofii, nauk administracyjnych, nauk politycznych, psychologii społecznej, nauk ekonomicznych, historii politycznej i gospodarczej, nauk wojskowych, regionalistyki i oczywiście geografii politycznej oraz geopolityki. W toku dziejów, począwszy od starożytności po czasy współczesne, państwo było bardzo różnie definiowane. Autor wychodzi zatem w swych rozważaniach od analizy elementów składających się na różne definicje państwa. Następnie dokonuje przeglądu klasyfikacji funkcji, które pełni współczesne państwo i analizuje sposób, w jaki są one realizowane w różnych krajach na świecie, próbując odpowiedzieć na pytanie: do czego państwo jest potrzebne obywatelom? Następnie Autor zwraca uwagę na częste podejmowanie tematyki funkcjonowania państwa w światowej literaturze pięknej zarówno w utworach epickich, jak i w dramatach zarówno w przeszłości, jak i obecnie. Ostatnim zagadnieniem podjętym w wystąpieniu jest analiza funkcjonowania państw nieuznanych, głównie europejskich i konsekwencje faktu ich wykluczenia ze społeczności międzynarodowej dla życia ich mieszkańców, gospodarki i funkcjonowania ich społeczeństw.

The hereby article discusses the issues related to the existing or required support given by the State to enterprises in order to provide them conditions to innovate. Neoclassical economy puts an emphasis to the price mechanism as a decision making effective tool, but enterprises meet many barriers in creating and introducing innovation, like high cost, high risk or lack of demand for innovation. These phenomena tend to inhibit innovation of enterprises. This means that market is not an efficient mechanism for innovation activity of enterprises, and its imperfections provoke the State’s intervention. The goal of the article is to shape the objectives of State’s impact on decisions of innovative enterprises. Research method is the critical literature review and public data on State’s support on business R&D analysis. The research results show State’s support for both – incremental and radical innovation, which proves that innovative activity of enterprises is far from being a spontaneous, market-based process.

The authors examine the national states development scenarios on the basis of two tendencies – the world government nascence and strengthening of the nation state. The ideas about inevitable formation to the 2000 year of the «world state» in the form of conflict-free and just united society of humanism in 1990-years failed. The possibilities of passing to more humane, just and intelligent society changed to the scenarios of split to parts civilization, contradictions between which were practically impossible to solve. By the end of XX century the determinative feature in investigation of the further existence of a sovereign state investigation becomes an inconsistency of the globalization process, which, despite expectations, at one time integrates and disjoins nations. The 1990s witnessed, that within global governance of the continuous "Shift of power" from governments of nation states to some new supranational structure of international management is not observed. Rather we talk about fundamentally new tendency of world development: at the global level both states and transnational formations own “the part” of power. The capital flows, which are consistently increasing, and products crossing national borders, making them more and more transparent, demand creation of coordinating bodies at the supranational level, but not as a shape of a "world government", but as collective actions of governments of several states. This model propsed by German political scientist W. Beck, is based on the idea of transnational state, namely community of states. The process of globalization provides arguments for supporters of the traditional theory of political realism, who claim, that in future development scenarios the main parts, as previously, belong to strong states and their nation interests, strength of which will be only increasing due to economic integration. The debates are kept only about whom in XXI century the leadership belongs to - traditional Western centers of power or East which grows stronger.

A common interpreting perception of Machiavelli’s thought is based on the paradox that state feasibility uses not only knowledge but also any form of immoral act in order to preserve power. Against this position that draws its origin in Meinecke, this paper aims to study the ways that the notion of liberty is interpreted by Machiavelli as well as the impact of this contribution to contemporary policy making. Furthermore, through this study, the diversification between the real Machiavellian contribution to modern thinking and Machiavellianism, will be thoroughly analyzed. The main research question of the paper is to test if the new arte dello stato (art of the state), in contrast with the notion of Machiavellianism, is based on the new form of rationality which has its roots in naturalism and history, as a precondition for the ruler’s unobstructed action. The methods used include main literature review on Machiavelli as well as content analysis of Machiavelli's treatise The Prince in order to address the research hypothesis that Machiavelli is based on rationality, naturalism and history in order to create a framework of stability, continuity, liberty and prosperity of the people. The main conclusion of the paper is that Machiavelli’s The Prince seems to posit a notion of the state operating around the ruler against fortune within a political regime of homogenization, in which the ruler represents the pole of stability and capable rationality by rolling out a long-term conservation strategy in accordance with the social reality that surrounds him. Thus, his thinking inaugurates the democratic pragmatism of modernity which was later deepened by the philosophy of the Enlightenment.

The importance of the autonomy of science is generally assumed to be good for the proper functioning of science. Yet, when we examine the notion more closely, various difficulties present themselves and cloud our understanding of this important concept. One such complication presents itself when we examine the relationship between science and the state. When examining the relationship between science and the state, there is an area of overlap that is called by Alvin Weinberg as trans-science. This concept contains within it an axiology of science that has bearing upon the scientific process itself. This leads us to ask, who determines the values in this axiology of science? In this paper I will argue that the state takes precedence in determining these values in the axiology of science which impacts science’s autonomy. To do this, I will first present an outline of what the concept of trans-science is. Next I will present the axiology of science and ways of determining it. Finally I will present the State’s role in determining these values.

The main purpose of this paper is to define the boundaries of the principle of impartiality of public authorities in matters of personal conviction and out-looks on life, expressed in article 25 paragraph 2 of the Polish Constitution of 1997. At its very root, the concept of the liberal state is strictly related to the idea of human dignity. For that reason, a democratic state ruled by law can not remain absolutely impartial in some branches of its activity, as far as the most important values represented in the Polish Constitution are concerned. For ex-ample, apart from the inherent and inalienable dignity of the person, the legisla-tor is bound to protect public morals. Moreover, article 13 of the Polish Consti-tution excludes totalitarian programmes and ideas from public spaces. Finally, the author notices that it is not a duty of the state to regulate all matters. On the contrary, in the liberal state there should be a vast space for the citizens’ initia-tive, especially if axiology is involved.

The aim of the study is to identify and evaluate dynamic capabilities in implementing the strategy of the State Forests National Forest Holding. The study reviews the literature related to the strategy and construct of dynamic capabilities, presents a synthetic approach to the strategy of the State Forests National Forest Holding for 2014−2030, followed by a discussion on the essence and role of dynamic capabilities in implementation strategy of the State Forests National Forest Holding. The conclusions of the study indicate the directions of improvement of the strategic management system of the State Forests National Forest Holding. The analysis enabled the conclusion that the actions taken by the forest district offices have a significant impact on the implementation of the strategic objectives of the State Forests National Forest Holding. According to the respondents, the forest districts have the greatest impact on achieving the goal of ensuring the sustainability of forests (forests as the most important element of the environment), and the smallest to build competences in the field of modern, well−managed and efficient organization. The respondents claimed that the significant importance of dynamic capabilities for State Forests National Forest Holding to achieve strategic objectives, with key capabilities in this area that can be attributed to the stage of looking for opportunities. At the same time, the results indicate that in the process of achieving strategic goals, human resources and skills as well as financial resources and skills are crucial, while the impact of structural resources and skills is the weakest.

This paper discusses several important problems related to the human capital and knowledge sector in Poland, including policy of the state in those matters and the role of the fundamental values. After describing current conditions, which influence human resources and knowledge sector in Poland, general framework for the state policy in those matters is being presented. The paper calls for synchronization and coordination of the policy of the state related to the knowledge sector, which consists of all levels of education (especially HE), science and R&D. Finally the article discusses 2 possible variants of the development of the knowledge sector in Poland in the nearest future: pessimistic and optimistic one.

The understanding of political pedagogy by Kazimierz Sośnicki as a kind of comparative pedagogy studies on the relationship between political systems and the educational system, as well as the goals, contents and effects of school actions. Main issues of these studies and their results. A special lecture on fascist and Nazi pedagogy at the secret University in Lviv. Other forms of practicing political pedagogy in interwar Poland. The processes of reproduction of authoritarian systems in the research of M. S. Archer. Linguistic confusion in our public sphere. Hopes for continuations. I intend to contribute to the memento of an important trend in Polish pedagogy, abandoned after the war. In my opinion, it should be included in pedagogy and education. It is necessary both in pedagogy and pedagogical practice to educate for critical political wisdom. In the face of the disarray of political structures and the language of public debates, it is necessary to develop the capacity for an independent position, over partial divisions and fighting. The subject of political pedagogy was practiced with a gusto in the 1930s.

In the proposed draft position the author points to the incompatibility with the Constitution of Article 2 of the Act amending the Act on the State Fire Service in the section containing the phrase “in the accounting period immediately preceding the entry into force of this Act”. In the explanatory memorandum, the author points out that internal differentiation of the officers of the so called uniformed services is acceptable from the perspective of the constitutional principle of equality and is supported inter alia by the specific nature of the service these officers and specificity of the risks they undertake. In the opinion of the author, the legislature should uniformly regulate the legal status of all officers. Moreover, the proceedings in relation to the remaining scope should be discontinued due to the inadmissibility of rendering the judgment.

In this paper, I employ the method of reflective equilibrium to analyse background conditions of our considered judgements about distributive justice generated by a thought experiment called “Three Children and a Flute”, proposed and interestingly commented upon by Amartya Sen in his book The Idea of Justice. I claim that, contrary to Sen’s conclusions drawn from the thought experiment, for the utilitarian and egalitarian visions of distributive justice to hold other things about distribution of resources and social life that we are not willing to accept must be true and that it is not the case then that it is a ‘difficult decision’ to make what pattern of distribution should prevail in the thought experiment. To boot, I hold that libertarian or natural pattern of distribution does not presuppose these background conditions that we are not willing to accept and which are presupposed by egalitarian and utilitarian distributive patterns. I conclude that taking into consideration the fact that there is a plethora of inconsistencies, counter-intuitive consequences and anti-scientific implications of the utilitarian and egalitarian solutions to the thought experiment, it is a natural pattern of distribution that prevails in the ‘flute dilemma’.
Artykuł ten analizuje za pomocą metody równowagi refleksyjnej warunki tła naszych rozważnych sądów na temat sprawiedliwości dystrybutywnej, wygenerowanych przez eksperyment myślowy określany mianem „Trójki dzieci i fletu”. Eksperyment ten został zaproponowany i w interesujący sposób skomentowany przez Amartya Sena w jego książce pod tytułem The Idea of Justice. W swym artykule stawiam tezę, że – w przeciwieństwie do konkluzji, które Sen wywiódł z tego eksperymentu myślowego – aby utylitarna i egalitarna wizja sprawiedliwości dystrybutywnej mogła pozostać w mocy, szereg innych twierdzeń dotyczących życia społecznego oraz dystrybucji zasobów, których nie jesteśmy chętni zaakceptować, musi być prawdziwych. Argumentuję również, że nie jest prawdą twierdzenie Sena, iż zdecydowanie o tym, który ze wzorców dystrybucji powinien przeważyć w tym eksperymencie myślowym, nie jest wcale „trudne”. Co więcej, twierdzę też, że tzw. naturalny czy libertariański model dystrybucji nie zakłada tych samych warunków tła, co utylitarny i egalitarny model dystrybucji, a których to warunków nie jesteśmy skłonni zaakceptować. W artykule swym dochodzę do wniosku, że biorąc pod uwagę cały szereg niespójności, nieintuicyjnych konsekwencji oraz sprzecznych z doniesieniami nauk szczegółowych implikacji rozwiązań utylitarystycznych i egalitarystycznych, to naturalny model dystrybucji stanowi jedyne rozwiązanie dylematu fletu.
