The purpose of the considerations hereinunder is an attempt to define a new, legal status of State Attorney Office (State Representation Office) of the Republic of Poland (RP), constituting – in theory – the completion of the construct of State Treasury as an administrator of public property, combining modernity and tradition in the area of counseling and state representation in court (for the purpose of litigation). Against the background of the changes having been introduced, involving, in particular, extension of competences of State Attorney Office of RP, there appears a question if the model of state representation constructed in a centralized way – defined in trading as ‘model of traditional modernity’ will provide effective representation and protection of state property.

Art. 48 of the Constitution of the Russian Federation guarantees everyone the right to qualified legal assistance. The question of the means and methods it should be provided with has been debated between lawyers for a long time. A number of scientists talk about the need for legislative consolidation of the ‘advocate monopoly’. Others consider it appropriate to license the legal services market. These disputes remain relevant today. However, in 2019, Russia has undergone a reform of procedural law, which lawyers have called a ‘process revolution.’ Many rules of procedural codes have undergone major changes. In particular, as a result of the reform, the requirements for persons who may act as representatives in civil matters have been substantially changed. In the framework of this article, an attempt is made to analyse the reform of the institution of representation. Based on a systematic analysis of procedural legislation and law enforcement practice, the author comes to the conclusion that legislative consolidation of the need for higher legal education for representatives can be called one of the positive aspects of the reform. This article provides an analysis of the development trends of the institution of representation in the historical aspect. The author concludes that it is maintaining logical and consistent movement along the path of becoming an‘advocate monopoly’ in Russia. It seems that subject to its competent and phased introduction, as well as the reform of the corps of the bar itself, not only by increasing its number but above all by increasing the professionalism of its members, it can and should become an effective tool in the civil process.

The article studies the legal nature of the introduction of the lawyer’s monopoly in Ukraine. The author notes the introduction of the lawyer’s monopoly in Ukraine had to take four steps. However, at the last stage of the introduction of the lawyer’s monopoly, the legislator amended the procedural codes regulating the course of civil, commercial, and administrative proceedings. With these changes, the legislator expanded the concept “self-representation” by substituting the concept of “representation”. In addition, the legislator brought in a draftto revoke the lawyer’s monopoly which was approved by the Constitutional Court of Ukraine. The scientist states that the relevant strategy of abolishing the lawyer’s monopoly is not a positive phenomenon. The introduction of court representation of citizens, business entities, state bodies, central and local authorities by a professional institute of advocacy is an upside in reforming the Ukrainian legal system. However, according to the author, the profession of a lawyer is primarily aimed at providing defense in criminal proceedings or when bringing to administrative responsibility or considering a case of an administrative offense. At the same time, the scientist marks that the reversion to the previous wording of Article 131-2 of the Constitution of Ukraine is inadmissible since the provision of legal services in Ukraine should be carried out professionally. After analyzing the legislation of the Republic of Poland, the author has concluded that lawyers and legal advisers, who carry out practical legal activities on a professional basis and permits, provide the public with legal aid. However, the only difference between a lawyer and a legal adviser in the Republic of Poland is that the latter cannot provide legal assistance in criminal proceedings, unlike a lawyer. Therefore, to create a professional and competitive market of legal services in Ukraine, the researcher proposes to borrow the experience of the Republic of Poland and introduce a professional institute of legal advisers in Ukraine, as this profession is legally identified in Ukraine.

The subjective context and dimension of administrative law objectively generate a diverse and rich catalogue of causes and manifestations of its multifaceted nature. In this respect, further diversity can be observed, namely that of conditionings and consequences, its crucial aspect being the distinction into administering bodies and subjects of administration. The analysis of the multiform nature of legal-administrative entities can yield particularly interesting results when the participants of administration change their roles (including the role changes which, from the perspective of the distinction between administering bodies and subjects of administration – run across borders). The analysis confirms the importance of taking care of the systemic approach and unification of the doctrinal and normative approach to the question of the multifaceted character of legal-administrative entities.

En el presente artículo se efectúa un análisis de la situación jurídica de los pueblos indígenas en Venezuela. En los años 90., la llamada “década de los pueblos indígenas”, aparecieron nuevas formas legales e institucionales en cuanto a la representación y participación de las comunidades indígenas en el marco del funcionamiento de los órganos e instituciones estatales. En la República Bolivariana de Venezuela, los derechos de los pueblos indígenas, garantizados por la Constitución de 1999 y otras leyes promulgadas en los años 2001-2009, se basan en la definición de la nación multiétnica y multicultural. Así pues, está bien fundada la pregunta si la pertenencia a un grupo étnico du-rante la transformación sistémica puede convertirse en el capital político. Por lo tanto, se propone reflexionar sobre las soluciones jurídicas e institucionales así como también los dilemas que aparecen en relación con la representación y participación. Para conseguir los objetivos propuestos se analiza la posición de los pueblos indígenas sobre la base de las normas jurídicas de los años 1999-2009, el alcance y las formas de la representación política y participación de la población indígena en el proceso de la transformación sistémica. Propongo la tesis de que la participación de los pueblos indígenas venezolanos en la actividad del Estado y la co-responsabilidad para su funcionamiento, respetando la soberanía y autonomía de los indios, están con-dicionadas por la evolución del proyecto político del gobierno de Hugo Chávez.
This article analyzes the legal status of indigenous peoples in Venezuela. From the beginning of the 90's, the so-called “Decade of Indigenous Peoples”, new legal and institutional forms of representation and participation of indigenous population were created within the framework of state entities and institutions. In the Bolivarian Republic of Venezuela the rights guaranteed to indigenous peoples by the Constitution of 1999 and other laws promulgated in the years 2001-2009 are based on the definition of a multi-ethnic and multicultural nation. Thus, there arises a question whether belonging to an ethnic group has become political capital during the transformation of the political system. Therefore, the proposal is to reflect upon the implemented legal and institutional solutions as well as the dilemmas that arise in the area of representation and participation. In order to achieve the proposed goals the author analyzes the position of in-digenous peoples on the basis of the legal regulations from the years 1999-2009, as well as the scope and forms of political representation and participation of indigenous population in the process of the political system transformation. In my opinion the parti-cipation of Venezuelan indigenous peoples in the activity of the State and their co-responsibility for its functioning, as well as respecting sovereignty and autonomy of Native Americans, are conditioned by the evolution of the Hugo Chávez government's political project.

The Gloss endorses Supreme Court's judgment from 20 X 2011 r.,( IV KK 137/11), which relates to extent of duty to redress the damage caused by unlawful arrest and to that, if it is possible, in proceeding regulated by the 58th section of Code of Criminal Procedure, to obtain reimbursement of legal representation costs under Article 632§ 2 of the Code of Criminal Procedure. Glossator held’s that the Supreme Court has rightly held that the damage must also take into account monetary liabilities, which drew family wrongly detained person to cover the cost of living during imprisonment. Compensation should cover entire damage and redress entire moral injury, which were suffered by detainee. In determining the amount of both compensation and redress all the circumstances of the case should be considered. The applicant in proceedings for damages should receive reimbursement of legal representation cost.

Celem opracowania jest przedstawienie wybranych elementów procesu weryfikacji granic upoważnienia pełnomocnika występującego w sprawie cywilnej ze skargi nadzwyczajnej. W artykule szczególny akcent położony jest na ramy przedmiotowe pełnomocnictwa. Publikacja zawiera również omówienie instytucji przymusu adwokacko-radcowskiego obowiązującego w toku kontroli nadzwyczajnej oraz konsekwencji prawnych jego naruszenia. Przybliża też zagadnienia związane z pełnomocnictwem jako dokumentem. W artykule poruszona została jednocześnie kwestia dopuszczalności udzielenia w postępowaniu cywilnym pełnomocnictwa w formie pisemnej opatrzonego kwalifikowanym podpisem elektronicznym. Autorka, dzieląc się własnym doświadczeniem praktycznym, podjęła przy tym próbę przedstawienia najczęściej pojawiających się w toku kontroli nadzwyczajnej uchybień związanych z oceną należytego umocowania pełnomocnika.
The purpose of this study is to present selected aspects of the verification of the scope of attorney’s authorization to act in a civil case that is initiated through the extraordinary complaint (skarga nadzwyczajna). A special emphasis in the paper is put on the substantive framework of the power of attorney. The study also discusses the compulsory representation in the course of an extraordinary review (kontrola nadzwyczajna) and legal consequences of its violation. It displays issues related to the power of attorney in the form of a document. The article also addresses the admissibility of granting in civil proceedings the power of attorney in a written form with an electronic signature. Sharing her own practical experience, the author presents the most common deficiencies in the assessment of the proper authorization of an attorney that arise in the course of an extraordinary review.
