    At this moment, the presence of foreigners in our country is one of the importan problems aefcting society in Poland. eTh unstable situation on the eastern border with Belarus and numerous attempts to illegally cross the border by emigrants - refug from, among others, Syria, Iraq, or Afghanistan, are one of the very popular topic of public and media disputes or topics discussed by politicians. This topic is very important and crucial - it concerns first of all respect for human rights in relation those people. Nevertheless, in Poland, apart from the problem of illegal foreigne there are also citizens of other countries who reside legally in our country. Curre it is a growing group, whose members are not citizens of our country, but they ar an increasingly important part of our society. eThrefore, it is worth taking up this topic and reflecting on the situation of foreigners who reside legally in Poland. eTh subject of this article is the issue of social security of foreigners staying in Poland. Th basic research question to which this article is to answer is the question of wheth foreigners legally residing in the territory of the Republic of Poland are guaran social security - it means if they have ability to live, survive and develop. eTh article will use the method of an interview and a survey conducted among foreigners livin in our country, as well as an analysis of available documents and sources regardi the situation of foreigners in Poland. eTh results of the research and analyzes indicat that the situation of foreigners in Poland is relatively correct, but not in all are needs of this group are fully satisfied.

    Celem opracowania jest syntetyczne przedstawienie obecnego stanu brytyjskiego systemu zabezpieczenia społecznego w kontekście Brexitu i jego konsekwencji dla Polaków przebywających w Wielkiej Brytanii na przykładzie zabezpieczenia od bezrobocia. Prawa, z których korzystają Polacy, nie posiadają statusu „praw nabytych” w rozumieniu prawa międzynarodowego i dlatego są przedmiotem negocjacji w ramach Brexitu. Brak porozumienia między Wielką Brytanią a Unią Europejską w zakresie zabezpieczenia społecznego będzie miał negatywne konsekwencje dla Polaków przebywających na Wyspach Brytryjskich.
    Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union (Brexit) will definitely, and in various manners, influence the situation of Poles residing there. Rights, which they currently enjoy, do not possess the status of ‘acquired rights’ under international law and have, in consequence, become subject to Brexit negotiations between the UK and the EU. It is therefore worthwhile to analyse the situation of Poles in the United Kingdom from the point of view of their social rights in particular. The article synthetically presents therefore the current state of the British social security system in this context, focusing on the example of protection from unemployment. It has been written at a time, when guarantees of preservation of the rights in question have already been formally put forward, but their practical implementation is still dependent on the overall result of the EU-UK negotiations, and a still possible lack of agreement between the parties would defifi nitely bring adverse consequences for these rights.

    Niniejszy artykuł obejmuje rozważania dotyczące prawa do świadczeń z pomocy społecznej w świetle Konstytucji RP. Celem jego jest przedstawienie zasad i norm prawnych odnoszących się wprost do tego prawa. Na podstawie materiału w nim zgromadzone- go można zasadnie przypuszczać, że wśród wartości i norm określonych w Konstytucji i odnoszących się do sfery praw socjalnych człowieka na szczególną uwagę zasługuje godność człowieka, a także zasada pomocniczości, które to zasady znajdują odniesienie do problematyki dotyczącej pomocy społecznej.
    This article discusses the right to social assistance benefits in the light of the Polish Constitution. Its purpose is to present the principles and legal norms directly related to this law. On the basis of the material contained therein, it can reasonably be assumed that among the values and norms specified in the Constitution and relating to the sphere of human social rights, human dignity deserves special attention, as well as the principle of subsidiarity, which are related to the issues of social assistance.

    The paper is an approach to present the category of social rights in the background of entire legal system of the human rights protection. It is particularly dealing with the issue of nature of the 2nd generation of human rights and its significance for society. It starts with a brief presentation of the philosophical (human dignity) and normative roots as well as a short historical view of the human rights’ codification; the established legal terminology (human rights, fundamental rights, individual rights and liberties) and various levels of the legal protection (international – of global or regional nature, supranational and national one). Thereafter it focuses directly on the issue of social rights. Unlike the 1st generation of human rights, they are rather connected with public activity, policy and services (facere) than with autonomy and liberty (non facere). This, in turn, demands appropriate institutional structures and procedures. Social rights are hardly provided – in a binding and effective way – by global or regional international law. Thus, the burden of their protection, guaranty and execution is satisfied by the particular state and depends on its economic and social circumstances. On the other hand – they significance is based on fact that they serve the protection of social security which is the fundamental issue for both – dignity and sense of community.

    Proces wystąpienia Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej z Unii Europejskiej (Brexit) przyniesie różne konsekwencje dla mieszkających tam Polaków. Prawa, z których nasi obywatele korzystają, niestety nie posiadają statusu „praw nabytych” w rozumieniu prawa międzynarodowego. Dlatego są przedmiotem negocjacji w ramach tego procesu. Celem opracowania jest syntetyczne przedstawienie obecnego stanu brytyjskiego systemu zabezpieczenia społecznego w odniesieniu do świadczeń emerytalnych Polaków. Brak porozumienia w zakresie zabezpieczenia społecznego w procesie negocjacji będzie miał negatywne konsekwencje dla Polaków przebywających w Wielkiej Brytanii. Istnieją jednak podstawy do ostrożnego optymizmu w kwestii gwarancji utrzymania posiadania omawianych praw.
    Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union (Brexit) will defifi nitely bring various consequences for the Poles residing there. Rights, which they currently enjoy, are a subject of the Brexit negotiations, especially as they do not possess the status of ‘acquired rights’ under international law. It is therefore worthwhile to analyse the situation of Poles in the United Kingdom from the point of view of their social rights in particular, including their rights with a long-time perspective, e.g. in the respect of pensions. The article synthetically presents therefore the current state of the British pension system in this context. It is being published at a time, when the results of the negotiations in question can’t yet be foreseen. However, it may already be stated, that a lack of withdrawal agreement would be their one defifi nitely negative result, and that there are grounds for cautious optimism as to the guarantees of preservation of the said rights.

    The article shows the role of comprehensive rehabilitation in restoring good health, ability and in social and professional activation of the growing population of the disabled. The author discusses changes that have occurred in the approach to disability over time. The paper stresses the importance of comprehensive rehabilitation including medical, social and professional rehabilitation due to the fact that rehabilitation results depend on the work of a team of professionals from different fields working under the direction of a doctor specialised in rehabilitation medicine. It also presents acts of international and domestic law pursuant to which Poland should provide the disabled with equal and quick access to comprehensive rehabilitation, thus enabling them to participate in all aspects of life as fully as possible.

    The SARS-CoV-2 coronavirus pandemic brought to light certain deficiencies in the social security infrastructure which should guarantee social security for all Polish citizens while ensuring, in particular, the possibility of exercising the right to health protection and social services for functionally disabled people. The pandemic became a “detonator” revealing, both in the scientific and public discourses, problems connected with the effective exercise of the rights to social security and health protection vested in elderly people, including those with functional disabilities. The article notably focuses on two areas of social life in which compliance with fundamental rights related to the dignity of a human being is linked to the respect and observance of rights related to the functioning of a specific age group – people over 60 years of age. The pace of demographic changes is not without impact on the quality of life of elderly people. The article attempts at outlining the problems triggered by the demographic changes taking place in Polish society and at indicating the legal context, often related to the specific needs of senior citizens, or, more accurately, to the failure to satisfy these needs. The purpose is to shed light on the social dimension of respecting elderly people’s rights to social support in the form of providing access to social security and health care institutions during the COVID-19 pandemic. The questions asked are: Are elderly people’s rights to social security and adequate health protection respected in Poland? Did the outbreak of the COVID-19 pandemic improve or worsen the situation in Poland in this regard?
    Pandemia koronawirusa SARS-CoV-2 uwidoczniła braki infrastruktury zabezpieczenia społecznego, która powinna gwarantować bezpieczeństwo społeczne wszystkim obywatelom Polski, a w szczególny sposób powinna zabezpieczać możliwość korzystania z prawa do realizacji usług zdrowotnych i społecznych osobom niesamodzielnym. Pandemia stała się „detonatorem” ujawniającym w dyskursie naukowym i publicznym problem braku skutecznej realizacji prawa osób starszych, w tym niesamodzielnych, do zabezpieczenia społecznego i ochrony zdrowia. W artykule szczególną uwagę zwrócono na dwa obszary życia społecznego, w których respektowanie praw podstawowych związanych z godnością osoby ludzkiej jest powiązane z poszanowaniem i respektowaniem praw powiązanych z funkcjonowaniem konkretnej grupy wiekowej – osób powyżej 60. roku życia. Tempo przemian demograficznych nie pozostaje bez wpływu na jakość życia osób starszych. W artykule starano się wskazać na kontekst prawny oraz ukazać problemy, jakie niosą za sobą wspomniane przemiany demograficzne społeczeństwa polskiego, często powiązane ze szczególnymi potrzebami seniorów, a ściślej z brakiem zaspokojenia tych potrzeb. Celem jest przybliżenie społecznego wymiaru respektowania praw osób starszych do wsparcia społecznego w postaci dostępu do instytucji zabezpieczenia społecznego i ochrony zdrowia w okresie pandemii COVID-19. Czy prawa osób starszych do zabezpieczenia społecznego i właściwej ochrony zdrowia są w Polsce respektowane? Czy wybuch pandemii COVID-19 wpłynął na poprawę czy też na pogorszenie sytuacji w Polsce w tym zakresie?

    Referring to the centenary of the International Labour Organization, and beginning with the assessment of the current state of social security in the world, the article analyses rights-based social protection on the example of Poland. Although social security is a basic human right, half of the world population still has no access to any social protection. ILO is working a lot to improve this. International standards of ILO, Council of Europe and European Union (EU) play important role in the development of comprehensive and rights-based social protection systems around the world. However, mechanisms to enforce these rights need to be strengthened. After the political transformation in 1990s, Poland joined international organisations, including the Council of Europe, the EU, and adopted their considerable acquis. Poland is developing rights-based social protection, including the introduction of non-contributory schemes that provide protection where contributory schemes left a gap. Further challenges are to provide adequate protection for atypical forms of work and to ensure a minimum level of old-age security in the future.
    Nawiązując do rocznicy 100-lecia działalności Międzynarodowej Organizacji Pracy (ILO) oraz wychodząc od oceny obecnego stanu zabezpieczenia społecznego na świecie, artykuł analizuje ochronę socjalną opartą na prawach człowieka na przykładzie Polski. Chociaż zabezpieczenie społeczne jest podstawowym prawem człowieka, to nadal połowa ludności na świecie nie ma ochrony socjalnej. Międzynarodowa Organizacja Pracy robi wiele dla poprawy tego stanu rzeczy. Międzynarodowe standardy ILO, Rady Europy i Unii Europejskiej odgrywają istotną rolę w rozwoju kompleksowych i opartych na prawach człowieka systemów ochrony socjalnej na całym świecie. Konieczne jest jednak wzmocnienie mechanizmów egzekwowania tych praw. Po transformacji ustrojowej Polska wstąpiła do organizacji międzynarodowych, m.in. Rady Europy, Unii Europejskiej, dzięki czemu przyjęła ich znaczny dorobek prawny. Polska rozwija ochronę socjalną opartą na prawach człowieka, m.in. wprowadzając bezskładkowe świadczenia uzupełniające, zapewniające ochronę tam, gdzie systemy składkowe pozostawiają lukę. Dalszymi wyzwaniami jest zapewnienie adekwatnej ochrony nowym formom pracy oraz zapewnienie minimalnego poziomu świadczeń na starość.

Warto zatem przyjrzeć się perspektywie Brexitu z punktu widzenia koordynacji systemów zabezpieczenia społecznego w UE, w szczególności biorąc pod uwagę uprawnienia socjalne Polaków w Zjednoczonym Królestwie (a także uzupełniająco i porównawczo Brytyjczyków w Polsce). Celem opracowania jest syntetyczne przedstawienie obecnego stanu koordynacji pod tym właśnie kątem. Biorąc pod uwagę czas powstania tekstu, można stwierdzić, że rysuje się możliwość braku formalnego porozumienia w sprawie Brexitu między Unią Europejską a Zjednoczonym Królestwem. Choć taki rezultat negocjacji między stronami trzeba uznać za zdecydowanie negatywny, to jednak stosowne zmiany w prawie UE zostały już przygotowane do wejścia w życie, zaś gwarancje dotyczące omawianych praw zostały formalnie przedstawione. Zakres i sposób ich faktycznego wprowadzenia w życie zależeć będą jednak od rozstrzygnięć politycznych.
    Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union (Brexit) will defifi nitely bring various consequences in the field of social security. It is therefore worthwhile to analyse its current perspectives from the point of view of the co-ordination of social security in the EU, taking into account in particular the situation of Poles residing in the United Kingdom (as well as, in a comparative and auxiliary manner, of the British residing in Poland) and of their social rights. Therefore, the article synthetically presents the current state of the EU co-ordination of social security systems in this context, focusing on the examples given above. It has been written at a time, when the prospect of a no-deal Brexit starts looming as a distinct possibility. Even though such a lack of agreement between the parties in question might bring adverse consequences for the said rights, appropriate legal changes (in particular to the EU law) have already been prepared to enter into force, and guarantees of preservation of the rights in question have already been formally put forward. Nevertheless, their scope and practical implementation is still dependent on further political decisions.
