    Opis:
    The family represents a fundamental social unit, consisting of individuals connected by marital and parental bonds. The relations between family members are determined by traditions handed down by means of upbringing, which, in turn, is based on shared emotions and attitudes subjected to the laws and moral order of nature. The prerogatives recognised by the family are also heavily affected by religious axioms. Generally speaking, the family represents the cultural legacy of whole generations falling under the influence of numerous factors, each of them being a link in the family’s history. The analysis of the function of the family as a fundamental social group and of parental responsibility indicates that the functions of the family are more extensive than the functions of parental responsibility. This is because the functions of the family are fulfilled by all its members, adults and minors alike. Those functions performed by adult family members are subject to a number of norms included in the Family and Guardianship Code. However, the family’s desired performance positively affects fulfilment of parental responsibility.

    Opis:
    The family is community of persons connected with oneself with the marriage and parental relationship, and at the same time the social fundamental unit. Every of families in relations with the society surrounding her, as the larger community expects regarding and accepting the identity for her with everyone with customs adopted in it and the code of conduct. So that it is possible must fulfil the functions assigned by the society to her in accordance with his business. When he isn’t performing these functions if this is the case a dysfunction is happening. The realization of these functions in the main measuring cup depends on conducts of marital and parental adult family members which through the virtue of its association created frameworks for her. These attitudes differ depending on the stage of the development of the family, it is early, centre and final. The dysfunction is creating bright prospects of the annihilation early stage, when spouses are associating their hopes and prospects with the development of the family. Remaining stages of her development require giving hope and the awareness of these prospects.

    Opis:
    Legal regulations regarding the performance of family functions and parental responsibility find expression in many norms included in the Family and Guardianship Code. The article reviews the forms of institutional assistance that are included in the Polish legal system, taking into account the importance of the family for the development of all its members, especially minor children. In case of problems in the area of parental responsibility, state authorities undertake voluntary (pre-trial) and forced (judicial) interventions. The subject scope of assistance provided to the family, depending on the type of problems and the degree of dysfunctionality, by state institutions based on normative acts of various levels was also analyzed.
    Uregulowania prawne dotyczące realizacji funkcji rodziny oraz władzy rodzicielskiej przez dorosłych jej członków znajdują wyraz w szeregu norm zawartych w Kodeksie rodzinnym i opiekuńczym. W artykule dokonano przeglądu form instytucjonalnej pomocy umocowanych w polskim systemie prawnym, uwzględniając znaczenie rodziny dla rozwoju wszystkich jej członków, a szczególnie małoletnich dzieci. W przypadku wystąpienia problemów w zakresie pełnienia władzy rodzicielskiej organy państwowe podejmują interwencje o charakterze dobrowolnym (stadium przedsądowe) i przymusowym (stadium sądowe). Analizie poddano także zakres przedmiotowy pomocy udzielanej rodzinie – w zależności od rodzaju problemów i stopnia dysfunkcjonalności – przez instytucje państwowe na podstawie aktów normatywnych różnych szczebli.     The article explores the issue of reconstructed families, focusing specifically on the roles of individual family members and the processes that occur within such families. Due to the complexity of the above processes, the article concentrates on the deliberations about the stepparent’s upbringing process towards the stepchild, determining its content, scope and role. The article analyses of the stepparent’s duty towards the stepchild, highlighting its normative sources, and assesses this duty in relation to the parental authority of the spouse and the parental authority of the other biological parent outside the reconstructed family. The deliberations presented in the article aim to support the primary thesis of the article that in order for the foster parent’s current custody of the child to be effective, the stepparent’s situation in terms of upbringing obligation should be made independent of the biological parent’ situation, which stems from their parental authority. The article proposes introducing for example, an institution of the so-called “adoptive parent’s care” that would encompass some rights and obligations typical of parental authority and independent of the parental authority of the child’s biological parent. This could serve as an equivalent to the concept of parental responsibility found in English law.

    W artykule zostało podjęte zagadnienie rodzin zrekonstruowanych, a dokładniej – roli poszczególnych członków takich rodzin i procesów, jakie w tego rodzaju rodzinach zachodzą. Z uwagi na wielość tych procesów skupiono się na rozważaniach dotyczących procesu wychowawczego ojczyma (macochy) względem pasierba poprzez ustalenie jego treści, zakresu i roli. Tekst stanowi więc analizę obowiązku rodzica przybranego względem pasierba, wskazując na jego normatywne źródła, a także na analizę przedmiotowego obowiązku w odniesieniu do władzy rodzicielskiej współmałżonka oraz w odniesieniu do władzy rodzicielskiej drugiego rodzica biologicznego pozostającego poza rodziną zrekonstruowaną. Poczynione tu rozważania mają więc na celu wykazanie zasadniczej tezy artykułu, że aby bieżąca piecza rodzica przybranego nad dzieckiem była skuteczna, należałoby uniezależnić sytuację ojczyma (macochy) w zakresie obowiązku wychowawczego od sytuacji rodzica biologicznego, wynikającej z przysługującej mu władzy rodzicielskiej, i wprowadzić np. instytucję tzw. „pieczy rodzica przybranego”; obejmowałaby ona niektóre uprawnienia i obowiązki typowe dla stosunku władzy rodzicielskiej i byłaby niezależna od władzy rodzicielskiej rodzica biologicznego dziecka. Mogłaby być odpowiednikiem istniejącej w prawie angielskim instytucji odpowiedzialności rodzicielskiej.
    The article deals with the issue of reconstructed families, and more specifically, the role of individual members of such families and the processes that take place in such families. Due to the multiplicity of the above processes, the article focuses attention on the deliberations about the stepparent’s upbringing process towards the stepchild by determining its content, scope and role. The present article is therefore an analysis of the above duty of the stepparent towards the stepchild, pointing out its normative sources, and also an analysis of this duty in relation to the parental authority of the spouse, and in relation to the parental authority of the other biological parent remaining outside the reconstructed family. The deliberations presented in the article are aimed at demonstrating the main thesis of the article that in order for the foster parent’s current custody of the child to be effective, the situation of the stepparent in terms of the upbringing obligation should be made independent of the situation of the biological parent, which results from the parental authority vested in him/her, and introduce, for example, the institution of the so-called “adoptive parent’s care”, which would include some rights and obligations typical of parental authority and would be independent of the parental authority of the child’s biological parent. It could be an equivalent of the concept of parental responsibility existing in the English law.
