    Jedną ze sfer, w ramach których administracja publiczna wykonuje swoje zadania jest bezpieczeństwo. Do katalogu organów administracji publicznej, wyposażonych w środki oddziałujące na bezpieczeństwo i z nim związane – porządek publiczny, ochrona życia i zdrowia, należy również wojewoda. Podejmuje on działania w zakresie przeciwdziałania sytuacjom nadzwyczajnym, ich zwalczania oraz usuwania skutków, które w związku z nimi zaistniały. Ze względu na konieczność dostosowania działań ochronnych do zagrożenia oraz potrzebę ich harmonizacji, wojewoda może również, w przypadkach ustawowo przewidzianych, podejmować czynności kierownicze i koordynacyjne na obszarze regionu. Jest on organem, który posiada szerokie kompetencje pozwalające mu kształtować terenowy system bezpieczeństwa na poziomie wojewódzkim.
    One of the fields in which public administration performs its task is security. The voivodeship governor is a part of public administration as they are equipped with security measures related to public order and the protection of life and health. They undertake actions to prevent, control and deal with extraordinary situations and their consequences. Due to the need to adapt protective measures to the threat and the need to harmonize them, in cases provided by the law, the governor may also undertake managing and coordinating activities in the area of the region. It is a body that has broad competencies to shape the field safety system at the voivodeship level.

    The subject matter addressed in this article concerns inspection procedures intended to ensure mass-event security. Such inspections are conducted by the executive bodies of a commune or by a Province Governor. The inspection powers include an assessment of the compliance of the running of the mass event (including a higher-risk mass event) with the conditions specified in the permit to hold the event, and – if these conditions are found to be violated by the organisers – the discontinuation of the event. The inspection may also result in issuing a decision prohibiting the organisation of the mass event if, after issuing the initial permit, it is found that there has been a breach of the security conditions which constituted the grounds for its issuing. In addition, the Province Governor may prohibit the organisers from conducting a mass event with public participation or from conducting the mass event on the territory of the Province or its part, or discontinue the mass event while in progress.

    Opis:
    Threats in water areas have forced the legislator to address the issues related to the safety of people staying in these areas, who are required to exercise due diligence in order to protect the life and health of themselves and others. Due diligence is a fundamental factor in providing security. Along with diligence, to perform water rescue it was appropriate to conduct an analysis of threats, including an identification of the places where the safety of people using water areas for swimming, bathing, practising water sports, and recreation, could be endangered. The analysis was conducted by entities who are professionals in the field of water security, i.e. the Police and the bodies authorised to perform water rescue.
    Zagrożenia występujące na obszarach wodnych zmusiły ustawodawcę do uregulowania kwestii dotyczących bezpieczeństwa osób przebywających na tych obszarach, które to osoby są zobowiązane do zachowania należytej staranności w celu ochrony życia i zdrowia własnego oraz innych osób. Należyta staranność będzie zatem podstawowym czynnikiem pozwalającym na zapewnienie bezpieczeństwa. Obok tej staranności ważna jest analiza zagrożeń, w tym identyfikacja miejsc, w których występuje zagrożenie dla bezpieczeństwa osób wykorzystujących obszar wodny do pływania, kąpania się, uprawiania sportu wodnego lub rekreacji, której dokonują podmioty zajmujące się profesjonalnie bezpieczeństwem wodnym, zatem Policja oraz podmioty uprawnione do wykonywania ratownictwa wodnego.

    The paper addresses problems of the position of the local government of the commune level in the space of security and public order. The commune pursues tasks in this area besides other public tasks and ensuring security and public order falls within the category of fundamental tasks, the fulfilment of which requires considerable effort, including financial effort. The commune as a basic unit of local government is to respond to threats most immediately and neutralise them with its own resources and means, or if this is not possible, to prevent them from spreading. This is the main objective of the commune to be pursued in this area of running public administration.
    W artykule podjęto problematykę dotyczącą miejsca samorządu gminnego w przestrzeni bezpieczeństwa i porządku publicznego. Gmina wykonuje zadania w tym zakresie obok innych zadań publicznych, przy czym zapewnienie bezpieczeństwa i porządku publicznego należy do zadań podstawowych, których realizacja wymaga znacznego zaangażowania, w tym znacznych nakładów finansowych. Gmina jako podstawowa jednostka samorządu terytorialnego najszybciej ma reagować na zagrożenie i za pośrednictwem posiadanych sił i środków ma je neutralizować bądź – jeżeli nie jest to możliwe – powstrzymać jego rozprzestrzenianie się. Jest to główny cel gminy, jaki ma być realizowany w powyższym obszarze wykonywania administracji publicznej.

    Security is a very important human need, which is addressed at all levels of local governance both by the central and local government bodies. As regards local government, the scope of tasks involving the provision of security on the local and regional levels has been adjusted to the capabilities (including financial) of individual local government units. Basic tasks are carried out at the municipal district level, supra-municipal tasks — at the county level, and regional tasks — at the provincial level, except that in the province there is a dualism of administration, meaning that administrative authority is shared between a central government-appointed governor, called the provincial governor, and an elected assembly called the regional council. In the case of the county, security-related tasks, as well as the competences relevant to this area, must be clearly defined in the act. At this level of public administration there is no presumption of competence for the benefit of the county authority. The county council performs the public tasks of a supra-municipal character set out by statute rather than the tasks not reserved for other entities. In order to ensure public order and safety of citizens, as well as fire and flood protection, the legislator authorises the county council to use technical means to record what is happening (CCTV cameras) in the area of public space, with the consent of the area manager or an entity holding a legal title to this area, or on the property and in civil structures constituting the property of the county or organisational units of the county, as well as in the area around such premises and structures, if it is necessary to ensure public order and the safety of citizens or provide fire and flood protection.
