One of the basic issues in the research on the fraternities is their system and internal structure. This problem has not been dealt with as a separate issue up to now. If it had been sometimes addressed, it would have been treated as a supplementation in the context of other issues. With regard to structure and internal organisation all fraternities were in principle similar, although there were at times differences between them. Sometimes they were small, more often however they were considerable and apparent. It all depended on the group to which a given fraternity belonged. The point was whether it was a devotional confraternity, or a member of charitable fraternities. In other words, this depended on the goals and tasks of a particular fraternity. The internal structure of fraternities was also influenced by the time of their establishment and the circumstances connected with their establishment. Bering all this in his mind, the author reviews the structure and internal system of several types of fraternities popular in the seventeenth and eighteenth centuries. He does it on the basis of accessible sources, old prints, and respective literature. In his considerations, he analyses particular offices and functions that occurred in fraternities. He looks upon them in the light of several selected fraternities, such as e.g. rosary, scapular, and literary confraternities (they were all Marian confraternities), and some fraternities devoted to particular saints (e.g. St. Ursula). For matters of comparison, he takes into consideration also examples of structures that some fraternities had. To sum up, the author notices that the structure of fraternity played an important role with regard to the vitality of fraternities, the form of their functioning, and their development.

This is yet another paper penned by the author on the problems of religious studies in the 17th and 18th c. Here the author deals with the question of the organization of religious studies in the 17th and 18th c. Similarly as in the previous papers he based his research on the material of the so-called religious questionnaire set up by G. Garampi, a nuncio in Poland in the period of 1773-1774, a questionnaire which is a unique source in this domain. Further material consisted of the literature concerning this subject. The author has arrived at the following conclusion. There were two ways of organizing religious studies. In the first one the criterion constituted of some needs and possibilities which were at the disposal of particular orders and provinces. Here come into play two possibilities of organization: setting up autonomous studies for particular disciplines, i.e., dogmatic, moral theology and philosophy or else creating for them joint studies. The total number of the houses of philosophical and theological studies in 1772 was 160. The latter was shared among 15 orders (we have no data concerning the organization of 23 houses of studies). In 28 cases there were autonomous, that is existing separately, studies of dogmatic theology. 14 houses were exclusively devoted to the studies of moral theology. Moreover 46 houses were organized in such a way that they combined either dogmatic theology, moral theology and philosophy or dogmatic theology and philosophy, or else moral theology and philosophy. In 49 monasteries there were autonomous philosophical studies which were not linked with any theological discipline. The second criterion according to which religious studies were organized was made up of some formal and legal premises. In view of this criterion one may distinguish the following studies: conventual, particular, material, formal and general. It is in the Dominican order that this division occurred in its fullest form. We find all types of studies in question in this order. The final part of the paper deals with the question of running the houses of studies, and especially with the tasks and function of prefect, that is the regents (a name which was alternately used in particular orders) of particular houses of studies.

In dem Artikel ist der Verfasser bemüht, das Funktionieren des Ordensstudiums im 17. und 18. Jahrhundert näher zu untersuchen. Dies geschieht unter Berufung auf die vom Verfasser schon früher verwendeten Angaben hinsichtlich der Seelsorgetätigkeit der Orden in der zweiten Hälfte des 18. Jahrhunderts, die sich auf das Material der sogenannten Ordensbefragung des Nuntius G. Garampi von 1772/73 gründet, sowie auf Informationen aus der einschlägigen Literatur. Im Ergebnis seiner Untersuchungen gelangt der Verfasser zu einer Reihe interessanter Bemerkungen. Erstens, dass die Orden − wenn nicht alle, so doch ihre überwiegende Mehrheit − bestrebt waren, mehr oder weniger organisierte eigene Studienhäuser zu besitzen. Besonders aktiv waren sie in dieser Beziehung im 17. und in der ersten Hälfte des 18. Jahrhunderts. Diese Bestrebungen waren sogar den Nonnenorden nicht fremd, sowohl was die lateinischen (Benediktiner und Zisterzienser) als auch die unierten Orden (Basilianer) betrifft. Der Verfasser ist der Ansicht, dass dies im engen Zusammenhang mit der Reform der katholischen Kirche gesehen werden muss, die vom Konzil in Trient eingeleitet wurde. Zweitens bemerkt er, dass das Ordensstudium oft seinen Sitz veränderte − oder besser gesagt, zu verändern gezwungen war. Es gab eine Reihe von Ursachen dafür, dass das Studium aus einem Kloster in ein anderes verlegt wurde. Meistens handelte es sich dabei um Überfälle durch fremde Heere, Seuchen und Epidemien u.a. Kataklysmen, die das Land heimsuchten. Die letzte allgemeine Bemerkung des Verfassers beruht darauf, dass das Niveau des Ordensstudiums, seine Entwicklung, Stabilität und Kontinuität in hohem Masse von der Einstellung der Klosteroberen und insbesondere von den für Lehre und Studium in den eigenen Provinzen verantwortlichen Provinzialoberen abhing. Man muss − dem Verfasser zufolge − feststellen, dass im allgemeinen alle Oberen grosses Verständnis für den Unterricht und das Ordensstudium zeigten. Fehlendes Verständnis von seiten der Oberen gehörte zu den Ausnahmen.

Making use of the well-known in Polish historiography and valuable source material, the so-called religious questionnaire by nuncio G. Garampi of 1773-74, as well as the most recent technical literature, the author discusses the process of formation and upbringing of the candidates for religious orders in the 17th and 18th centuries. In his considerations he confines himself to show the formation and upbringing which the candidates were subject to in the religious novitiates. The author pinponts that the Tridentine Council had a great influence on the setting of all matters related with the upbringing of religious youth in an order, and at the same time it was important for the very process of upbringing. This Council, while attaching great importance to a good formation of all candidates for the ministry (a well-known order to introduce theological seminaries in all dioceses), regulated also, among other things, the duration of novitiate in orders. From that Council on there were being set up central novitiates, introduced almost in all orders in place of the hitherto upbringing of the religious youth in all monasteries and abbeys. The abovementioned questionnaire makes notice of those novitiates. On the basis of them the author attempts to find the number of novitiates and novices in a dozen or so greatest orders in Poland at that time. The question of the age of the candidates for orders, practices and devotions which they carried on in the novitiate, the role and function of the novitiate’s magister, bills and handbooks used in the formation of candidates - these are the subsequent questions with which deals the remaining part of the paper. Contrary to the number of novitiates and novices, the latter data have been based on either general literature concerning the orders themselves or on the literature dealing with particular questions.

The article is a continuation of the author's research of teaching the law, and especially canon law, in monastic studies in the 17th and 18th centuries. The research was preceded by an article generally devoted to the teaching of law in monastic studies in the 17th and 18th centuries that was published in the periodical Prawo-Administracja-Kościół (2-3 (2000), pp.85-99). In the present article, with the use of the recently published compendium of the knowledge about Jesuits in Poland entitled Encyklopedia wiedzy o jezuitach na ziemiach Polski i Litwy 1564-1995 (compiled by Ludwik Grzebień SJ with the co-operation of a Jesuit team, Publishing House WAM, Cracow 1996) and of the literature of the subject, the author tries to look more closely at the issue of teaching canon law in the Jesuit order in Poland in the 17th and 18th centuries. He focuses on those two centuries for two reasons. Firstly, they were the period in which teaching canon law was only introduced to monastic studies, including Jesuit ones. Secondly, because it is for this period that the issue generally has not been undertaken and hence it is not widely known. The author's considerations resulted in a few interesting statements. It turns out that the process of introducing the teaching of canon law into the curriculum of Jesuit studies, like in the case of other orders, was very slow. This was closely connected with the fact that canon law, like history of the Church, was for a long time an auxiliary discipline and it was taught within theology, first of all moral theology. However, as soon as they became convinced that canon law should be taught, Polish Jesuits put this postulate into practice in a lot of their colleges. In this respect they followed the example of Akademia Wileńska (the Vilnius Academy), where as early as the forties of the 17th century the chair of canon law was established. Jesuit professors of canon law did not limit themselves to teaching but they also prepared theses for discussion and they wrote dissertations about this discipline. This work resulted in a situation which gave them a decided advantage in this respect over the other orders, where until the end of the period in question teaching canon law was treated as a matter of secondary importance.
