- The use of medical immobilisation for some injuries can make it difficult to determine whether these impaired the function of a body organ for up to seven days or more. The publication presents the possibility of using in practice the method of forensic medical opinion created by the authors, which concerns the legal and penal qualification of bodily injuries in cases of medical immobilisation in patients suffering such injuries when it is necessary to carry out a follow-up medical examination to determine whether such impairment of bodily organ functions caused by injuries other than those specified in Article 156 of the Criminal Code lasts up to seven days or longer. The article uses forensic medical opinions formulated by the authors in cases concluded with valid court verdicts. If the nature of the injury does not make it possible to determine whether it impairs the function of an organ of the body for more or less than seven days, and immobilisation was ordered as part of the treatment, the period of immobilisation should not be equated with the period of organ dysfunction.
