Wywołuje on również potrzebę odniesienia się do kwestii – czy warunkiem wystarczającym do istnienia praworządności w państwie jest jedynie przestrzeganie najwyższej mocy prawnej norm konstytucyjnych?
The rule of law of the state is beginning to be of particular and increasing importance in the current political situation. This requires a revision of views on the standards and expectations that one can have towards the law-abiding state and its apparatus. The scope of the issue thus determined requires reference to the constitutional concept of a democratic state governed by the rule of law and its role in determining imperatives in the activities of the state and its organs. It also raises the need to address the issue – is it sufficient for the existence of the rule of law in a state to only respect the supreme legal force of constitutional norms?

Opis:: The purpose of this article is twofold: on the one hand, to relate the fiscal and financial model to the Social and Democratic Rule of Law, on the other one, to transfer Spanish experiences that may be of interest to Poland, as both countries began their democratic experience and integration into the European Union a few decades ago. From a multidisciplinary perspective, the contributions that law could make to the field of political economy can be of capital importance for the consolidation of our democratic systems, public order, and social peace, analyzing the role of religious confessions. Methodology. To achieve this purpose, the analytical-comparative-interdisciplinary method was chosen as it was considered the most appropriate one in view of the close connections between economics, law, progress and social peace. The result of the research. The work shows that democracies, although they are the most effective models for achieving the highest standards of progress, and even though in the Polish and Spanish cases, they have the advantage of having served to bring dictatorial periods to an end, there is a need for effective control mechanisms. Democracies absolutely cannot degenerate into corrupt and ineffective systems under the control of large political and partisan oligarchies. The independence of the judiciary is, in this sense, an essential and inalienable element in guaranteeing the correct functioning of other state institutions. It is necessary to insist on the importance of the legal norm as an instrument of political control and its impact on macroeconomics, and the consolidation of democratic regimes, even more in the context initiated with the respective integration processes in the European Union. On the other hand, the aim is to show how beneficial tax treatment for religious denominations has a powerful effect on the achievement of the common good and social peace. In addition, it is about relating importance that has the budgetary balance and mechanisms for controlling public expenditure for the maintenance of progress and social justice in a sustainable model.

Opis:: Recent years have witnessed the publication of a number of research papers and books seeking to assess threats of electoral victories of anti-establishment politicians and political parties, described as authoritarian populists. This essay focuses on three books directly addressing the origins and threats of authoritarian populism to democracy. It consists of six sections and the conclusion. The first section presents findings (Norris and Inglehart) based on surveys of values of voters of various age cohorts concluding that authoritarian populism is a temporary backlash provoked by the post-materialist perspective. The second section examines the contention, spelled out in Levitsky and Ziblatt, that increase in openness of American political system produced, unintentionally, a degradation of the American political system. The third section continues brief presentations focusing on to the causes and implications of “illiberal democracy,” and “undemocratic liberalism” (Mounk). The fourth section examines developments in the quality of democracy in the world showing that despite the decline in Democracy Indices, overall there was no slide towards non-democratic forms of government in 2006–2019. The next two sections deal with dimensions missing in reviewed books; the notion of nation-state, international environment, civic culture and, in particular, dangers of radical egalitarianism to democracy. The last section concludes with regrets that the authors ignored rich literature on fragility of democracy and failed to incorporate in their analyses deeper structural factors eroding democracy: by the same token, return to the pre-populist shock trajectory is unlikely to assure survival of liberal democracy.
