Sądownictwo polubowne, często określane mianem arbitrażu, przedstawiane jest powszechnie w poglądach piśmiennictwa jako jedna z alternatywnych metod rozwiązywania sporów. Zastrzeżenia względem nieprawidłowości sądowego wymiaru sprawiedliwości oraz uzasadnione oczekiwania w zakresie redukcji czasu i kosztów postępowania gwarantują stronom realny dostęp do sądu i ochronę praw przez sporządzenie zapisu na sąd polubowny. W ramach wzajemnych relacji sądownictwa polubownego względem alternatywnych metod rozwiązywania sporów należy podkreślić, że arbitraż stanowi realną alternatywę dla wymiaru sprawiedliwości sprawowanego przez sądownictwo państwowe. Warto również wskazać na możliwości i potrzebę rozstrzygania sporów w ramach sądownictwa polubownego stanowiącego istotne uzupełnienie sądowego wymiaru sprawiedliwości. Odzwierciedlony w umowie arbitrażowej zgodny zamiar rozstrzygnięcia konfliktu oraz wyjątkowe możliwości partycypacji stron w prowadzonym postępowaniu arbitrażowym stanowią o nowej treści kultury i świadomości prawnej obywateli oraz kreowaniu nowoczesnych wzajemnych relacji stron szeroko rozumianych stosunków cywilnoprawnych. Zapis na sąd polubowny, realizacja postępowania arbitrażowego i rozstrzygnięcie sporu w ramach sądownictwa polubownego mogą i powinny stanowić nową jakość w zakresie wymierzania sprawiedliwości.
Arbitration judiciary, often referred to as arbitration, is commonly presented in the literature as one of the alternative methods of dispute resolution. The objections to the irregularities of the judicial state system and legitimate expectations in terms of reducing the time and costs of the proceedings guarantee the parties real access to court and protection of their rights by drawing up an arbitration clause. As part of the mutual relations of arbitration with respect to alternative dispute resolution methods, it should be emphasized that arbitration is a real alternative to the state justice administered by the common courts. It is also worth pointing to the possibilities and the need for disputes resolution by arbitration constituting as an important addition to the course of justice made by courts. The consistent intention to resolve the conflict reflected in the arbitration agreement and the exceptional opportunities for the parties to participate in the arbitration proceedings constitute a new content of the culture and legal awareness of citizens and the creation of modern mutual relations between the parties of broadly understood civil law relations. An arbitration clause, the implementation of arbitration proceedings and the resolution of a dispute within the framework of arbitration may and should therefore constitute a new quality in the administration of justice.

This paper examines some problems of educating people in alternative dispute resolution. The social, economic and political changes give rise to a greater level of conflict and inequality within any society that is undergoing transformation. We suggest that education in conflict management and resolution, and particularly with the respect to consensusbuilding techniques and collaborative interest-based approaches to conflict, can play an important role. Individuals who are used to alternative dispute resolution (ADR) better perceive their values and achieve their needs and are more active in decision making process. The better one can use consultation, negotiation and mediation the more society acquires the features of self-regulation and self-governance and the more efficient is counterweighing of social relations sharpened by modernization. Teaching and training the society in peaceful practice brings to people certitude that the best way of interacting with adversaries is to communicate and cooperate with them in solving problem which contradistinguished individuals or organisations. Modern conflict resolution development in Lithuania takes place in a wide legal, administrative, cultural and social environment. Actual conflict resolution curricula may be found in some university programs and postgraduate studies. The next stage will ensure the development of classes and programs in the fields of law, social psychology, political science, public administration, and sociology. Some corrections with elements of dispute resolution and peace education may be incorporated into the curricula of primary and secondary schools. Also certificate programs have to be designed for professionals solving commercial, social problems, dealing with extreme situations, and others, to meet their specific needs in conflict resolution skills. Long-term purposeful efforts while forming positive thinking, approach towards constructive activities and assertive behavior, that is the whole mental and cultural heritage, should be followed constantly in order to make negotiations, mediation and other alternative dispute resolution methods a part of public life and problem solution.

The presented article is aimed at reflecting usage of mediation as a form of international conflicts settlement and at revealing its factors, at the example of the case of conflict in Abkhazia, Georgia. The article is a hypothesis on to what extend international or regional organizations act as effective mediators during mediation process. Attempt of conflict regulation and work of the mediation platform created after Russian-Georgian war are discussed. The theory discussing main variables for evaluating international mediation represented in mediation literature have been used for evaluating mediation factors. The article shows the level of mediation effectiveness in international conflicts, when it is not clear which are the conflicting sides; it shows that when there is an influential country, considering its capabilities, it has enough power to act as effective mediator, only in case if it does not have direct interest in the conflict. We have concluded that mediation can be effective only when it is clear which the conflicting sides are. It is considered that international organizations cannot be effective in conflict resolution when a conflict is in cold phase.

Conflict-related and disputable situations have been present in our lives since ancient times, when people have become aware of the need to protect their rights and interests, sometimes at odds with the aspirations of others. The conflict that emerges between people disturbs their relationships and poses a threat to the proper functioning of people, bringing with them negative emotions. However, it can be an opportunity for development, be treated as a change in interpersonal relationships and can ultimately produce positive effects. Mediation offers a possibility of converting the negative aspects of the conflict into constructive solutions. Being voluntary, confidential, non-formal, out-of-court proceedings, it enables the parties to come to an agreement, offering them the opportunity to actively participate in shaping the legal and social situation and exercising their rights and interests in the spirit of consensus. In the mediation process, the parties use the support of a professional, impartial, neutral mediator. The authors of the article promote the idea of mediation with full conviction that it is a valuable and effective way for conflicted parties and third parties and their relatives to reach a consensus on various issues, including family matters.

Tekst prezentuje specyfikę nowej dla polskiego Kodeksu postępowania administracyjnego instytucji mediacji. Część drugą opracowania stanowi analiza z wykorzystaniem zaprojektowanych przez autora kategorii badawczych najważniejszych regulacji prawnych dotyczących mediacji zawartych w ustawie z dnia 7 kwietnia 2017 r. o zmianie ustawy Kodeks postępowania administracyjnego oraz niektórych innych ustaw, która z dniem 1 czerwca 2017 r. wprowadziła rzeczoną formę polubownego rozwiązywania sporów do krajowego porządku prawnego.
The article presents the specificity of a new mediation institution for the Polish Code of Administrative Procedure. The reflections in the first part focus on the presentation of the paradigmatic features of mediation in a wider context as one of the forms of Alternative Dispute Resolution (ADR). The second part is comprised of the author’s research categories, which analyze the most important mediation regulations contained in the Act of 7 April 2017 amending the Code of Administrative Procedure and some other acts, which on the 1st of June 2017 introduced this form of amicable disputes resolution to Polish legal regulations.

The article discusses an alternative way to settle a tax dispute through mediation. The object of the analysis of this paper is Qatari mediation. The role of facilitation as a tool of conflict management in Doha’s foreign policy as well as its modus operandi and the conditions for successful facilitation are the main issues examined here. In conclusion, it is revealed that mediation is only one tool of the Qatari foreign policy among many others. Moreover, the presence of the window of opportunity, the conflict parties’ inclusion and cohesion, and the acceptability of an intermediary are crucial for the successful conflict mediation. The use of reward power, the absence of the follow-up mechanism, the trained administrative staff of the foreign policy apparatus, and the war-weariness are the main obstacles for the transformations of Qatari conflict mediation into conflict resolution.

The article focuses on the novelties introduced by the Damages Directive in the field of consensual settlements of disputes concerning private enforcement. The Damages Directive obliges Member States to ensure that the limitation period for bringing an action for damages is suspended for the duration of any consensual dispute resolution process. The Directive also establishes the main principles that govern the effect of consensual settlements on subsequent actions for damages. Since the EU framework for consensual dispute resolution of private enforcement disputes is quite new, many issues must still be solved in Member States’ practice. While analysing consensual dispute resolution in private enforcement cases, particular interest should be paid to mediation and arbitration as a form of Alternative Dispute Resolution (ADR). Mediation is often used in competition law litigation. In a mediation process, parties are subject to fewer legal costs than in litigation and arbitration. It may thus be concluded that consensual dispute resolution is usually a faster way to receive compensation. However, voluntary arrangements and ADR in competition law still raise many problems concerning both procedural and substantial legal acts.

The article reports the results of a study conducted in the form of structured interviews. The goal of the study was to find out about the nature of this institution, the objectives of academic ombudsmen, the cases they deal with, their role in the academic community, in particular their role in resolving disputes at universities, and the type of methods they apply in their work. The institution of an academic ombudsman is considered to use an ADR method which is more appropriate in resolving problems and conflicts that appear at the universities, in comparison with formal procedures. The academic ombudsman takes into account important elements of the mission of universities which include respect for the other party, diversity, tolerance, and application of more inclusive and democratic methods in university governance. The introduction of ombudsman institutions at the universities is Poland is dictated not only by the necessity for more effective management and dispute resolution, but also shows a change in the attitude of the university administration towards the academic community. The need for research into the function of academic ombudsman arises from the relatively dynamic growth in the last three years in the number of academic ombudsmen as well as other institutions with similar names and goals. The emergence and significant increase in number of these institutions in the last few years at the universities in Poland raises the question of their nature and role at the universities.

In the era of progressive economic and trade cooperation at a national and international level, the number of disputes related to them is increasing. Statistics overviewing the activity of Polish courts dealing with proceedings in commercial cases confirm the fact. The development of alternative disputes resolution instruments, in particular regarding arbitration and mediation, gives rise to hope for remedying the situation. At the moment their scope is of little significance related to the entirety of legal transactions. Moreover, there are areas virtually devoid of them. The Podlaskie region is one of such areas. Recently, collaboration of the Chamber of Industry and Commerce in Bialystok and the Faculty of Law of University of Bialystok resulted in the launch of the Arbitration and Mediation Center of the Podlaskie region. As a part of the project, mediation services were commenced and further steps to launch the Eastern Court of Arbitration were taken. It seems that the undertaking can bring satisfactory results for socio-economic trading. The assumption will be possible to be verified in practice in the nearest future.

The article deals with the issue of asserting the rights and interests of all employees who enjoy the representation of trade union organisations in their disputes with the employer. The aim of the article is to give a detailed presentation of issues related to collective labour disputes. To achieve this aim, the stages at which the rights and interests underlying collective labour disputes are presented in detail. This study employs the dogmatic-legal method. The author carries out an analysis and interpretation of the provisions relating to collective labour disputes in the field of labour law. It was vital to examine the legal norms established by the legislator. A description and systematisation of the applicable legislation was also conducted. Issues relating to the resolution of collective disputes in the workplace are presented theoretically with a detailed discussion of the specific stages. This presented work is divided into four parts. The first presents the basic notions related to collective labour disputes. The sections that follow present the problems involved in the particular stages of claims enforcement based on employment relationship, i.e. bargaining, mediation, and arbitration. The rules for joining specific stages of resolving the above mentioned disputes were also discussed. To a large extent, the issues elucidated here bring the reader, and above all entities involved in collective labour conflicts, closer to the methods of asserting their own rights and interests.
