According to Polish synodal legislation, similarly to the Code of Canon Law, the provision of the office of pastor consists of three stages: 1) designation of a person, 2) conferral of the title, and 3) taking possession of the office. In accordance with both universal and particular law, the provision may be free or dependent. The diocesan bishop confers the office freely (cc. 523–525). In the case of a dependent provision, however, another competent ecclesiastical authority nominates a candidate, and the diocesan bishop only confers the title to the office (c. 525; 682, §1). According to legislators of particular law, the conferral of a legal title to an office should take place by a nomination decree. The decree should meet the requirements of a singular administrative act (cc. 48–57). The placement in the possession of a parish by the local ordinary or his delegate and the assumption of the office by a pastor is the final stage of the provision. Under particular law, two aspects of this act are distinguished: the legal aspect (the drawing up and signing of a handover protocol by the pastor and other competent bodies), and the liturgical one (solemn entry of a new pastor into the parish church according to the ritual of a specific particular Church). Legislators of particular law also places the presbyter who has been promoted to the office of pastor under an obligation to make a profession of faith (c. 833, 6°) and take the oath of fidelity, according to the formulas approved by the Holy See.

Edith Stein is widely recognised as a saint, a martyr, a victim of the Holocaust and a female philosopher – but can she be a Doctor of the Church? So far, thirty-seven figures, including four women, carry the title due to their so-called ‘eminent doctrines’, eminentes doctrinae. For centuries, a procedural difficulty existed in awarding the titles to martyrs, however, in the second decade of the 21st century, the Congregation for the Causes of Saints reached a conclusion that martyrdom is not, in principle, an obstacle in awarding the title. A question, therefore, can be posed: does the legacy of someone among the Christian martyrs fulfill the criteria of the Church’s Doctorate? The aim of this article is to investigate the criteria for conferral of the title of the Doctor of the Church, prime among which is a criterion called eminens doctrina, and apply them to one example, that of Edith Stein. In doing so, I consider the question purely historically and philosophically, starting out with definitions of the Father of the Church and the Doctor of the Church in part one (available below). In the second part of the article (available in 2024), I ask what aspects of the female martyr’s theology, philosophy and spirituality fulfill the criteria of an eminent doctrine, as formulated in the Church’s documents, and which are insufficient or lacking. In order to highlight the nature of a particular criterion, I contrast Stein’s case with other recently debated cases, such as those of Irenaeus of Lyons and John Paul II.

La tendance actuelle semble être de ne plus nommer de Docteur trop éloigné dans le temps des réalités présentes. La Congrégation pour les causes des saints a, en effet, décidé « d’éviter de rechercher les candidats parmi les saints des époques passées, sans exclure pour autant ceux qui le mériteraient vraiment ». Mais ce n’est pas un critère intangible, la norme le précise elle-même. Une confirmation officielle provient de la nomination de sainte Hiledegarde de Bingen (1098-1179) et de saint Jean d’Avila (1499-1569) par le pape Benoît XVI, le 7 octobre 2012. Le critère de l’éminence de la doctrine est compris en ce sens qu’elle « se révèle toujours actuelle, et qu’elle est donc assumée par l’Église comme une aide pour l’accomplissement de sa mission à l’instant même où elle déclare Docteur de titulaire de ladite doctrine ». Il ne nous appartient pas de porter un jugement sur un éventuel doctorat en faveur de saint Césaire d’Arles. Nous nous sommes contentés d’apporter des éléments de jugement dans deux domaines : d’une part, celui du droit canonique, avec les différents conciles qu’il a présidés ou qui sont tributaires de ceux-ci et en indiquant leur contribution plus particulière au domaine liturgique ; et, d’autre part, celui des critères en vigueur pour étudier toute demande d’attribution du titre de Docteur de l’Église. Dans le même état d’esprit, nous n’avons pas voulu nous prononcer sur le fait que notre saint répond à tel ou tel critère. Encore une fois, tel n’est pas notre rôle. Il reste à souhaiter que des spécialistes se penchent sur l’œuvre de l’Arlésien – l’Association « Aux sources de la Provence » mentionnée in limine s’y emploie – et que ces études portent sur une éventail le plus large possible de disciplines. La traduction en français des nombreux sermons de saint Césaire que l’Association a entrepris constituera aussi une contribution majeure à la connaissance de la pensée arlésienne et à son actualité sur bien des points.
In his article, the author presents the canonical criteria for con- ferring the title of Doctor of the Church in the historical perspective. In this context, he presents the life and achievements of St. Caesar of Arles in view of possible conferring on him the title of Doctor of the Church. Despite the current tendency to limit such nominations, the author emphasizes two reasons for a possible nomination: first, his achievements in the field of canon law, and second, some other criteria that Saint Caesar of Arles meets to initiate the procedure of conferring on him such a title.
