The article discusses the issue of a withdrawal of an indictment by a public prosecutor, which was introduced to the Polish criminal proceeding by the Act of 27 September 2013 amending the Act on the Criminal Procedure Code and some other acts, which will enter into force on 1 July 2015. The essence of a withdrawal of an indictment, conditions for it, its scope and the role of the injured persons are discussed and a comparison with the former solution of dropping the charge by a public prosecutor is presented.
Przedmiotem artykułu jest cofnięcie przez oskarżyciela publicznego aktu oskarżenia wprowadzone do polskiej procedury karnej ustawą z dnia 27 września 2013 r. o zmianie ustawy – Kodeks postępowania karnego oraz niektórych innych ustaw, które wejdzie w życie w dniu 1 lipca 2015 r. Została omówiona istota cofnięcia aktu oskarżenia, warunki i zakres jego cofnięcia oraz rola pokrzywdzonego. Porównano także tę instytucję z dotychczas obowiązującym odstąpieniem oskarżyciela publicznego od oskarżenia.

This study is about the exploration of innovative management control systems in the context of New Public Management (NPM) initiatives. NPM initiatives created the changes to the structure and processes of public sector organizations with the objective of getting them to run better. A government department in the Australian Capital Territory (ACT) has been selected as the field for investigation. This study draws on a single theoretical perspective, Giddens’s structuration theory to understand the management control systems evolved in the researched organization. Qualitative research methodology is applied to obtain a better understanding of the phenomena. Case-based research method is used in developing a complete understanding of the relative role of controls in the management of organizational performance. In this study, it is argued that the researched organization has adopted various management control tools to improve its performance and demonstrate transparency and accountability. Some of the control tools it has adopted are the innovations in the public sector. It appears from the case that these adopted management control tools forced the researched organization towards better performance supporting the rationale of adopting New Public Management practices.

Celem artykułu jest próba określenia cech i zakresu nowej sfery publicznej, wskazania jej uczestników, a także implikacji wynikających z jej funkcjonowania. Główna teza opracowania zawiera się w następującym stwierdzeniu: nowa sfera publiczna umożliwia łatwiejsze zaangażowanie społeczne w kwestie publiczne i daje lepsze możliwości agregacji preferencji, co powinno skutkować większą efektywnością działania sektora publicznego. Pojęcie nowej sfery publicznej zostało zaproponowane w opozycji do tradycyjnej – mieszczańskiej, zdefiniowanej przez J. Habermasa. Jej najistotniejszą cechą jest wykorzystanie sieci Internetu, a w szczególności jego asynchronicznych cech do budowania więzi, grup zainteresowań i grup nacisku, wpływających na zakres przedmiotowy sektora publicznego.
The aim of this paper is to define the characteristics and scope of the new public sphere, indicate its participants, as well as the implications of its operation. The main thesis can be summarized in the following statement: the new public sphere facilitates involvement in public issues and provides better opportunities for preference aggregation, which should result in greater efficiency of the public sector. The concept of the "new public sphere" has been proposed in opposition to the traditional, bourgeois public sphere, defined by J. Habermas. Its most important attribute is that it uses the Internet, in particular its asynchronous features, to build relationships, interest groups, and pressure groups, influencing the scope of the public sector.

Background. In many economies, both developed and developing rapidly, we can observe the potential of administration as organizations which under appropriate conditions may show high levels of innovation. The administration on one hand may be an active participant and on the other hand act as a creator of conditions conducive to innovative activities. Both of these roles are important and complementary to each other because the administration can create a legislative base as well as adequate infrastructure and space for innovation, and then actively participate in the process of their diffusion. In recent years, the European Union has shown increasing interest in the actions for measuring innovativeness of the European administration and stimulating its growth. Research aims. The aim of the study is to compare the degree of innovativeness of Polish and Spanish administration and the activities undertaken to stimulate it. In research on the innovativeness of the EU economies (Innovation Union Scoreboard, 2014) both countries were in the group of "moderate innovators", although there are noticeable differences in the approach to the implementation of innovations and cultural conditions of their diffusion. Methods. The adopted research method was analysis of the reports on public sector innovativeness in the EU and foreign and national literature studies. Key findings. The analyzed research results clearly show a higher degree of innovativeness of Spanish administration in comparison to Polish administration. Creativity of employee is a prerequisite of efficiency of public sector. To a significant extent its level is determined by the model of organizational management. Therefore, inspiring are the ways of creativity building in public sector institutions. In the opinion of the Author, management style plays a significant part in supporting the development of the competence of creativity. Thus, the article presents the analysis of the influence managers have on shaping creativity of their employees in public sector in Poland. Researching the opinions of 346 employees of public sector has been the basis of drawing conclusions that enable both evaluation and identifications of impediments to the impact of managers on creativity of employees.

Purpose: In recent years more and more agile methods of software production have been used in information projects (IT projects). Apart from some common features with other measures, IT projects have their own specificity which should be considered prior to the choice of the Traditional Project Management (TPM) or Agile Project Management (APM) for management of a particular project. Owing to the specificity of the implemented projects the approach presented in agile methods is more and more frequently chosen and preferred both by the solutions providers and the clients. Furthermore, the use of one of the traditional or agile methods should be preceded by analysis of various types of conditions of the sector in which the public administration entity is functioning. Legal conditions, organizational and decision-making culture, project financing methods and maturity of teams and the whole organisation in the project management area, affect not only the choice of methods but also the final success of the project. The multicriterial analysis of limitations in information projects implementation in the public sector allowed identification of the most important recommendations within necessary changes. The article points out that agile methods will not entirely replace the traditional management of IT projects in the public sector, with the most effective approach being their harmonious coexistence. Design/methodology/approach: The recommendation to use the TPM and APM approaches in Polish public administration entities was preceded by analysis of the most important legal acts for this purpose and comparison of the position of our country (or cluster to which Poland is qualified) in the acknowledged European study from the cycle of eGovernment Benchmark dating back to the years 2004-2018. Recommendations for implementation of IT projects in the public sector were supported by analysis of CHAOS reports dating back to 2012-2018 and 11th, 12th and 13th Annual State of Agile Reports respectively from 2016, 2017 and 2018. The article does not treat separately each of the best known methodologies and methodologies of confirmed effectiveness, but considers the shared philosophy of traditional or agile approach. Findings: The development of e-government proceeds due to the implementation – from the private sector – of the form of management through the development of projects. Analysis of the position of the Polish e-government in the eGovernment Benchmark points to a high backwardness of the public sector in Poland as compared to other countries. The backwardness may be made up for through implementation of effective methods of IT project management. However, the choice of an agile method should be preceded by an analysis of specific achievable benefits and conditions which have to be fulfilled as they are necessary to achieve such benefits. The public sector conditions connected with the Public Procurement Law and informal limitations resulting, among other, from organisational and decisive culture will not allow, as for now, to fully use agile methods. Originality/value: The public sector in Poland is the largest but at the same time the most difficult customer of services and products from the ICT sector in Poland. For a large purchaser of the ICT sector solutions the choice of the most effective project management method becomes a significant determinant of the project’s success. In practice, there is no organization or project in which a methodology in its pure form could be used. Therefore, a given methodological approach has to be adjusted to the conditions of the sector in which the organisation is functioning and to a specific project.

In the face of constant pandemic-related and military threats to citizens’ right to work, collective bargaining has become almost the only real instrument to reconcile the interests of social partners and consolidate their efforts. The authors proposed a methodology for assessing the development of social partnership in the regulation of labour remuneration based on a set of indicators and a comparative analysis of the indicators in several public organisations: the State Audit Service of Ukraine, the State Treasury Service of Ukraine, the State Statistics Service of Ukraine, the State Fiscal Service of Ukraine, the Armed Forces of Ukraine, the State Border Guard Service of Ukraine, the Police of Ukraine, and the Pension Fund of Ukraine. Based on the challenges and general trends revealed by the results of the analysis, the authors identified areas for improving collective wage bargaining and the best practices in social partnership for their dissemination in public organisations.

This article discusses conditions of professional social work in public organizations, especially from the perspective of the Nordic countries. We propose that public arenas for social work consist of three domains with different functions and logics, yet interconnected and interdependent. These domains are the domain of politics, the domain of management and administration, and the domain of professional practice. The individual local organizations – made up of these domains with their respective logics – are in turn conditioned by a fourth domain, the domain of institutional conditions. This latter domain contains ideals of control, norms, and views of knowledge and technologies that exist in society, that are legitimized and disseminated by central institutions, and that govern important aspects of how the individual local organizations work. The purpose of this work is to contribute to the development of a domain theory for the organization of social work in the public sector.

Aim/purpose - This study examined the impact of public sector spending and governance on economic growth in Sub-Saharan Africa (SSA) and further assessed the role of governance in the causal relationship between public sector spending and economic growth in the sub-region. Design/methodology/approach - The study employed the Panel Corrected Standard Errors (PCSE) estimator on data spanning the period 2002 to 2020 across a sample of 31 selected countries in SSA. To check for the robustness of the results, we adopted the Dumitrescu and Hurlin (2012) panel non-causality test to detect Granger causality in the relationships among the variables. Findings - The findings show that spending in the public sectors alone, such as education and health, does not always yield the needed outcome of promoting economic growth. Government education expenditure stimulates economic growth in SSA, albeit the effect is statistically insignificant, whereas government health expenditure has a growth-limiting effect in SSA. The results reveal that government effectiveness, rule of law, political stability, and absence of violence/terrorism are among the governance indicators that can help to fast-track economic prosperity in SSA. However, the results further show that good governance can act as a stimulant to invigorate the effectiveness of public sector spending in achieving economic growth in SSA. The growth-enhancing complementary role of good governance to public sector spending is robust across all governance indicators except political stability for government education spending and regulatory quality for government health spending. Research implications/limitations - The findings imply that strengthening good governance in SSA is non-negotiable in managing and using public funds allocated to the public sectors and in achieving sustainable economic growth, poverty alleviation, and income inequality reduction in the sub-region. However, the findings of this study are limited to the SSA region and may not apply to other regions of the globe. Originality/value/contribution - The contribution of this paper is that it examines the moderation effect of governance in the causal relationship between public spending and economic growth in SSA while accounting for cross-sectional dependence. The paper also contributes to the existing literature by using disaggregated governance and public sector spending components to ascertain the robustness of the results and better inform policy.

The article is an attempt to present deliberations concerning effectiveness in the public sector operation including the communal sector. The entire public sector and entities operating within in have been an object of sharp critique both in the field of economic theory and practice for a long time. The article contains theoretical remarks concerning the operation of public sector entities in market economy conditions. It discusses the theoretical background for changes in the public sector and assesses cautiously the impact exerted by privatisation and other important factors on effectiveness of the public sector. The author points also to the possibility of rational and effective operation of public entities in competitive conditions, which is confirmed by experience of other countries.

Coraz bardziej palącym problemem staje się niska jakość polskiej administracji. Dotychczasowe próby zmian nie przynoszą pożądanych efektów, niekiedy wręcz pogarszają sytuację. Wprowadzenie powiatów spowodowało rozrost biurokracji przejawiający się między innymi gwałtownym wzrostem zatrudnienia w sektorze publicznym. Jednocześnie w ostatnich latach w wielu krajach przeprowadzono szereg reform podnoszących efektywność i jakość pracy administracji. Do takich krajów należą Wielka Brytania, Australia, Nowa Zelandia, Kanada i USA. Szczególnie interesujące i godne naśladowania są rozwiązania irlandzkie, które są wypadkową systemu "anglosaskiego" i "unijnego". Aby usprawnić działalność administracji w Polsce, należałoby wprowadzić takie rozwiązania jak: urynkowienie niektórych obszarów działalności, zmiany sposobu zarządzania finansami, obowiązkowy system mierników efektywności i jakości pracy instytucji, system rozwoju kadr, zmiany organizacyjne i szeroką informatyzację działalności.
Low quality of Polish administration is an increasingly urgent issue. Any attempts made hitherto to introduce modifications do not bring required effects, and sometimes even make the situation worse. Introduction of administrative division into poviats resulted in increased bureaucracy, noticeable in particular in a sudden rise of employment in the public sector. At the same time a range of reforms have been carried out in many countries which increase effectiveness and quality of the work of administration. These countries include Great Britain, Australia, New Zealand, Canada and the USA. Particularly interesting and worth following are the solutions adopted in Ireland, being a combination of the Anglo-Saxon system and that of the European Union. In order to improve the work of administration in Poland, the following solutions should be adopted: marketing of particular areas of activity; changes in the methods of managing public finances; obligatory system of the measures of effectiveness and quality of the work of institutions; personnel development system; organizational modifications; and broad computerization of the activities.

Objectives: The purpose of this paper is to create a model of public-sector and other-sector projects. Research Design & Methods: An extensive review of literature was performed. The snowball approach was applied for collecting relevant papers. Models of differences between public-sector organisations and other organisations were chosen as the reference models for building a model for project level. Findings: There are differences between managerial processes between public-sector and other-sector projects in all project management areas (integration management, scope management, cost management, schedule management, quality management, hr management, communications management, risk management, procurement management, and stakeholder management). Hence the most adequate model for explaining these differences is the dimensional model. Implications / Recommendations: Project managers will be able to better align their managerial methods to the sector in which project are implemented. For instance, in public-sector projects in the area of HR management motivation should be more focused on non-financial factors. Contribution / Value Added: The proposed model is the first, original, comprehensive model describing the differences between public-sector and other-sector projects.

In the global rankings of generalized trust, Poland occupies a low position. Polish people are rather distrustful. Analyses of trust endeavour to isolate (distinguish) distrust. Distrust is more and more often defined as a separate definition, not only as the opposite to trust. Analysis of distrust seems indispensable, in particular with reference to the public sector. Public sector organizations point out at building trust. The article is an attempt to systematize the concept of distrust through analysis of trust and separation of basic differences in both concepts (trust and distrust) was made. A great significance of distrust towards entities (organizations) of the public sector may be observed. The objective of the article and research was to prepare a theoretical basis for the studies on distrust in the Polish public sector. The paper includes theoretical frameworks, which may be used for a detailed research on the role and significance of distrust in the public sector. The paper is based on the literature review and generally available data.
