Opis:
According to the author, in the Polish legal system there is no regulation concerning the flag protocol. Therefore, the rules of diplomatic protocol as well as heraldry and vexillology customs are applied which allow for flying, apart from the national flag, also other symbols of states or international organizations. The author claims that, due to lack of provisions governing competence to determine which authority is an appropriate body for adopting flag protocols for particular public administration buildings, this should be the power of the Marshal (Speaker) of the Sejm, who – according to the Standing Orders of the Sejm – ensures order and decorum within the precincts of the Chamber.

Opis:
The author of this opinion analyzes the possibility of recognition as Deputy’s intervention his/her application with a letter to the First President of the Supreme Court for “immediate intervention” in a particular case previously examined by the Supreme Court. In the opinion of the recipient, that document should be considered as a violation of independence of the judiciary. The author of the opinion comes to the conclusion that this letter goes beyond the regulation of the so-called Deputy’s intervention, due to the fact that judicial authorities are not those bodies to which – under this legal institution – Deputies may address their concerns. The said letter may also be viewed on the basis of the provisions of the Code of Administrative Procedure regarding the complaint. Analyzing the document in the context of the provisions of the Constitution, the author claims that the character of the letter may be the sign of actions taken to exert influence the decision-making process, which would be beyond the scope of the technical and administrative services (the so-called court administration).

Opis:
The author argues that laconic regulation of the dismissal of members of the Labour Protection Council, in conjunction with the provisions specifying its composition and with the principle of personal discontinuation of parliament’s work, allows us to assume that the end of the term of the Sejm and the Senate may constitute a precondition for dismissal from membership of the Board of Deputies and Senators sitting in the chambers of previous term of office and for the appointment of their successors from among the members of parliament of a new term. The principle of rotation in the terms of office of the Labour Protection Council means that the Marshal of the Sejm may not dismiss its members at his/her own “discretion”. Because of such a flawed and unclear provisions of the Act on the National Labour Inspectorate, the existing law should, according to the author, be changed and supplemented.

Opis:
The opinion presents the interpretation of the definition of “parliamentary group representing a separate electoral list on the day of the start of the Sejm’s term”. The conditions that all Deputies’ associations have to meet in order to fall into this category have been indicated. Meeting such conditions is necessary for obtaining the right to participate of a representative of the group in sittings of the Council of Seniors. The need to amend the interpreted provision of the Standing Orders of the Sejm, in order to adapt it to relevant provisions of electoral law, has been also signalled.

Opis:
The provisions of the Standing Orders of the Sejm concerning the reduction of Deputy’s salary or parliamentary per diem allowance (as a form of financial penalty) do not require any changes, as there is no need to adjust Polish law to the jurisprudence of the European Court of Human Rights contained in the cases referred to in this opinion. The views expressed by the ECHR in these judgments may however affect the interpretation and application of the provisions of the Standing Orders of the Sejm concerning, in particular, the terms “a Deputy making it impossible for the Sejm to work” and “making it impossible to carry out the debate”. The author claims that the introduction into the Standing Orders of a requirement to give reasons for decisions on the reduction of salary or per diem allowance in order to avoid the allegation of “excessive severity of the penalty,” would also allow both to demonstrate that the principle of equality before the law and principle of proportionality are observed.
