    This paper is a review of the book by Rémi Brague, titled The Law of God.A Philosophical History of the Alliance, in which he aims to analyze the concept of divine law, assuming „[...] that human activity is based on norms derived from a divine source.” The author analyses this concept historically and philosophically, and thus searches for its historical conditions and reasons for its existence. Focusing mainly on the Middle Ages, he undertakes a critique of modern times and the modern concept of law, according to which it is merely a convention. He stresses that in pre-modern times law was treated as objective, because it was given by God and was closely connected with religion. Such understanding of law was common in all traditions, the history of which the author is following, and it constitutes the very foundation of european culture. In spite of certain differences in interpreting the idea of law, resulting from differences in the doctrines of Judaism, Islam and Christianity, on the grounds of all of them law possesses divine features—as determined and revealed by God, eternal and inherent to the nature of being.

    Die richtige Analyse der Texte des hl. Thomas von Aquin zeigt, dass für ihm eine objektive und entfernende Norm der Handlungen des Menschen ratio divina. Entweder ist die nähere Norm ratio humana. Die Äussärungen des hl. Thomas über ratio im Sinne der Norm der objektiven Moralität in der Tradition des Thomismus eindeutiger nicht verstanden sind. Bewegte und sehr interessante Diskussion über dieses Thema unter die Thomisten im ersten Hälfe des 20.  Jahrhunderts fortgeführt worden ist. Die Kommentatoren der thomistischen Texte waren nicht einverständig im welchen Sinne die ratio als die nähere und objektive Norm der Moral verstehen soll. Die einigen von ihnen erachten, dass dieses Fachwort die rationelle Natur des Menschen bestimmt; die andere entweder, dass dictamen rationis den allgemeinen Urteil der Vernunft über den Wert der Handlungen im ganzen Umfang festsetzt; endlich die andere, dass ratio naturalis im Sinne der Stimme des Gewissens sein muss, die aus seine Natur etwas vereinzelt, individuell und praktisch ist. Die erste Möglichkeit verteidigen in ihren Abhandlungen E. Elter (†1955), O. Lottin (†1965) M. S. Gillet (†1951) und die andere. Für die zweite ausspricht L. Lehu (†1939) – erklärend, dass die Norm der Moral ein allgemeiner Urteil der Vernunft (dictamen rationis) sei. Für die dritte Möglichkeit entscheidet sich V. Cathrein (†1931). Seiner Ansicht nach die Norm der Moral auch ein Urteil der Vernunft sei aber nur als die Stimme des Gewissens. Allgemeiner sagend im Thomismus verhält man die dreieinige Verstanden ratio in Sinne der moralischen Norm: die entfernende und objektive Norm ist ratio Dei wie das ewige Gesetz; die objektive und nähere Norm ist ratio humana wie natura rationalis; die nähere und subjektive Norm ist ratio wie eine Stimme des Gewissens.

    The article, based on Karol Wojtyła’s texts from the years 1957-1978, discusses the context of the appearance of the terms “person” and “nature” and their significance. Next the article reflects on the morality of the human person and shows, in a very synthetic mode, the apparent conflict between the person and the natural law. This conflict is based on the foundation of the mistaken opposition of the person and nature. Finally, the article discusses the question of the integration of the person and nature. Text analysis of Wojtyla’s texts allows a  deeper understanding of how human nature and the law, which is depicted in the context of this nature, are means of the interpersonal dialogue of the Creator and the man.

    The purpose of our philosophical research is determination the starting point for attempts to understand the essence of God’s law and its relevance to the human way of life. We use for this purpose an analysis of selected writings of St. Thomas Aquinas. We present own selected aspects that constitute a philosophical interpretation of the law of God. We recognize the meaning and the significance, also the heart and the inside, as the primary concepts in the context of the essence of God’s law. We notice this primordiality in metaphisical aspect. We notions of cause, purpose and movement. Meaning is related to the appropriateness of existence and eternal regularity and order. It is rational order, the Logos. As a result, a person can read the meaning of one’s life and give it your decisions. The meaning as a source of law of God is entered in the human interior. This interior is a human heart. We understand it as the inner reality of human, especially in the intellectual and moral context. The biblical significance of the heart is associated primarily with concealment. What is unseen, involves what externalized, movement and action. Heart in the philosophy of St. Thomas Aquinas is the mind. We discuss the mutual relationship of mind, will and heart. We analyze the differences between the mind, understanding and intellect, which occur in the philosophy of Aquinas. Their common feature is rationality. The heart is what is reasonable. Rational aspect is the original. The will is also rational. Human finds the truth and the law of God not only in the external reality, but primarily in his interior.

    Artykuł jest próbą dokładniejszego zmapowania queerowo--rewolucyjnego potencjału teologii chrześcijańskiej, mającego podwójne źródła: historyczno-polityczne (antyimperialne korzenie chrześcijaństwa w sytuacji kolonialnej, generujące permanentną opozycję wobec imperialnych ideologii „wiecznego porządku”, cnoty i władzy, a także rozbudowane strategie parodystyczne) oraz religijno-imaginacyjne (teologia Wcielenia i Zmartwychwstania jako rewolucyjne dyskursy zwrócone przeciw całej antycznej tradycji metafizycznej, pracującej wokół „natury” i pozytywnych, determinujących porządków bytu / kosmosu, stabilizujących polityczneporządki imperialne, homonoia). Projekty chrześcijańskie okazały się zarazem „dewiacyjne” i „reapropriacyjne”: kryptopolityczny radykalizm chrześcijańskiej teologii Wcielenia i Zmartwychwstania wytworzył niesłychane napięcie, które prawie natychmiast rozładowywane było w ramach naturalizacji wyższego rzędu, ale napięcie to nie może zostać usunięte bez zniszczenia samych kontrimperialnych i antynaturalistycznych fundamentów tej teologii. Chrześcijańska erotyczna eschatologia „zbawiennych porażek” jako religijno--polityczna utopia nie ma nic wspólnego z „naturalnym porządkiem” oraz wspólnotą republikańskich / imperialnych podmiotów i ich cnót – dlatego polityczne ciała eklezjalne to ciała queerowe, niezdolne do bycia regularnymi organami„doskonałego ciała” jako wiecznego schēma.
    The article is an attempt to map more closely a queer revolutionary potential of Christian theology, which has two sources: historico-political (anti--imperial roots of Christianity in a colonial situation, generating a permanent opposition against the imperial ideologies of the „eternal order”, virtue and power, as well as some comprehensive parodistic strategies), and religio-imaginative (theology of Incarnation and Resurrection as revolutionary discourses set against the whole ancient metaphysical tradition working around the concept of „nature” and the positive, determining orders of being / universe, which stabilize the political imperial orders, homonoia). The Christian projects turned out to be both „deviant” and „reappriopriative”: crypto-political radicalism of Christian theology of Incarnation and Resurrection has produced an enormous tension being relieved by some naturalization of a higher order, but that tension cannot be erased without destroying the very anti-imperial and anti-naturalistic foundations of the theology. Christian erotic eschatology of the „saving failures” as a religio-political utopia has nothing to do with the „natural order” or community of republican / imperial subjects and their virtues, which is why the political, ecclesial bodies are the queer bodies, un able to be regular organs within the „perfect body” as an eternal schēma.

    Opis:
    The author presents considerations concerning morality criteria based on cultural and philosophical prepositions. Contemporary issues, in particular bioethical ones, make us pose the questions about the hierarchy of norms and, thus, the hierarchy of activities. This automatically leads to the question about the source (or sources) of law. The basis for these considerations is Antigone by Sophocles as a masterpiece with universal message. From the text analysis one can discover the issue of tradition and its role in social life principles determination. This leads to the question about the sources of law – are they transcendental or immanent? The author points out that Antigone uses the word „law” – „νόμος”, „νόμιμα” – only in relation to the divine laws. Creon’s regulations which oppose them are described as „φρόνημα”– inventions. In this way she acknowledges the supreme character of the transcendental norm. Rejection of the reference to the transcendental leads to „absolute contradiction” in the area of prepositions and attainments of legal objectives. This notion („absolute contradiction”) was used by Joseph Ratzinger in Benedict’s Europe in the cultures crisis. It can be said that this contradiction in the modern age comes from different ways of understanding the relationship between the transcendence and science, and, consequently, law by Galileo. Therefore, the premise of absolute autonomy creates „absolute contradiction”. The attempt to overcome this obstacle is respect for the so called „immanent transcendence”, which is expressed in the natural law. However, one must first acknowledge the existence of the objective truth and the possibility of knowing it and the norm which assesses the consistency of one’s action with those reference points. This norm is one’s conscience which has its autonomy in relation to legal norms that are not based on the natural law. Without that acknowledgement the only justification of law would be mere force. In our cultural situation Antigone’s question about the sources of law and its validity as well as how to save human dignity and love remains still pending.
