Opis:
In the introductory part, the paper refers briefly to the historical interpretation of the provision of article 35 § 3 of the Polish Penal Code on the basis of further amendments to the Polish Penal Code of 1997 as well as contradictory ideas concerning its interpretation. Further on, the issue concerning the interpretation of the legal norm of article 35 of the Polish Penal Code is described on the basis of its current wording, taking into consideration the legal doubts connected with it that may come about when applying this regulation in practice. The paper also attempts to explain the role of the possible consent of a convict to pass on them a custodial sentence from the perspective of not only the court, but also and mainly the defendant themselves as well as their defence counsel. This issue is discussed taking into account the situation both before and after the custodial sentence has been imposed on a given perpetrator.

Artykuł odnosi się do ostatniego etapu wykonawczego kary ograniczenia wolności w przypadku jej niewykonania przez skazanego na nią sprawcę przestępstwa w kontekście orzeczenia wobec niego zastępczej kary pozbawienia wolności. Autor dokonuje analizy i oceny zakończenia postępowania w zakresie kary ograniczenia wolności na skutek orzeczenia i wykonania kary zastępczej z uwagi na niepozytywne zakończenie wykonania kary ograniczenia wolności przez skazanych. W szczególności omawia jako najdalej idące alternatywne prawnie dopuszczalne rozwiązanie modyfikujące rodzaj orzeczonej pierwotnie kary i jej wymiar wymierzonej w orzeczeniu końcowym, wobec określonego sprawcy czynu zabronionego. Autor dokonuje analizy i oceny aktualnego stanu prawnego, podkreślając związane z nim niedopatrzenia i wątpliwości w ujęciu praktycznym, odnosząc je do uprawnień sądu i stron postępowania wykonawczego.
The article refers to the final stage of execution of the sentence of restriction of liberty in the event the convicted offender does not serve the sentence and is subject to a substitute sentence of imprisonment. It analyses and evaluates the ending of the proceedings in the field of restriction of liberty as a result of the judgment and execution of a substitute sentence due to failure of the convicted offender to serve the sentence of restriction of liberty. In particular, as the most far-reaching alternative, it discusses a legally admissible solution for modifying the sentence imposed originally on a specific offender and changing its duration in the final judgement. Finally, it analyses and evaluates the current state of the law, highlighting its shortcomings and doubts in practical terms, relating them to the powers exercised by the court and the parties to the enforcement proceedings.

In the judgment with commentaries, the Provincial Administrative Court in Opole made a statement concerning the penalty of expulsion from a higher education institution as a disciplinary penalty declared only by disciplinary committees. From the point of view of the judgment with commentaries, it is of importance to specify that this penalty is not of “life-long” nature, nor dśs it result in deprivation of the right to study in other institutions. The author approves of the position held by the judgment with commentaries and claims it to be an accurate and significant voice of the judiciary, which may prove substantial in eliminating legal ambiguities (and absurdities) arising as a result of applying the provisions of law in regard to responsibilities of higher education students, drawing attention to the incomplete and insufficient form of the provision of the relevant legal regulation.

Injuries are much more often incurred by those who practice sports recreationally, which is probably caused by the lack of proper physical fitness and violation of the safety rules, as well as by the fact that mass sports attract much more people. The majority of dangerous, injury-prone situations in skiing are also generated by technical errors, lack of proper coordination, poorly fitted or faulty equipment. Although an accident is defined as a series of causes and circumstances that are difficult to anticipate, a considerable reduction of the number of sports accidents involving the locomotor system while skiing is possible, e.g. by promoting safety rules and analysing accidents that happen on the slopes. The characteristics of skiers' safety and injury rate have been developed by way of analysing skiing accidents that required rescue team interventions. The analysis comprised 90 skiers from the Kasprowy Wierch; 42 women (46%) and 48 men (54%) who were involved in skiing accidents in the 2008-2009 season, on the basis of accident sheets from the 2008-2009 season routinely delivered to the TOPR (Tatra Volunteer Search and Rescue) stations, which were made available to us.

Celem niniejszej pracy jest przedstawienie zasad dotyczących treningu w warunkach wysokogórskich odnoszące się do planowania programów treningowych. Przegląd literatury pozwala zrozumieć przebieg fizjologicznych zmian zachodzących w czasie górskiej aklimatyzacji, odróżnić reakcje człowieka w fazie ostrej od reakcji w czasie późniejszych okresów adaptacji. Osiągane korzyści przygotowania będące następstwem treningu w górach są następujące: zwiększony transport tlenu do mięśni, udoskonalenie funkcji krwi związanej z transportem tlenu, zwiększenie wydolności tlenowej, wpływającej na wzrost buforowej zdolności mięśni i krwi.
The aim of study is to present rules of training in mountain conditions relating to the planning of training programs. The review of literature allows us to understand the course of physiological changes during acclimatization in mountains and it also helps us to distinguish human responses in acute phase from responses during subsequent processes of adaptation. The benefits of preparation which are results of training in the mountains are as follows: increased transport of oxygen to the muscles, improvement of the blood functions associated with the transport of oxygen, increased aerobic capacity, which affects the growth of buffering ability of muscles and blood.

Purpose: The aim of the research was to reflect the location of Biologically Active Points (BAP) in microsystem of feet and hands reflex zone. Methods: We analised the database, including the Cochrane Library, Medline, PubMed, etc. on microsystems of hands and feet. The results of the Chinese Reflexology points locations of feet and hands microsystems are shown in the tables. Results: In the hands microsystem there are 46 points, and in the feet microsystem we located 70 points from the 12 meridians. In the feet and hands microsystem there are 22 independent points, 8 of which are located in the feet reflex zone, and 14 in the hands reflex zone. Conclusions: In the reflex zone of the ,,own organs” there are three BAP points − KI1 kidneys meridian points are situated on the sole side of the right and the left foot and the heart meridian point HT8 which is located on the left palm side. It turned out that the majority of Chinese points located within the reflex zone of feet and hands, are located outside the reflex zones of their organs.

The aim of the paper was to analyze: training effectiveness in the preparatory period, changes in contestants’ aerobic and anaerobic capacity in the preparatory period, changes in contestants’ motor abilities in the preparatory period, to compare the level of selected parameters of anaerobic capacity measured by means of Wingate test and aerobic capacity measured by means of Beep-test of kickboxing contestants with the results of contestants training similar martial arts. The research has been carried out on three contestants of UKS Gladiator Club who achieve high sports results. An analysis of obtained results shows that the training employed in the preparatory phase has been appropriately planned and effective enough. Both aerobic and anaerobic capacity in the preparatory phase has increased significantly. Anaerobic capacity of the examined contestants is higher than capacity of the contestants in the control group. Their aerobic capacity, on the other hand, is lower than in the control group. When planning further training in the future greater attention should be paid to developing aerobic capacity.

Aim: The aim of the study is an attempt to answer the question whether a long-term karate practice exerts influence on the incidence of injuries and what its type and underlying cause. Methods: The research was carried out in July 2013 in Cracow during a karate training camp. 125 people from Poland participated in the study. The participation in research was voluntary and people were informed about its aim and application. The average age was 37,6 ± 11,3 years. The youngest participant was 15 and the oldest 57. Median age was 39 which means that half of participants was not older than 39 and the other half was at least 39. Questionnaire techniques were used in the study. The research tool used to implement the selected technique was survey questionnaire. The questionnaire consisted of 23 open- and close-ended questions. Results: As results from own research, the greatest number of competitors (38) have suffered from contusion (47,1% of all injury types). This injury types constitutes almost half of all injuries. Among all injury types karate contestants suffered from last year, the most common were contusions (25,6% of all injuries). Conclusions: Karate training is not related to any serious injuries apart from contusions which at the same time are most common injury in this type of training. Contestants’ and training experience are not directly related to injury incidence. An appropriately organized, rational training and using prevention enables to avoid injuries. Circumstances of injury incidence change with contestants’ age and training experience.

The aim of the research was to diagnose chosen individual factors of adolescents’ physical development (motor skills, physical fitness, motor activity needs) and their influence on their actual level of physical activity in their leisure time. The subjects of the research were students of Cracow’s junior high schools. The probability sample of 295 girls and 329 boys were examined. The method used was a survey. The results of the examinations showed that the chosen individual factors had an influence on the actual level of physical activity in their leisure time. The boys’ motor skills (in contrast with the rest of the factors) correlated the least with the increase of the actual level of physical activity in leisure time, and in case of the girls, they did not correlate at all. Youngsters’ individual predispositions to undertake physical activity in their free time were at a medium-high level. Nevertheless, their internalization did not take place because more than a half of the subjects undertook physical activities at a low level (51.0%) or not at all (7.4%).

The aim of the paper it to analyze the effectiveness of training of fighters of UKS Gladiator Club in the preparatory phase and to analyze training loads used during that time. Participants included a group of 12 fighters of UKS Gladiator Club who have achieved high sports results – this group includes medalists of Polish Championships and of the Cup of Europe. Test were carried three times in the preparatory phase. Physical fitness parameters have been evaluated by means of selected tests of EUROFIT testing battery. Summing up, it should be noted that an important cognitive element of the research carried out is an observation of improvement of the level of physical fitness in case of the majority of investigated features, which was the intended effect of training in the preparatory phase. The adopted training load has caused an average increase of investigated parameters, which proves training effectiveness.

The purpose of training in ju-jitsu is developing characteristic adaptation to physical activity and optimizing body functions so as to obtain maximal achievements. A means to an end is mastering the fighting technique and develop the essential level of special physical fitness. The aim of this paper was to determine the influence of a modified circuit training conducted according to an original program on level of special physical fitness of ju-jitsu trainees. Ju-jitsu trainees having similar somatic parameters and training experience (3-5 years) were included in the research. 30 participants between the age of 21 and 28 have been selected by means of a purposeful selection. On the basis of different variants of a circuit training and governed by the guidelines of a functional training for trainees, we have developed a training programme which aims to develop special strength, stamina and speed skills. STATISTICA PL software was used to compile the results. In order to determine statistical significance of differences between pre- and posttest measurements in the evaluated group of Ju-Jitsu contestants, a t-test for related groups was used. In conclusion, the proposed training programme proceeds at a high level of intensity, which resembles start activity (which is indicated by the heart rate frequency measurement and lactic acid blood concentration) and may be used in ju-jistu training. The experimental training programme has exerted positive influence on the participants’ with respect to the number of movements made, which can affect their effectiveness in fight.

Purpose: The aim of the study was to determine the influence of participation in the XTERRA Poland 2017 triathlon on blood morphology indicators. Material and methods: The study was performed in a group among 10 triathletes aged 30-40 years. Blood was collected 24 hours before, immediately after , and 16 hours after the competition. Blood morphological indicators were evaluated using the ABXMicros60 analyser. Results: Comparison of the results among the first (24 hours before the competition), second (immediately after the competition), and third assessment (16 hours after the competition) revealed statistically significant changes for WBC [109/l], RBC [1012/l], HGB [g/l], HCT [l/l], MCV [fl] and PLT [109/l]. Conclusions: The intensity of effort in the XTERRA Poland 2017 triathlon competitors was confirmed in the results of blood morphology. Blood counts in those practicing triathlon well characterise the actual scope and direction of exercise changes and allow for the diagnosis of transient adaptive effects. The results of the research confirmed that vigorous physical effort during the triathlon increased leukocyte and platelet counts, but 16 hours after completing the competition, their value was close to baseline level. Most likely, this phenomenon was caused by the intense effort, stress or even eating a large meal before the competition. Analysing the red blood cell system showed a tendency towards decrease in the number of red blood cells, HGB and HCT both after the competition and 16 hours after its completion, which results from increased post-exercise haemolysis or the risk of anaemia.
Cel: Celem pracy jest uzyskanie odpowiedzi w jaki sposób udział w triathlonie XTERRA POLAND 2017 wpłynął na wskaźniki morfologii krwi. Materiał i metody: Badanie przeprowadzono w grupie 10 triathlonistóww wieku 30-40 lat. Krew pobrano 24 godziny przed zawodami, bezpośrednio po zawodach oraz 16 godzin po zakończeniu zawodów. Wykonano oznaczenia wskaźników morfologicznych krwi u triathlonistów w aparacie ABX MICROS 60. Wyniki: Analizując wyniki pomiędzy pierwszym pomiarem (24 godzin przed zawodami) a pomiarem drugim (bezpośrednio po zawodach) i trzecim pomiarem (16 godzin po) zaobserwowano zmiany istotne statystycznie dla: WBC [109/L], RBC [10¹²/L], HGB [g/L], HCT [L/L], MCV [fL], PLT [109/L]. Wnioski: Stopień zaawansowania wysiłku u zawodników startujących w triatlonie XTERRA POLAND 2017 został potwierdzony w wynikach morfologii krwi. Wskaźniki morfologii krwi u osób uprawiających triathlon dobrze charakteryzują faktyczny zakres i kierunek zmian wysiłkowych oraz pozwalają na diagnostykę przejściowych skutków adaptacyjnych. Wyniki badań potwierdziły, iż intensywny wysiłek fizyczny podczas triathlonu wpłynął na zwiększenie leukocytów i płytek krwi, jednak 16 godzin po zakończeniu zawodów ich wartość była zbliżona do stanu wyjściowego. Najprawdopodobniej zjawisko to zostało spowodowane intensywnym wysiłkiem, stresem czy nawet spożyciem dużego posiłku przed zawodami. Analizując układ czerwonokrwinkowy wykazano tendencję do zmniejszania się liczby krwinek czerwonych, HGB i HCT zarówno po zawodach jak i 16 godzin po zakończeniu zawodów co wynika z nasilonej hemolizy powysiłkowej czy zagrożeniem wystąpienia anemii.

Development of endurance in soccer players is mainly based on continuous runs and variable-intensity runs, supplemented with strength conditioning and sport-specific training. The aim of the study was to analyse selected parameters of physical capacity of soccer players after 8-week variable-intensity running training and circuit training. The experiment was carried out in a group of 34 soccer players aged 21 to 26 years. The athletes were divided into two groups: 17 people in the experimental group and 17 people in the control group. The experimental group was involved in 30-minute tempo runs two times a week for 8 weeks with variable intensity at AT. In the same period, the control group performed two 60-minute continuous runs at the intensity of 70-75%HRmax. The determination of metabolic thresholds used two indirect tests: the multistage shuttle run test (beep test) and maximal lactate steady state test (MLSS) with author's own modification. In order to evaluate maximal heart rate (HRmax), the research procedure was started from the beep test (distance: 20 m). The speed at the first level was 8.5 km/h and increased with each level by 0.5 km/h. Training of the experimental group where variable exercise intensity was used caused a statistically significant increase in HRmax (by 1.9%) and blood lactate levels at the AT (by 20.5%). The training in the experimental group led to the statistically significant (p < 0.05) increase in the parameters of the following variables: HRmax (by 1.9%); lactate level (by 7.85); HR at the AT (by 1,9%); lactate level at the AT (by 20.5%). The assumptions of the experimental training did not cause statistically significant changes in pretest vs. posttest HRmax and blood lactate levels for the LT. Endurance training with high intensity is more effective in soccer players compared to training with moderate intensity. Development of special endurance in soccer should also assume the intensity and method of working similar to the method used during sport competition.

Humans maintain balance in the vertical position through random movements that result from instability of the body supported in two points. These tracking movements are responsible for the motor activity focused on maintaining body balance. The role of the postural control system is to choose a strategy, that is, the behaviour as a response to stimuli and regaining the balance through coordinated activity of the muscles that stabilize the talocrural and hip joints that perform movements in the frontal and sagittal planes. The aim of this study is to evaluate the effect of equestrian classes on postural balance in the frontal and sagittal balance in healthy boys aged 15 to 17 years and boys at the same age with mild intellectual disability. The study examined 100 randomized boys aged 15 to 17 years with mild intellectual disability and healthy boys. The study participants were divided into two groups: experimental group, who participated for 12 weeks in equestrian classes and the control group, with boys attending outdoor or indoor physical education classes. Before and after completion of the study, both experimental and control groups were diagnosed by means of Accu SwayPlus force plate. Maximum and minimum locations of the position of the centre of pressure (COP) with respect to the base of support on the platform were evaluated in the frontal and sagittal planes. The description of the parameters was based on the arithmetic mean, maximal and minimal value, scatter diagram and percentage distribution of values. Correlation of the parameters was also evaluated. Significant changes were found in the experimental groups after horse-riding classes, which pointed to the improvement in balance response, particularly in the sagittal plane, both in terms of minimal and maximal values. The character of these changes was similar: value of body sway in the sagittal plane was reduced and the higher percentage of minimal values was recorded for each parameter in both planes after the equestrian effect. Correlations were found between maximum position of the centre of pressure (COP) in the frontal plane and minimal and maximal position of the centre of pressure in the sagittal plane. All the significant changes and trends found for the experimental group which occurred after 12 weeks of equestrian classes suggest improved parameters of balance. The lack of changes in balance parameters in the control group shows that the equestrian classes help develop balance abilities in healthy boys aged 15 to 17 years and, to a lesser extent, in those with mild intellectual disability.

Introduction: The aim of the research was to evaluate the relationship between selected body parameters and posture in a group of lower secondary school students. The formulated hypothesis assumed that body mass does not influence the posture of teenagers aged 14–16. Materials and methods: The research included a group of 73 students aged 14–16, including 42 boys and 31 girls. The research was conducted by means of a modern body posture computer analysis system – Zebris APGMS Pointer. Static indicators of body posture, as well as mobility and shape of the spine were analyzed as well. Results: The analysis of body built indicators has proven that there is not any statistical relationship between the distribution of body mass and the value of spinal curvature. What is more, it has turned out that there is a relationship between physical activity and the content of fatty tissue. Conclusion: Non-invasive monitoring of body posture as well as the parameters of body posture enables an early detection and correction of posture defects which influence human physical development and the quality of their life in the future.
