    Poprzedni rok kalendarzowy, obecny oraz nadchodzący będzie decydujący dla uszczelnienia systemu gospodarki odpadami. Przepisy, które choć są mniej medialne niż dokumentacja cen transferowych, czy podatek od źródła - wprowadzają dość znaczące zmiany, które można ocenić pozytywnie z perspektywy środowiska, ale negatywnie z uwagi na wzrastające obciążenia dla przedsiębiorców. Kolejną nadchodzącą nowelizacją w tym zakresie jest projekt ustawy o zmianie ustawy o odpadach oraz niektórych innych ustaw, który został właśnie skierowany do dalszych prac w ramach Komisji Prawniczej. Powyższe oznacza, że ku końcowi zbliża się rządowy etap tego ważnego projektu, który wprowadza rewolucyjne zmiany jeżeli chodzi o funkcjonowanie podmiotów wytwarzających odpady, czyli właściwie w zakresie każdego przedsiębiorcy.

    Opis:
    A new act on maintaining the cleanliness and order in communes of 1 July, 2011, will become effective in Poland on 1 January, 2012. The act will come fully into force on 1 July, 2013. According to this act regulations, commune self-governments take over the obligations of the property owners concerning waste management, moreover, they become responsible for construction and maintenance of the infrastructure supporting recycling and waste disposal processes. The self-governments were granted a 1.5 year transition period to implement the act regulations.The introduced changes are an adjustment of Polish regulation to the European law. Only in Poland and Hungary local self-governments have not yet been responsible for management of waste generated in their areas.The article presents an analysis of the basic changes introduced by the act to the Polish system of municipal waste management. Presented are also the estimates of the mass of wastes collected on the territory of Poland with particular regard to the Małopolskie voivodeship. Calculations and forecasts were made on the basis of information collected by the Main Statistical Office (GUS) and commune offices, where systems similar to the one introduced by the act have been operating for several years. The act assumes that all citizens of Poland will be covered by a system of waste collection, but will also have to pay so called "garbage tax", which should translate into increased amount of collected wastes, especially in these communes where wastes collection system was faulty. In Małopolskie only in 30 communes the 100% of inhabitants have signed contracts for garbage disposal. In the communes where the modern municipal waste management system has been operating, the increase in the mass of collected wastes (for the first three years of system operation) ranged between 31% and 94% in relation to the mass collected in the year preceding the introduction of the new system, although over 90% of local inhabitants were covered by the previous system. As results from the analyses, after introducing the new act the amount of wastes collected in the Małopolskie voivodeship may increase from the level of 765,000 Mg (2010) to over 1.1 M Mg (1.4 M Mg according to less optimistic forecasts), assuming that all generated wastes will be collected (the same amount as in 2010). In some of the Małopolskie communes the estimated increase in collected municipal wastes may reach over 500%.

    Opis:
    Wojewódzki Sąd Administracyjny (WSA) w Białymstoku w wyroku z dnia 9 czerwca 2020 r., oddalając skargę Spółki z o.o. w H. na zarządzenia pokontrolne Podlaskiego Wojewódzkiego Inspektora Ochrony Środowiska w Białymstoku z dnia 6 listopada 2019 r., uznał konieczność realizacji obowiązku wynikającego z art. 25 ust. 6a ustawy o odpadach, tj. prowadzenia wizyjnego systemu kontroli miejsca magazynowania odpadów, obowiązującego w opinii WSA od lutego 2019 r. pomimo braku wydania aktów wykonawczych przez właściwego ministra. Określenie wymagań dla prowadzenia wizyjnego systemu kontroli miejsca magazynowania lub składowania odpadów, minimalnych wymagań dla urządzeń technicznych wizyjnego systemu kontroli oraz wymogów przechowywania i udostępniania zapisanego obrazu, kierując się koniecznością umożliwienia sprawowania nadzoru nad działalnością w zakresie gospodarowania odpadami, nastąpiło mocą przepisów rozporządzenia z dnia 29 sierpnia 2019 r., które weszło w życie w grudniu 2019 r. W opinii WSA przepisy wynikające z ustawy o odpadach nie muszą być jednak spełnione łącznie z przepisami wydanymi na podstawie rozporządzenia, gdyż normy aktu wykonawczego są jedynie dopełnieniem warunków ogólnych wynikających z przepisów ustawowych.
    The Voivodeship Administrative Court in Bialystok, in its judgement of 9 June 2020, dismissing the complaint of the limited liability company in H., on the post-inspection orders of the Podlaskie Voivodeship Inspector for Environmental Protection in Bialystok of 6 November 2019, considered the necessity to fulfill the obligation under Article 25 para. 6a of the Act on Waste, i.e. the operation of a visual control system for the place of waste storage, in force, in the opinion of the Court, from February 2019, despite the lack of executive acts issued by the competent minister. Determining the requirements for the visual control system of the place of storage or storage of waste, the minimum requirements for the technical devices of the vision control system and the requirements for the storage and sharing of the recorded image, guided by the need to enable supervision over the activities in the field of waste management, was established pursuant to the provisions of the Regulation of 29 August 2019 which entered into force in December 2019. In the opinion of the Court, the provisions of the Act on Waste do not have to be met together with the provisions issued on the basis of the Regulation, as the standards of the implementing acts only supplement the general conditions resulting from the statutory provisions.

    The implementation of the provisions of the Act on cleanliness and order in municipalities has raised doubts as for which body is competent to examine the compliance with the regulations of the local law. Before the amendments to the Act, municipal regulations in the field were supervised by the regional governor (Polish: wojewoda), while the owner of an estate made payments directly to those who take the waste away, on the basis of a civil law agreement. With the amendments, the system has been based on declarations, while payments have been subject to tax law; it is not, however, at any point called a local payment. On the other hand, on the basis of the Act resolutions are still made, related to the municipal waste management system, not directly connected with the payment. That is why supervision bodies are having some problems with identifying the legal nature of the payment and the scope of resolutions adopted.

    Opis:
    This article attempts to evaluate the effects of the amendment to the Act on maintaining the cleanliness and order in Polish municipalities based on the reports of local governments of the following three voivodeships: the Lesser Poland (Malopolska), Opole and Silesia, in terms of the implementation of provincial waste management plans for the period 2011-2013. The chosen period of analysis includes the breakthrough between the rules of the Act on maintaining the cleanliness and order in municipalities prior to the amendment and after amending it to a large extent. This allows to assess the influence of the amendment on the attitudes of local governments concerning the problem of waste management and the effects of changing those attitudes according to the letter of the amended law.
    W artykule podjęto próbę oceny efektów nowelizacji ustawy o utrzymaniu czystości i porządku w polskich gminach na podstawie sprawo-zdania samorządów trzech województw: małopolskiego, opolskiego i śląskiego z realizacji wojewódzkich planów gospodarki odpadami za lata 2011-2013. Wybrany okres analizy obejmuje przełom pomiędzy rządami ustawy o utrzymaniu czystości i porządku w gminach w brzmieniu sprzed nowelizacji i tejże ustawy w dużym zakresie zmienionej. Daje to możliwość oceny wpływu nowelizacji na postawy samorządów w stosunku do problemu zarządzania gospodarką odpadami oraz efektów zmiany tych postaw, zgodnie z literą ustawy znowelizowanej.
