    Opis:
    A new act on maintaining the cleanliness and order in communes of 1 July, 2011, will become effective in Poland on 1 January, 2012. The act will come fully into force on 1 July, 2013. According to this act regulations, commune self-governments take over the obligations of the property owners concerning waste management, moreover, they become responsible for construction and maintenance of the infrastructure supporting recycling and waste disposal processes. The self-governments were granted a 1.5 year transition period to implement the act regulations.The introduced changes are an adjustment of Polish regulation to the European law. Only in Poland and Hungary local self-governments have not yet been responsible for management of waste generated in their areas.The article presents an analysis of the basic changes introduced by the act to the Polish system of municipal waste management. Presented are also the estimates of the mass of wastes collected on the territory of Poland with particular regard to the Małopolskie voivodeship. Calculations and forecasts were made on the basis of information collected by the Main Statistical Office (GUS) and commune offices, where systems similar to the one introduced by the act have been operating for several years. The act assumes that all citizens of Poland will be covered by a system of waste collection, but will also have to pay so called "garbage tax", which should translate into increased amount of collected wastes, especially in these communes where wastes collection system was faulty. In Małopolskie only in 30 communes the 100% of inhabitants have signed contracts for garbage disposal. In the communes where the modern municipal waste management system has been operating, the increase in the mass of collected wastes (for the first three years of system operation) ranged between 31% and 94% in relation to the mass collected in the year preceding the introduction of the new system, although over 90% of local inhabitants were covered by the previous system. As results from the analyses, after introducing the new act the amount of wastes collected in the Małopolskie voivodeship may increase from the level of 765,000 Mg (2010) to over 1.1 M Mg (1.4 M Mg according to less optimistic forecasts), assuming that all generated wastes will be collected (the same amount as in 2010). In some of the Małopolskie communes the estimated increase in collected municipal wastes may reach over 500%.

    This article attempts to evaluate the effects of the amendment to the Act on maintaining the cleanliness and order in Polish municipalities based on the reports of local governments of the following three voivodeships: the Lesser Poland (Malopolska), Opole and Silesia, in terms of the implementation of provincial waste management plans for the period 2011-2013. The chosen period of analysis includes the breakthrough between the rules of the Act on maintaining the cleanliness and order in municipalities prior to the amendment and after amending it to a large extent. This allows to assess the influence of the amendment on the attitudes of local governments concerning the problem of waste management and the effects of changing those attitudes according to the letter of the amended law.
    W artykule podjęto próbę oceny efektów nowelizacji ustawy o utrzymaniu czystości i porządku w polskich gminach na podstawie sprawo-zdania samorządów trzech województw: małopolskiego, opolskiego i śląskiego z realizacji wojewódzkich planów gospodarki odpadami za lata 2011-2013. Wybrany okres analizy obejmuje przełom pomiędzy rządami ustawy o utrzymaniu czystości i porządku w gminach w brzmieniu sprzed nowelizacji i tejże ustawy w dużym zakresie zmienionej. Daje to możliwość oceny wpływu nowelizacji na postawy samorządów w stosunku do problemu zarządzania gospodarką odpadami oraz efektów zmiany tych postaw, zgodnie z literą ustawy znowelizowanej.

    Celem artykułu była identyfikacja problemów gospodarki odpadami komunalnymi w Katowicach, które ujawniły się po wejściu w życie nowelizacji ustawy o utrzymaniu czystości i porządku w gminach. Wyłonione problemy dotyczą trzech grup odbiorców ustawy – gminy, jej mieszkańców oraz przedsiębiorstwa zajmującego się odbiorem i zagospodarowaniem odpadów. Identyfikacja głównych problemów pozwoliła na stworzenie podstaw teoretycznych do praktyk doskonalących, jakie powinny być uwzględnione w dalszych działaniach na rzecz poprawy funkcjonowania systemu gospodarki odpadami komunalnymi w Katowicach.
    The purpose of the article was to identify the problems of municipal waste management in Katowice, which emerged after the amendment to the Act on maintaining cleanliness and order in municipalities entered into force. Emerged problems concern three groups of recipients of the Act - residents, municipalities and businesses dealing with the collection and disposal of waste. Identification of the main problems has allowed to create the theoretical basis for the improvement actions that should be taken into account in further efforts to improve the functioning of the municipal waste management systems in Katowice.

    Artykuł przedstawia analizę bieżącego stanu systemu gospodarki odpadami komunalnymi w województwie śląskim. Badania obejmowały ocenę przygotowania technologicznego w ramach nowych przepisów, które zobowiązują gminę do opracowania i zarządzania systemem gospodarki odpadami komunalnymi. Efektem analiz jest wskazanie potrzeby ciągłego doskonalenia systemu, w tym selektywnej zbiórki jak również efektywnego wykorzystania dostępnych technologii i działań logistycznych pod kątem wzrostu odzysku i recyklingu odpadów komunalnych.
    The paper presents the results of the urban waste system analysis in the present moment in Silesia. The researches were encompassed consideration of technological preparation regarding to new regulations that obligate commune to logistic urban waste system elaboration and management. As a result of analysis is necessity for continuous improvement which involve selective collection and effective usage of available technology considering level of urban waste recycling.

    In 2013, the Polish legal system referring to municipal wastemanagement was restructured in a revolutionary way. The analysis of new provisions of law described in the article requires particular attention, taking into account their place in the entire system of dealing with waste and connections with the remaining elements of this system. The article discussed the process of road transport operation planning connected with municipal waste transport and the organization of mixed waste collection on the example of shipping routes analysis carried out by means of transport of a service company in Wałcz commune in West Pomeranian voivodeship. The article consists of seven parts, all of which present elements of a planning and transport process connected with municipal waste in road transport from legal, technical and economic perspective. Legal information concerning a road transport of goods was provided along with conditions that have to be met in order to perform this kind of transport and business activity. Moreover, technical and legal aspects of municipal waste transport vehicles were approached. At the level of Polish law, the goals and tasks concerned with dealing with waste were set forth, which leads to tightening of the system. All actions in this respect - from propagating the selective accumulation and collection of municipal waste, keeping the established levels of recycling and recycling of packaging wastes, and limiting the mass of biodegradable waste directed at the storage - is only a beginning of the road to reduction of environmental risks. In this case, permanent monitoring of proper waste dealing in the commune, the province as well as the entire country is essential. One of the crucial reasons of the system changes of waste management in our legal system in Poland was a need to implement solutions and mechanisms that are applied in the European Union. At the European Union law level, a Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives constitutes a basic legal document described in this part of the article. Achievement of these assumptions requires providing segregation at source and recycling of the main waste streams above all. The article covered as well the characteristics of: transport process, transport technologies, transport systems, the analysis of work capacity on the basis of drivers’ working time and a description of optimal routes for providing services in the commune taking into consideration a technological process of municipal waste transport step by step. The aim of the article is to present the rules of municipal waste: management, storage, segregation, keeping appropriate records of waste in municipal enterprises on the example of Altvater Piła Group Eneris.
    Obecnie ustawodawca wprowadził i zobowiązał gminy do organizowania gospodarki odpadami i zbierania od każdego właściciela nieruchomości. W związku z tym gminy są wyposażone w instrumenty prawne zgodne z ustawą z 2012 r., które umożliwiają im wykonywanie zadań. Spośród instrumentów szczególne znaczenie mają lokalne akty prawne, których celem jest określenie zasad zbierania odpadów w gminie. Mieszkańcy gminy mogą korzystać z administracyjnych instrumentów prawnych, a stosunek między gminą a przedsiębiorcą, który zbiera odpady, jest uregulowany (z uwzględnieniem osobowości cywilnoprawnej) umową o zbieraniu odpadów. Przepisy dotyczące gospodarki odpadami w Polsce obowiązują od kilku lat, jednak wciąż pojawiają się zagadnienia problematyczne pomiędzy gminą a spółką komunalną.
