Nowelizacja samorządowych ustaw ustrojowych datowana na styczeń 2018 r. stanowiła wyraz dążeń ustawodawcy do zapewnienia członkom wspólnot samorządowych skutecznego wpływu na działalność organów tych wspólnot. Realizacji tego zamierzenia służyć miało ukształtowanie nowych instytucji, do których zakwalifikować należy komisję skarg, wniosków i petycji. Jednostki samorządu terytorialnego wszystkich stopni zobligowane bowiem zostały do utworzenia komisji stałej, przy pomocy której organ stanowiący i kontrolny rozpatrywałby skargi na działania organu wykonawczego i samorządowych jednostek organizacyjnych, a także wnioski oraz petycje składane przez obywateli. W niniejszym opracowaniu dokonano analizy materiału normatywnego, która umożliwiła przedstawienie pozycji ustrojowej komisji oraz jej zadań. Pozwoliła ona również na ocenę przejętych rozwiązań prawnych wyznaczających status tego organu oraz sformułowanie wniosków de lege lata.
The amendment of system-related laws dated January 2018 was an expression of the legislator’s pursuits to provide members of self-government communities with an effective impact on the activity of bodies thereof. Shaping new institutions under which the complaints, requests and petitions commission falls was to serve the implementation of this assumption. Local government units of all levels were obliged to create a permanent commission by which the law-making body and the auditing body were to examine complaints about the activity of the executive authority and self-government organisational units, as well as requests and petitions brought in by citizens. This study analysed the normative material, which made possible to present the commission’s systemic position and its tasks. It also allowed an assessment of the adopted legal solutions outlining this body’s status and formulation of de lege lata conclusions.

To determine the memory volume of information systems (IS), it was proposed to use a stochastic model, based on the use of a queueing network with bypasses, known as an HM-network. This model includes the servicing of heterogeneous requests along with their volumes, the ability to change the volume of such requests with their passage of time and the possibility of finding computer viruses in them, and therefore servicing requests can be interrupted at some random time. The paper presents the influence of social context on illocutionary metonymy in directives evoked by various elements of request scenarios. As the human language activity reflects the physical and social worlds of the intersubjective context (cf. Verschueren 1999), the recognized and construed social relations have an impact not only on addressive forms, but also on the appearance of other elements such as indirectness and its scalarity.Indirect directives are based on illocutionary metonymic scenarios (Panther and Thornburg 1998) and by evoking a part of the scenario referring to the core action they give access to the illocutionary scenario domain. The scalar nature of indirectness (Panther and Thornburg 1998, see also Panther and Thornburg 1999, 2007 and Thornburg and Panther 1997), depends on the number of evoked elements and their conceptual distance from the core of the request. It can be based on conventional grammatical structures (e.g. auxiliary verbs) or giving hints by only introducing the action scenario. As Veres-Guśpiel (2013)  has shown the chosen type of indirectness is influenced by social context and the weight of a directive (for the latter, see also Csató and Pléh 1988, Pléh 2012).The main question of the presented research regards types of illocutionary metonymy, that can be experienced in various social contexts and what their frequency of use is.

W artykule omówiona została symulacyjna metoda badania wydajności procesu obsługi żądań dostępu w obiektowych bazach danych. Zaproponowany został model symulacyjny umożliwiający badanie wpływu metod klasteryzacji na efektywność omawianego procesu. Rozpatrywana jest organizacja danych w modelu „pamięć podręczna-pamięć zasadnicza”. Eksperyment symulacyjny może posłużyć do porównania wybranych metod klasteryzacji na etapie projektowania rozwiązań. Wyniki badań mogą być wykorzystane przy podejmowaniu decyzji o implementacji metod w rzeczywistych systemach bazodanowych.
This article presents the simulation method for the efficiency evaluation of the serving access-requests process in object databases. Simulation model has been proposed, capable to investigate the impact of the clustering method on the efficiency of this process. The presented approach assumes organisation of data in the „cache memory-main memory” model. Simulation experiment may be used for a comparision of chosen clustering methods, at the early stage of designing the final solution. The results can be considered while making decisions about implementation of methods in the real database systems.

Big Data technology is described. Big data is a popular term used to describe the exponential growth and availability of data, both structured and unstructured. There is constructed dataspace architecture. Dataspace has focused solely – and passionately – on providing unparalleled expertise in business intelligence and data warehousing strategy and implementation. Dataspaces are an abstraction in data management that aims to overcome some of the problems encountered in data integration system. In our case it is block vector for heterogeneous data representation. Traditionally, data integration and data exchange systems have aimed to offer many of the purported services of dataspace systems. Dataspaces can be viewed as a next step in the evolution of data integration architectures, but are distinct from current data integration systems in the following way. Data integration systems require semantic integration before any services can be provided. Hence, although there is not a single schema to which all the data conforms and the data resides in a multitude of host systems, the data integration system knows the precise relationships between the terms used in each schema. As a result, significant up-front effort is required in order to set up a data integration system. For realization of data integration from different sources we used SQL Server Integration Services, SSIS. For developing the portal as an architectural pattern there is used pattern Model-View-Controller (MVC). There is specifics debug operation data space as a complex system. The query translator in Backus/Naur Form is give.

We present a method of finding the expected volume of requests in HM-network with homogeneous requests and bypass of the queueing systems of requests. The case was considered when the volume changes associated with the transitions between the states of the network are deterministic functions, depending on the state of the network and time, and the systems are single line. It is assumed that the probability of the states of the network systems, the parameters of the entrance flow of the requests and the service depend on the time.

This article presents the analysis of the legal aspects of administrative systems for reporting problems and ideas using maps (geolocation – spatial data) via the Internet. As part of the analysis of such systems, the 19115 system functioning in Warsaw was presented in detail. In the article, the legal regulation of the 19115 system which is of an intra-organizational character was referred to the provisions of generally binding laws – Section VIII of the Code of Administrative Procedure and the Regulation of the Council of Ministers of 8 January 2002 on the organization of receipt and processing of complaints and requests. The research confirmed that the functional interpretation of these laws leads to the conclusion that the systems at issue are generally consistent with them. The problems and ideas submitted by residents through such systems should be treated as requests within the meaning of the Code of Administrative Procedure. However, in order to avoid doubts and practical difficulties, it is advisable to amend Section VIII of the Administrative Procedure Code and the Regulation of the Council of Ministers of 8 January 2002 on the organization of the receipt and processing of complaints and requests in accordance with the submitted de lege ferenda conclusions. They assume, inter alia, the introduction of an explicit legal basis for establishing such systems.

The article aims to point out a social phenomenon in Vietnam currently which is recognized as both visible and invisible violence from parents and teachers to their children or learners at different levels of general education16. The focus of this study is to interpret violence as a result of parents and teachers’ excessive demand on the study of their children or learners. A survey was employed to collect data from 265 primary and high school students about the behavior of their parents and teachers on issues related their learning to clarify the research problem. The findings analyze the phenomenon from emphasizing the forms of violence significantly resulting from teachers’ behavior when young learners make mistakes at school and parents’ concerns and behavior towards their children’s learning; simultaneously, the consequences of this type of violence are also examined from the insiders’ voices of the learners in a comprehensive picture for various types of violence. These forms of violence may not be recognized in other contexts, but in Vietnamese families and schools. The results of the article can contribute considerably to not only raise awareness in Vietnam specifically and in Asia generally about of the notions of violence on our young generation but also recognize the needs of young generations in their learning.

In the paper, we investigate multi-server closed queueing systems with identical servers and a finite number of terminals. Requests from each terminal are characterized by a random space requirement (volume), the request service time doesn’t depend on its volume and has an exponential distribution. The total requests capacity in the system is limited by a positive value (buffer space memory volume) V. For such systems, stationary requests number distribution and loss probability are determined. The analogous results for open multi-server systems are obtained as a limit case. Some numerical results are attached as well.

In 2016, the Turkish Competition Authority (hereinafter, TCA) published the Cement Sector Inquiry Report (hereinafter, Cement Sector Report) following more than two years of market analysis. One of the reasons for conducting such a market inquiry was the fact that the implementation of competition rules and accuracy of the economic analysis by the TCA in cement cases were frequently criticized. In order to provide some guidance and have better understanding about the competitive dynamics of the cement market, the TCA initiated the inquiry in 2014. Another reason for the inquiry was the importance of the cement industry for the construction sector and the economy of Turkey, as well as numerous competition law concerns in this sector. The article provides an analysis of the substantive and procedural issues in the TCA activity in the cement sector in Turkey. Particular emphasis is placed on the assessment of the Cement Sector Report and common competition law violations in the sector in Turkey based on a review of the decisions of the TCA. Additionally, legal grounds for conducting sector inquiries in Turkey, as well as limits to and potential impact on the TCA’s powers to issue extensive compulsory information requests (in the light of the recent CJEU’s judgements in cement cartel cases) are discussed. Overall, the article provides the reader with a better understanding of the Turkish cement sector dynamics and most common anticompetitive practices there. In conclusion, it is argued that inspite of having a reputation of a “problematic sector”, the behaviour of cement producers and developments in the cement market in Turkey may be justified by economic reasons and the oligopolistic nature of this market.

The subject of the study is a series of advertisements – requests from the Siepomaga.pl website in terms of the method of acquisition of recipients (using Cicero’s captatio benevolentiae principles), convincing and persuading to act through proper selection of rhetorical arguments. The main procedure is to create statements taking into account the common auditorium, bearing the hallmarks of ordinariness. Language structures, toposes, arguments explicitly referring to pathos; the most typical strategies are modesty and raising the value of recipients as a last resort; and toposes: unequal fight against disease, time passing relentlessly as well as causative reasons (support is only a means to obtain priceless values: health and life). A characteristic feature of the requests posted on the Siepomaga.pl website is the presence of various semiotic codes typical for the Internet space, a kind of multimodality of communication in which verbal communication and image coexist. In addition, interaction is an important persuasive element, giving the recipients – the donors – an immediate effect of reward for taking action in the form of satisfaction with the real contribution visible in the account balance bar.

Opis:
Formation of rational delivery routes is the main way to increase the effectiveness of client services for freight forwarding companies. The main part of the requests for transport services comes from occasional (non-constant) clients. The set of those requests forms a stochastic flow. For stochastic requests flow, the delivery routes are formed in the process of the requests receipt. Therefore, the standard approaches for merging of requests from multiple clients into routes, based on linear programming techniques, cannot be used in such conditions. An algorithm of formation under the stochastic demand conditions of such delivery routes, which allow servicing of two or more shippers, is proposed in the paper. The author has developed a specialized software to support decisions made by dispatchers of forwarding companies.

This study intends to expand the range of studies on the acquisition of pragmatic competence in English as a foreign language, with special attention paid to impoliteness. It examines the development of one component of learner interlanguage pragmatics, i.e., requests, and looks for acquisitional patterns in modifying their impositive force in advanced Polish learners of English. A sample of linguistic written data was collected in a longitudinal study by means of a discourse completion task (DCT). The author seeks evidence of impoliteness by examining alerters, external moves, internal mitigation, together with strategies for expressing the directness of requests. On this basis, conclusions about noticeable impoliteness in the interlanguage pragmatic competence of the participants are drawn.
