The author benefitted from the support of the private security sector as the Chief Officer of the City Police. When, after leaving the service, he was the President of the Polish Association of Employers Protection Branch “Małopolska”, one of the basic objectives of his activity was to ensure a high level of functioning of the private security sector as an important component of public security. Optimisation of the use of private security companies to ensure public security and order is one of the basic directions of his practical operation and research conducted by him. In the article, the author discusses the role of the private security sector and the tasks set for this sector. The genesis of security companies, their evolution and development in various countries of Europe and the world is covered. Much attention is devoted to the de-monopolisation of security in Poland, in which the security companies played a special role. The author outlines the most important objectives of private sector development in Poland as a specific type of economic activity. The basic concepts related to the functioning of security companies are explained, exposing their priority task, which is the protection of facilities, areas and equipment important for the functioning of the state. The author shows that the current level of terrorist threats implies the need for greater involvement of security companies in providing security to facilities constituting the critical infrastructure of the state. The role of specialist armed security formations in this area is highlighted. In the conducted research process, a positive answer to the main question is given, demonstrating that security companies are currently an important element of the public security system in Poland, and their use in this area should be constantly strengthened.

The considerations presented in this article are based on several assumptions. First of all, the human environment and the set of its elements are constantly changing. In the early periods of evolution and development of humanity, man lived in conditions given by nature itself, no different than in natural conditions. However, even then, he was also exposed to threats, mainly natural, including disasters. Secondly, with the passage of time and development there was a very large population increase, which caused changes in quite primitive interpersonal and social relations. More and more organized communities, states began to emerge. With this development, new threats also appeared. In addition to the natural threats, which were already natural by their very name, the threats of a social nature began to emerge from the natural world around us, characterized by continuous and dynamic changes. Thirdly, man, who wanted to effectively deal with the problems of the threats he faced, created safety systems. One of them is the public security system. Fourthly, in today’s security environment there is a paradox that in practice these systems function, and in theory there is no commonly accepted definition of public security. The circumstances outlined above determined the shape of this article, the essence of which was to work out a compromise definition of public security based on the interpretation of this concept by recognized authorities in the field of law, administration and security.

The paper shows the crucial elements of the Japanese spirit of law and security culture. Since the 1950s, the USA and European countries have witnessed global expansion and huge popularity of the phenomenon of Budō (Far-Eastern martial arts). The rules and traditions of martial arts favorably influence the field of security culture. For instance, The Seventeen-Article Constitution proposed ethical principles whose purpose was to ensure the security of the state and its residents. This document, coined by prince Shōtoku in 604, was based on both Confucianist and Buddhist teachings, which by that time were well rooted in Japan. The Constitution included a principle stating that each person was part of a group, and should live in harmony with other members of the society. Most importantly, the documents instructed that morality should precede law. This notion is very close to the idea of natural law that should be the basis for statutory law. The Articles are also considered to be the first Japanese constitution.

The article deals with the problem of national security in the contemporary world which is greatly influenced by the process of globalization and digitalization. The paper highlights the role of national security in modern state building. The following issue has been of great interest to many outstanding scientists worldwide especially since the beginning of the XXI century. However, the subject matter of national security in the system of public administration has not been clearly defined yet. Therefore, the paper analyzes the approaches to define national security and points out its distinctive features. Moreover, it emphasizes the fact that at the level of national, regional and global relations the concept of national security is often associated with security strategies. Thus, the article puts emphasis on the predominant characteristics that help to distinguish between these two concepts. In addition, the research clarifies the characteristic features of national security as well as state security. Security, like many other categories of social sciences, does not have a conclusive definition. What is more, the category of security has an interdisciplinary significance. Therefore, scientists define it in accordance with the subject matter and the specifics of cognition and research. Nevertheless, many outstanding scholars view security as an anthropocentric category related to man’s socialessence and value. Accordingly, security presupposes having freedom from the risk, danger and the threat of change to the worse. Most scientists agree that security is a constituent of every aspect of human life. Consequently, security issues consideration is of great significance. All in all, nowadays it is greatly important to achieve a state of security as our globalized society frequently leads to different challenges and dangers. The results of the research contribute to better understanding of the issue and make it possible to introduce effective mechanisms of public administration in the field of national security.

The article aims to show the selected challenges and pathologies that affect the private security agencies in Poland. The author first indicates problems related to the legal regulations concerning the protection of persons and property, the most important of which concerns the amendment of the acts regulating the performance of some professions; then he briefly defines the organizational problems of most companies in the security sector, pointing out that the entrepreneurs in the private security sector often have no idea how to develop their own companies, have great difficulties with adapting to the changing market of the security services, do not keep up with the innovations, which all lead to offering their customers the solutions that are already outdated. This article also describes significant problems related to the market trends, with the indication of the growing costs of the remuneration of employees in this sector and the use of various forms of employment and the irregularities related to it. Finally, some of the most important problems are listed as the pathologies of the entire industry. This leads to the conclusion that the private security agencies in Poland are an incredibly significant element of the functioning of the security system, which without significant legislative changes will not fully function as intended and in accordance with its function. The presented results prove that the research on the functioning of the security agencies should be carried out on a continuous basis due to their direct impact on the internal security of the country.

The author of this article hope to show the essential meaning of the Japanese perspective on law, order and security. Since the 1950s in the USA and European countries we have been witnessing the global expansion and popularity of Budō (Far- Eastern martial arts). Those martial arts positively influence the improvement of security culture. The authors want to show that it is worthwhile to study the achievements of Japanese culture, not only because of their different characteristics, but mainly because they emphasize honor and tradition, which are the specificities of uniformed and public services. The purpose of the creation of “The Seventeen-Article Constitution” was the implementation of ethical principles, which would ensure the security of the state and its residents. This document was based not only on Buddhism, already firmly rooted in Japan, but also on Confucianism. In this work we read that “the Constitution” included the principle stating that each person is part of a particular group, and should live in harmony with other members. Thus, it means to show respect toward all people and to rid oneself of negative thoughts, emotions and actions. “The Seventeen-Article Constitution” also includes the foundations of central management. Moreover, it is considered to be the initial Constitution of Japan.

The human and social security paradigm has been developed and shaped at different levels in various countries and political regions as a result of their diverse development of civilisation. Security in all spheres of social life has become a paradigm of the present and the future and, following its creation, has caused mental changes in the human value system. The system of values developed at universities, in terms of peaceful coexistence, tolerance, respect for the canons of law, and environmental protection, is becoming an interpretation of the quality of human life. This means that universities, regardless of their educational and scientific research profiles, are actively involved in building security in their micro- and macro-environment in the short and long term. The social responsibility of universities to shape a safe environment consists in including the following in the content of education and in the system of values of graduates: human rights, assumptions of humanitarianism, ethics, tolerance, environmental protection, respect for the law, shaping pro-social attitudes, and many others arising from the challenges of the present and future.

Public security, a state constituting a normative subject, is defined by numerous acts dedicated to regulating areas that require specific measures aimed at assuring it. The public order defined in such a way determines public security. Nevertheless this simple dependence is insufficient as regards the normative formulation of public security. It is identified as an expression pointing at public tasks of administrative bodies as a legal criterion for the operation of such a body or as competence of the body. The present paper presents contexts of its usage in diverse normative acts, considered as separate legal departments. Such a broad review has been carried out by classifying them depending on categorisation to the political, process and material laws. A separate discussion has been made of public security as a structure that does not occur directly in the basic law, yet has its reference in it. The presented material enables making a differentiation of the concept of public security in normative acts, depending on the context of its formulation.
Bezpieczeństwo publiczne jest stanem będących przedmiotem normatywnym, określanym przez wiele aktów regulujących obszary wymagające szczególnego zachowania w celu jego zapewnienia. Tak określony porządek publiczny determinuje bezpieczeństwo publiczne. Ta prosta zależność jest jednak niewystarczająca w kontekście normatywnego ujęcia bezpieczeństwa publicznego. Jest ono określane jako wyrażenie wskazujące na zadanie publiczne organów administracji, jako kryterium prawne działania organu czy jako kompetencja organu. W niniejszy artykule zostały przedstawione konteksty jego użycia w rożnych aktach normatywnych, zaliczanych do oddzielnych gałęzi prawa. Tak szerokiego jego obrazowania dokonano, systematyzując je w zależności od przynależności do prawa ustrojowego, procesowego i materialnego. Odrębnie zostało omówione bezpieczeństwo publiczne jako konstrukcja niewystępująca wprost w ustawie zasadniczej, mająca jednak w niej swoje odniesienie. Przedstawiony materiał pozwala ocenić zróżnicowanie użycia w aktach normatywnych pojęcia bezpieczeństwa publicznego, zależne od kontekstu jego ujęcia.

This article presents the basics of the security system in Poland after the political transformation in the late 80’s/early 90’s. The development of personal and property security gained momentum in the 90’s. After the political change, the lack of adequate regulations for the operation of security companies required the introduction of legal regulations that systematized the creation and operation of security companies as well as the requirements for people working in organizations. In Poland, the private security services sector emerged at the end of the 1980s. The first concessions for performing services in this area were issued after 1 January 1989 on the basis of the law on economic activity. Until the entry into force of the law on the protection of persons and property, the private security sector operated, inter alia, on the basis of the provisions of the aforementioned law on economic activity and the criminal code.1 Due to the changes occurring both in the law and in terms of changing hazards, the regulations did not correspond to the new socio-economic reality of the 1990s. As a result, on 22 August 1997, the lower house of parliament of the Republic of Poland passed an act on the protection of persons and property. The ‘privatisation of security’ is, one of the means for improving public safety. The private security sector contributes significantly to improving security, but only if appropriate legislative solutions are in place and proper control is exercised over the activities of this sector.
