The subject matter of the present paper is art. 16 of the Polish Constitution Draft in the version which gained acceptance on the part of the majority of the members of the Constitutional Commission of the National Assembly at the sitting held on April 4, 1995. At the beginning the author states that setting the constitutional wordings on the State-Church relation in Poland under system transformations is a difficult and complicated task. These difficulties result above all from a discrepancy between ideological assumptions, with which post-communist parties approach to the Church, and the standpoint of the Polish Episcopate in this matter. Political parties, which as a result of the previous election gained majority in the parliament, and at the same time in the Constitutional Commission, draw on the communist or extremely liberal ideology. On the other hand, the Polish Episcopate postulate to include in the Constitution the principles which respect the identity of Polish culture and do not diverge from the solutions accepted in the constitutions of the contemporary democratic European states and are in line with the teaching of the Vatican Council. Art. 16, being a result of compromise, in its version accepted by the majority of the Constitutional Commission, entails the following principles: 1) the principle of equality of rights for churches and religious associations, 2) the principle of impartiality of the state authorities towards religious, philosophical and philosophy-of-life beliefs, while safeguarding a possibility to express them in public life, 3) the principle of respect for the autonomy and independence of the State as well as Churches and religious associations, each in its own sphere, and their cooperation for te good of man and the common good, 4) the principle of regulation of the bilateral relations between the State and the Church by way of agreements; at the same time, the relations between the State and the Catholic Church are to be regulated in the form of an international convention with the Apostolic See, whereas the relations between the State and other churches and religious association are regulated in the form of a law passed after an agreement with their appropriate representatives. On establishing the above principles the principles included in point 2 and 3 aroused most controversy. The representatives of political parties sharing post-communist or extremely liberal views sought to write down formulations stating "separation between the Church and the State", "secular character of the State" or "neutral philosophy of life of the State". They refused, however, to include a clear guarantee statuting that the relations between the State and the Catholic Church are to be grounded on the principle of respect for the autonomy an independence, and in the form of an international convention with the Apostolic See. Eventually, they accepted the principle that the regulation of bilateral relations between the State and the Catholic Church is to be grounded on an international convention. In place of the formulation stating neutrality of the State they introduced the formulation of "impartiality of the State authorities" towards "religious and philosophy-of-life beliefs". According to the author the formulation of "impartiality" is ambiguous. The problem of its importance may be an object of further controversies.

Przedmiot rozważań dotyczy genezy i interpretacji podstawowej zasady relacji między Państwem a Kościołem katolickim, proklamowanej w art. 1 Konkordatu między Stolicą Apostolską i Rzecząpospolitą Polską w latach 1993-1998 i potwierdzonej w art. 25 ust. 3 Konstytucji RP z 1997 r. Całość rozważań obejmuje dwie części. W pierwszej części ukazana jest geneza zasady poszanowania niezależności i autonomii Państwa i Kościoła katolickiego, każdego w swojej dziedzinie, oraz ich współdziałania dla dobra wspólnego. Autor stwierdził, że chrześcijaństwo wniosło do kultury ogólnoludzkiej oryginalny paradygmat dualizmu religijno-politycznego – przeciwstawny do panującego w świecie antycznym monizmu religijno-politycznego – i przedstawił kształtowanie się znaczenia tej zasady w epoce konstantyńskiej (od cesarza Konstantyna Wielkiego do Soboru Watykańskiego II). Druga część obejmuje: interpretację proklamowanej w art. 1 Konkordatu podstawowej zasady relacji między Państwem polskim i Kościołem katolickim w Polsce, jej uszczegółowienie w kolejnych artykułach Konkordatu w formie wzajemnych zobowiązań i uprawnień Państwa i Kościoła katolickiego oraz jej recepcję w art. 25 ust. 3 Konstytucji RP z 1998 r. w odniesieniu do wszystkich Kościołów i innych związków wyznaniowych, mających uregulowaną sytuację prawną. W zakończeniu autor stwierdza, że na podstawie przywołanych regulacji Polska jest państwem świeckim, opartym na zasadzie separacji przyjaznej i skoordynowanej.
The considerations concern the genesis and interpretation of the fundamental principle of the relationship between the State and the Catholic Church, proclaimed in Article 1 of the Concordat between the Holy See and the Republic of Poland in 1993–1998 and confirmed in Article 25 (3) of the Polish Constitution of 1997. The first part of the study presents the genesis of the principle of respect for independence and autonomy of the State and the Catholic Church, each in its own sphere, and their cooperation for the common good. It is claimed that Christianity contributed to the culture of whole humanity an original paradigm of religious-political dualism – at odds with the religious-political monism prevailing in the ancient world – and presented the formation of the meaning of this principle in the Constantinian era (from Constantine the Great to the Second Vatican Council). The second part includes: an interpretation of the basic principle of the relation between the Polish State and the Catholic Church in Poland proclaimed in Article 1 of the Concordat, its elaboration in the subsequent articles of the Concordat in the form of mutual obligations and rights of the State and the Catholic Church, and its reception in Article 25 (3) of the Constitution of the Republic of Poland of 1998 with respect to all Churches and other religious associations whose legal situation has been regulated. In the concluding section, the author states that on the basis of the cited regulations Poland is a secular state, based on the principle of friendly and coordinated separation.

At the stage of the transformations of the political system, which have been taken place in Poland since 1989, there is a debate on the type of the model of relation between the State and the Church in democratic Poland. Various opinions which have already been put forward should be grouped in two opposite standpoints. Those who favour the first standpoint postulate a change in legal regulations, which were imposed by the communist authorities in order to build an atheistic State. They justify their standpoint by adhering to the principle of respecting moral values by the democratic State. The proponents of the second standpoint, however, favour the preservation of the hitherto legal regulations, and particularly preservetion of the principle of „separation of Church and State” in the Constitution. They justify their standpoint by adhering to the assumptions taken from the ideology of radical liberalism. They raise an objection to the proponents of the first standpoint, namely that the latter want to impose a religious character on the contemporary Polish State. They introduce themselves as defendants of the lay State, neutral towards the system of moral values, and particularly Christian values. In order to clarify this controversy the author has carried out an analysis of the folowing questions: 1.the conception of the religious and lay State as well as their substantiations in the history of Polish statehood; 2.the conception of a State neutral towards moral value; 3.a requirement to respect moral values, and particularly Christian values, on the part of the democratic State; 4.postulated principles of mutual relations between State and Church, which should be written in the Constitution of III Polish Republic.
