    The aim of the article is the reconstruction of a nature of EU’s immigration policy that emerges from EU’s activities and reaction on migration crisis, understood as an effect of the unprecedented inflow of economic migrants and asylum seekers in 2015–2016. The analysis is focused on presenting the impact of the concept of security on the nature and scope of legislative and political measures adopted by the EU in the scope of migration policy. The article underlines that security is a factor which fundamentally determines the EU’s migration policy. The EU’ intervention to the migration crisis, giving priority to security-driven concern, was focused to meet a ‘secure border’ demand, understood as a process of increase the level of their closeness (as a opposition to openness) and impermeability. In the effect, the EU’s response to the migration crisis was highly narrow, fragmentary and insufficient.

    The aim of the article is to show the challenges in scholarly attempts to conceptualize the phenomenon of irregular immigration. Although this type of migration has been of interest to scholars for several decades, it still requires in-depth analysis to better explain and understand its causes, scope, and consequences. The article attempts to clarify the nature of irregular immigration, indicating both the general ways of defining this phenomenon and the process of shaping it in socio-political reality since the end of the 19th century. The analysis reveals the internal diversity, dynamism, and ambiguity of this type of migration, which developed in parallel with the control instruments implemented by the states, aimed at enforcing increasingly complex immigration regulations conditioning the entry, stay and work of immigrants. The presented theoretical reflection on the complexity and the heterogeneity of irregular immigration is then confronted with the interpretation of this phenomenon in the EU immigration policy. Another important complement to these studies is to show the terminological challenges that have emerged in previous studies on irregular immigration. They are important both for the objectification of theoretical investigations and for an empirical analysis of this social phenomenon.

    The article analyzes the problem of immigrants’ participation in the elections on a local level as a display of political activity and the means of integration of the country and its migrants. Assuming the European-wide perspective it is noticeable that given countries differentiate in the level of enabling immigrants to participate in the political life. In Scandinavia and several north European countries there is the highest rate of immigrants’ participation, on the other hand, in the countries that joined the EU in 2004 the rate is the lowest. In 2010 immigrants without the EU citizenship were able to run for the local elections in 13 European countries and they had the voting right in 19 countries. In Poland only the EU citizens are allowed to participate in the elections. The research into the legal solutions enabling immigrants (especially those who are not from the EU) to acquire more voting rights proved to have interesting results. The research has shown that over a half of the people willing to participate in the parliamentary elections is for granting the voting rights to immigrants. According to the research among the electorates, the substantial percentage of the Platforma Obywatelska voters proved to be in favor of granting the voting rights to immigrants. Less support is displayed by the potential voters of SLD and Ruch Palikota. Furthermore, the majority of the PiS voters is against the immigrants’ participation in the local elections. Finally, the results of the research show that voters perceive differently the problem of granting immigrants the right to vote versus the right to stand for the elections. Although the first one is accepted by the majority of voters, the latter - not so much.

    Zapobieganie i zwalczanie nieregularnej imigracji było jednym z zasadniczych celów unijnej polityki imigracyjnej, od uzyskania przez UE kompetencji w tej dziedzinie. I chociaż na gruncie tej polityki imigracja nieregularna definiowana jest szeroko i obejmuje zjawiska dotyczące nielegalnego wjazdu, tranzytu oraz pobytu imigrantów w państwach członkowskich, UE zdecydowanie skoncentrowała swoje wysiłki na eliminowaniu nielegalnego wjazdu. W tym celu podejmowano działania w obszarach bezpośrednio z tym związanych, jak zwalczanie przemytu i walka z handlem ludźmi, a także takich, które stopniowo wykształciły własną logikę polityk szczegółowych jak: zarządzanie granicami zewnętrznymi, polityka wizowa czy polityka azylowa. Oznaczało to, że od początku aktywność UE wobec imigracji nieregularnej była rozproszona i stanowiła elementy kilku szczegółowych polityk, strategii i planów działania. Kryzys migracyjny lat 2015–2016 jedynie nieznacznie zweryfikował unijne podejście do nieregularnej imigracji. Priorytetem nadal pozostało eliminowanie nieregularnego wjazdu poprzez walkę z przemytem (prowadzoną środkami kontroli granic zewnętrznych z wykorzystaniem nawet instrumentów polityki bezpieczeństwa i obrony), przy wzmocnieniu wysiłków na rzecz drugiego celu, jakim stało się zwiększenie realizacji powrotów imigrantów, którzy nie uzyskali zgody na pobyt w państwach członkowskich. Ponadto, unijna uwaga w większym stopniu została też zwrócona w kierunku eliminowania pierwotnych przyczyn nieregularnej imigracji. W tym zakresie UE postawiła przede wszystkim na różne instrumenty polityki zewnętrznej, by współpracować z krajami pochodzenia i tranzytu imigrantów.
    Preventing and combating irregular immigration has been one of the key objectives of EU immigration policy since the EU gained competence in this field. Although irregular immigration is broadly defined in this policy and covers the phenomenon of illegal entry, transit and residence of immigrants in Member States, the EU has focused its efforts on eliminating illegal entry. To achieve this, actions were taken in areas directly related to it, such as combating migrant smuggling and the fight against trafficking in human beings, as well as those that gradu ally developed their own logic of specific policies such as: management of external borders, visa or asylum. This meant that from the very beginning, EU activity against illegal immigration was scattered and was a part of several specific policies, strategies and action plans. The migration crisis in 2015–2016 only slightly verified the EU approach to irregular immigration. The elimination of illegal entry by combating smuggling (carried out by means of external border controls and even security and defence policy instruments) remained a priority, complemented by strengthening efforts for the second objective, which was to increase the return of immigrants who were not allowed to stay in member countries. Additionally, EU attention has been turned more towards eliminating the root causes of irregular immigration. In this respect, the EU has focused primarily on various external policy instruments to cooperate with the countries of origin and transit of immigrants.
