Opis:: Charakterystyczną cechą infrastruktury przesyłowej jest jej przebieg przez bardzo dużą liczbę nieruchomości charakteryzujących się różnorodnym statusem ochronnym (grunty rolne i leśne, obszary Natura 2000, parki narodowe i krajobrazowe, grunty zabytkowe, tereny zurbanizowane, grunty zagrożone powodziami). Biorąc pod uwagę powyższe oraz uwzględniając fakt, że grunty rolne i leśne w Polsce stanowią ok 91% powierzchni kraju, a sieć Natura 2000 pokrywa ok. 20% jej powierzchni lądowej, należy stwierdzić, że skala wpływu urządzeń przesyłowych na przestrzeń rolniczą jest bardzo duża. Celem niniejszego artykułu jest analiza oddziaływania linii elektroenergetycznych wysokich i najwyższych napięć na przestrzeń rolniczą, na etapie fazy realizacji inwestycji oraz eksploatacji urządzenia przesyłowego.
The characteristic feature of the transmission infrastructure is its course over numerous properties of diversified protection status (arable lands, forest lands, Natura 2000 sites, national and landscape parks, his torical areas, urban areas, areas threatened by floods). Considering this, as well as the fact that in Poland arable and forest lands cover about 91% of the entire country, and the Natura 2000 network covers about 20% of lands, it should be stated that the level of impacts of transmission installations on the agricultural space is considerably high. The objective of this paper is to analyse impacts of power lines (of high and very high voltages) on the agricultural space at the stage of investments implementation and exploitation of transmission installations.

Opis:: The construction of transmission infrastructure and its functioning imposes the obligation on transmission companies to have a legal title to land. Both in Poland and in Canada, the title particularly results from the established easements subject to registration in public information systems. Due to different historical, social, and economic conditions, the specificity of legal regulations and technical solutions related to the registration of rights to land property is different in both countries. This results from the functioning and the substantive scope of particular systems of information on land property. Such systems are regulated by independent, internal rules of each of the countries. In Poland, easement is subject to registration in the land and mortgage register. In Canada, a federation country, it depends on legal regulations of particular provinces. The research objective of the article is the analysis of the way of registration of easements established for transmission companies in Poland and in Canada in the Ontario and Quebec provinces. The analysis covers the scope of registration of the said right in systems of information on land property. The evaluation of the applied solutions particularly involves pointing out those which to the greatest extent guarantee the safety of land property turnover. The best result is obtained in Canada in the Ontario province.

Opis:: Służebność przesyłu, jako podstawowy tytuł prawny pozyskiwany przez przedsiębiorców, umożliwia budowę oraz późniejszą eksploatację urządzeń przesyłowych w przestrzeni cudzej nieruchomości. Pozwala również na regulację tzw. zaszłości, czyli sytuacji, gdy urządzenia zostały wybudowane bez posiadanego tytułu prawnego do gruntu. Wykonywanie służebności przesyłu powinno się odbywać w niezbędnym do tego zakresie. Metodyczne i precyzyjne wyznaczenie jej zasięgu jest więc niezwykle istotne, gdyż przekłada się na ograniczenie konstytucyjnie chronionego prawa własności. Zakres wykonywalności przedmiotowego prawa, tzw. powierzchnia służebności przesyłu, ma z kolei wpływ na wysokość rekompensat przysługujących właścicielowi nieruchomości obciążonej, rozumianych jako odszkodowania za szkody związane z budową i istnieniem urządzeń przesyłowych w przestrzeni cudzych nieruchomości oraz wynagrodzenia za ustanowienie samego prawa. Celem artykułu jest opracowanie metodyki określania zakresu wykonywalności prawa służebności przesyłu na przykładzie napowietrznych linii elektroenergetycznych.
Transmission easement as the basic legal title obtained by entrepreneurs permits the construction and later exploitation of transmission devices in the space of another person’s land property. It also allows for the regulation of unfavorable circumstances; i.e., situations where the devices were constructed without a held legal title to the land. The execution of transmission easement should be implemented in the necessary scope. The methodical and precise determination of its range, therefore, is important, because it also translates into a limitation of the constitutionally-protected ownership right. The scope of executability of the said right (the so-called “area of transmission easement”) in turn affects the amount of compensation payable to the owner of the encumbered land property, defined as compensation for any damage related to the construction and existence of transmission devices in the space of another person’s land property and remuneration for the establishment of the right itself. The objective of the article is to develop a methodology of determining the scope of executability of the right of a transmission easement based on the example of overhead power lines.
