After the russian Federation began its aggression against Ukraine in 2022, the Ukrainian critical infrastructure system was attacked with the aim of its complete or partial destruction. In response to these attacks, the Ukrainian authorities announced the reconstruction of the infrastructure protection system based on eU legal solutions. therefore, the article discusses the issues of critical infrastructure, both at the european and Polish level. the provisions of 2007 are in force in the Polish legal system, and the 2008 directive – in the european legal system. however, legal provisions were amended in 2022 and will be implemented into national legal systems in 2024. the aim of the article was to analyze the content of the provisions of legal acts in the field of critical infrastructure in Poland and the eU. the analysis is accompanied by research questions regarding how to define basic concepts and terms in both legal systems and the mutual relations of both systems. the article refers to the document examination method that allows for the analysis of legal acts and comparative analysis. eU Member States have gained a superior position over european bodies, but growing natural and anthropological threats and the process of deepening european political integration have resulted in a gradual change in the way of thinking about critical infrastructure. the position of EU bodies under 2022 directive has been significantly strengthened vis-à-vis member states.
Po rozpoczęciu przez Federację Rosyjską agresji na Ukrainę w 2022 r. zaatakowano ukraiński system infrastruktury krytycznej w celu jego całkowitego lub częściowego zniszczenia. W odpowiedzi na te ataki władze ukraińskie zapowiedziały odbudowę systemu ochrony infrastruktury na podstawie rozwiązań prawnych Unii europejskiej. W artykule omówiono zagadnienia infrastruktury krytycznej, zarówno na płaszczyźnie europejskiej, jak i polskiej. W polskim systemie prawnym obowiązują przepisy z 2007 r., natomiast w europejskim – dyrektywa z 2008 r., niemniej jednak w 2022 r. dokonano zmiany przepisów prawnych, które zostaną implementowane do krajowych systemów prawnych w 2024 r. W tekście jako cel przyjęto dokonanie analizy treści przepisów aktów prawnych w zakresie infrastruktury krytycznej w Polsce oraz w Unii europejskiej. Analizie towarzyszą pytania badawcze dotyczące sposobu definiowania podstawowych pojęć i terminów w obu systemach prawnych oraz wzajemnych relacji obu systemów. Nawiązano do metody badania dokumentów pozwalającej na dokonanie analizy aktów prawnych oraz przeprowadzenie analizy porównawczej. Państwa członkowskie uzyskały pozycję nadrzędną wobec organów europejskich, jednak rosnące zagrożenia naturalne i antropologiczne oraz proces pogłębiania europejskiej integracji politycznej wpłynęły na stopniową zmianę sposobu myślenia o infrastrukturze krytycznej. Pozycja organów Unii europejskiej na podstawie dyrektywy z 2022 r. została zdecydowanie wzmocniona wobec państw członkowskich.

Critical infrastructure is a key element of the functional security of any country. Sea ports (but also river ports) are part of the CI system of the country. The security of such sites is particularly important for the continuity of supply and transit of goods transported by vessels. Ports have always been protected from potential threats. Today, these threats have become more real, particularly as a result of the Russian Federation’s attack on Ukraine. Poland, which today has the status of a frontier state, is a target of espionage and sabotage activities. Security is a state of non-threat. This is the state to which we aspire in every area of modern life of every society, every country. Seaports, like other places, which are essential (special) for the unimpeded and secure delivery of goods. They’ve always been under special surveillance and special protection. Destruction of the port makes it impossible to transport by sea, which is obvious. Threats to port security come from different sources, but at a time of ongoing war in Ukraine, terrorist attacks come to the fore. It is also necessary to highlight the hybrid actions on the border with Belarus, which affect the state of security. Poland, as a front-line country, is particularly vulnerable to acts of terror, diversion and espionage, which is confirmed by the actions of the special services. Monitoring of seaports is part of the security strategy of the critical infrastructure of these places. The threat of CI ports is real, especially at the present time. This applies in particular to the LNG terminal in Świnoujście, which is regularly visited by ships (gas carriers) supplying raw materials of strategic importance. Violation of security rules (principles) may lead to a threat that cannot be ruled out, however, the most important and dangerous are those that come from the outside and are of an intentional nature.

Nowadays, humanity has become dependent on the devices and systems which form part of everyday life. This relation was made clear by the terrorist attacks in New York, Madrid and London. The attacks resulted not only in human casualties and damage to infrastructure, but also made people aware of the close relations between the damage and the effective operation of the rescuers. This gave rise to the need to face the problem of protecting the infrastructure which is important for the security of the state and its citizens. At the same time, the issue of threats to critical infrastructure has started to emerge more and more in the literature devoted to internal security and stopped being associated solely with military concepts. In Poland, the notion of ‘critical infrastructure’ first started to appear in government documents and literature in 2007 after the introduction of the Crisis Management Act. The legislator specifies in the document the conceptual range of critical infrastructure which is closely related to the functioning of facilities, devices, and installations relevant for the security of the state and citizens. The following systems were regarded as critical infrastructures: the energy and fuel, communications and ICT, transport, rescue, financial, food and water supply, and healthcare systems, and also the one related to chemical and radioactive substances. This paper is an attempt at characterising the defence of critical infrastructure in Poland and the possibilities of preventing threats to important state security systems in the context of the establishment of the Territorial Defence Force.

W artykule przedstawiono charakterystykę trzech obiektów infrastruktury krytycznej rafinerii w Gdańsku: rurociągu surowcowo-produktowego, instalacji rafinerii oraz bazy magazynowej. Opisano zagrożenia na jakie narażone są obiekty infrastruktury krytycznej. Wyszczególniono zarówno zagrożenia naturalne, takie jak: zagrożenia powodziowe, silny wiatr, upał i suszę, mróz i gołoledź, a także zagrożenia które wywołane są przez człowieka. Do tych ostatnich zaliczyć można terroryzm, zakłócenia porządku publicznego oraz zagrożenia techniczne. Główny nacisk położono na opisanie zagrożenia pożarowego, które z punktu widzenia autora jest zjawiskiem najgroźniejszym dla właściwego funkcjonowania obiektu infrastruktury krytycznej, a także mogącym spowodować niewyobrażalne straty w ludziach i mieniu.

In this paper we present current key challenges with respect to Critical Infrastructure Protection and to their resiliency. As our world becomes more and more interconnected via open networks with the cyberspace, many new challenges arise. Therefore, we frame the problem within three distinctive domains: real world natural events, human (organisational and legal), and cyber one. Within our analysis we present how current technologies, tools and methodologies can be used to address certain problems within those domains. Moreover, we stress the fact that there is a limited number of initiatives that aim at proposing the holistic (all hazard) approach addressing all the domains at once.

This paper analyses the concept of critical infrastructure (CI) in the context of electoral process organization. I will determine whether the seats of circuit electoral commissions (CECs) meet the relevant criteria. How can such facilities be effectively protected? What does international, European, and national law prescribe in this regard? I will examine doctrine and the provisions of the current legal system, including the documents of the National Electoral Commission (NEC). I adopt the statutory1 assumption whereby critical infrastructure should be understood as systems and their functionally interdependent facilities, including buildings, equipment, installations and services that are essential to the security of the state and its citizens, serving to ensure the proper functioning of public administration bodies, institutions and entrepreneurs. Critical infrastructure is comprised of systems which, for example, ensure the continuity of public administration.

Jednym z głównych zadań bezpieczeństwa wewnętrznego jest zagwarantowanie funkcjonalności systemom infrastruktury krytycznej. Ochrona infrastruktury krytycznej, tak istotna dla bezpieczeństwa państwa i jego obywateli, jest również najważniejszym zadaniem stawianym przed szefami administracji rządowej i samorządowej. W artykule przytoczono akty prawne dotyczące infrastruktury krytycznej, które poszerzono o ustalenia dokonane przez Najwyższą Izbę Kontroli w latach 2015−2016. Ponadto uwzględniono dorobek nauki i sporadyczne publikacje na ten temat.
The main task of internal security is to guarantee the functionality of critical infrastructure systems. The protection of critical infrastructure is important for the security of the state and its citizens, as well as the most important task for the heads of government and self-government administration. In the article, the author cites legal acts regarding critical infrastructure, as well as extends its considerations to findings made by the Supreme Audit Office in 2015-2016 on the protection of critical infrastructure in Poland. In addition, the author recognizes the achievements of science in this area and appreciates the occasional publication on this subject.

This paper explores the directions for the application of unmanned aerial vehicles in the provision of security to vital elements of a country’s critical infrastructure. The analysis focuses on two paths of development: the first one refers to the transportation system, the latter is related to the gas supply network – the basic components of a country’s critical infrastructure. The first section of this paper will examine the current state of knowledge in the field, and is designed as a reference of terminology pertaining to unmanned aerial vehicles (definitions and classification). The section shall furthermore provide a basis for and a contribution to the developed conceptual-semantic framework for UAV research. The first direction of development is described in terms of the characteristics and assumptions of the system; this includes an overview of the specific requirements of the unmanned platform itself, as well as the elements of the system, such as a local monitoring centre and other components. Furthermore, this section provides the overview of the designated mobile application, whose development is expected to improve the efficiency of system operation, which is a conceptual novelty considering similar developments. The second direction concerns the development of an unmanned system of production, storage, and use of chemical and radioactive substances, including pipelines for hazardous substances. The programme that fits perfectly in the framework of the second considered branch of development is “Cricket” [Polish: “Świerszcz”] – a programme implemented in the periodic inspection of gas supply infrastructure. The description of the programme in question included specifying the technical and operational requirements for the fight devices as well as for the equipment.

W artykule przedstawiono interpretacje pojęcia infrastruktura krytyczna i jej autorską definicję. Wyjaśniono uwarunkowania bezpieczeństwa infrastruktury krytycznej i wskazano na kluczowe elementy decydujące o jej bezpieczeństwie.
The notions of infrastructure and critical infrastructure in particular are ambiguous and in most cases do not take into account the consequences of threats. The aim of the article was to present the results of research on evaluation of critical infrastructure security theory. The article presents interpretations of the notion critical infrastructure and its author's definition. It clarifies the security determinants of critical infrastructure and points to the key elements determining its security.

One of the main tasks of internal security is to guarantee the functionality of the critical infrastructure systems. The protection of critical infrastructure, so important for the security of the state and its citizens, is also the most important task for the heads of government and local government administration. Access to this type of services becomes a key issue from the point of view of the efficient functioning and development of a modern state, society and economy. These services and the infrastructure that provides them have been referred to as critical infrastructure. As a result of events caused by natural or human activities, critical infrastructure may be destroyed or damaged. The consequence may be a threat to the continuity of key services, and thus the property, health or even life of citizens. Taking into account also the fact that such incidents negatively affect the economic development of the state, it should be stated that the critical infrastructure plays a key role in the functioning of the state and the life of its citizens, and its protection is one of the priorities for the Polish state. Critical infrastructure protection is a process that covers a large number of task areas and competences, and involves many stakeholders. This process includes all activities aimed at ensuring functionality and continuity of activities an integrity of the critical infrastructure, it also assumes a gradual achievement of the expected result and continuous improvement.

Ostatnich kilka lat przyniosło wiele zmian w kształcie sektora energetycznego w Polsce. Dywersyfikacja kierunków i źródeł energii jest od dawna elementem polityki bezpieczeństwa energetyczno-ekologicznego nie tyko Polski, ale i całej Unii Europejskiej. Pozostaje pytanie, jak Polska radzi sobie z dostosowaniem rynku energii do polityki nisko- lub zeroemisyjności UE, z ograniczeniem dostaw surowców z Rosji i z rosnącymi cenami surowców. Sytuacja kryzysowa może przerodzić się w sukces przedsiębiorstwa (w tym przypadku – państwa), jeżeli działania zostaną podjęte w sposób szybki, efektywny i uwzględniający perspektywę czasową, zarówno krótko- jak i długoterminową. Drugi element to zasobność państwa w zaplecze surowcowe, podmiotowe (relacje na poziomie lokalnym, regionalnym, krajowym i międzynarodowym) oraz sprawnie funkcjonujący mechanizm i struktura, która umiejętnie rozdziela zadania. Skonkretyzowanie zadań i rozdzielenie odpowiedzialności pozwalają na weryfikację działań i ich skrupulatną ocenę. Nie można pomijać też tzw. czynników okolicznościowych, które stanowią elementy składowe zaistniałej sytuacji i dają jej pełny obraz (kryzys z dominacją czynników wewnętrznych lub zewnętrznych).
The last few years have brought many changes to the shape of the energy sector in Poland. Diversification of directions and sources of energy has long had its place in the policy of energy and ecological security not only in Poland, but also in the European Union. The question is how Poland coped with adapting the energy market to the EU’s low- or zero-emission policy, how it coped with the reduction of supplies of raw materials from Russia, how it coped with the rising prices of raw materials. A crisis situation can turn into a success for an enterprise (in this case, the state) if actions are taken in a quick, effective and time-sensitive manner, both in the short and long term. The second element is the state’s wealth in raw materials, subjective resources (relations at the local, regional, national and international level) as well as an efficiently functioning mechanism and structure that skillfully distributes tasks. Specifying tasks and separating responsibilities allows for verification of activities and meticulous evaluation of them. Also the so-called circumstantial factors cannot be omitted, that constitute the components of the existing situation and give a full picture of it (crisis dominated by internal or external factors).

Opis:
In recent years we have been observing a new approach of the European Union to security threats, including the terrorist ones. In this case, it consists primarily in rejecting the division into physical and cyber threats, recognizing the role of private entities in preventive actions and noticing the problem of radicalization. The issue of data protection is also important, for example in the context of individual freedom. Finally, it is no longer possible to remain indifferent to the relations between terrorists and organized crime groups, or threats inspired by third countries. The conflict in Ukraine shows that the destruction of critical infrastructure is much more dangerous for the lives of entire societies than bombings or attacks by individual terrorists. These and other issues are reflected in the EU legislation. However, the topic is so extensive that it requires elaboration in several parts.
W ostatnich latach obserwujemy nowe podejście Unii Europejskiej wobec zagrożeń bezpieczeństwa, w tym zagrożeń terrorystycznych. Polega ono w tym wypadku przede wszystkim na odrzuceniu podziału na zagrożenia fizyczne i cybernetyczne, uznaniu roli podmiotów prywatnych w działaniach prewencyjnych oraz dostrzeżeniu w większym wymiarze problemu radykalizacji. Nie bez znaczenia jest także problematyka ochrony danych, chociażby w kontekście wolności jednostki. Wreszcie – nie można już pozostać obojętnym na związki terrorystów z przestępczością zorganizowaną czy zagrożenia płynące z inspiracji państw trzecich. Wojna w Ukrainie pokazuje, że niszczenie infrastruktury krytycznej jest znacznie bardziej niebezpieczne dla życia całych społeczeństw niż zamachy bombowe czy ataki indywidualnych terrorystów. Te i inne kwestie znajdują swoje odbicie w legislacji unijnej. Tematyka jest jednak na tyle rozległa, że wymaga omówienia w kilku częściach.

In connection with the entry into force of the Anti-terrorism Act, administrators of many production facilities are required to prepare a number of anti-terrorism procedures called anti-terrorist/AT attachment (Security plan related to facilities and equipment subject to mandatory protection in respect of terrorist threats). The article is a case study of the AT attachment implementation in several production plants belonging to one enterprise. It characterizes the strategy adopted in this company and the solutions developed in 2017-2019 in several production plants. The purpose of the article is to show why the implementation of this procedure is a challenge for the company.
