    Opis:
    The presented sentence of the Roman Rota, to which the author provides a comment, concerns nullitatis matrimonii, which was heard by the turnus c. Monier on the grounds of exclusion by the female defendant of the indissolubility of marriage and offspring. This sentence was passed by another instance, after obtaining by the male claimant nova proposition causae (in the first and third instance the sentence was negative, in the second instance it was positive); the defendant failed to attend all three instances. However, her testimony given in c. Monier instance, fully confirmed by the claimant and witnesses, unequivocally demonstrated that she simulated marriage consent – both in reference to bonum sacamenti and bonum prolis (the reason for both simulations were her beliefs concerning marriage and its procreative purpose, which deviated from the teaching of the Church). The sentence of the Roman Rota c. Monier is an example of an in-depth assessment of means of proof, which enabled to convincingly declare the nullity of marriage.

    Opis:
    Indissolubility is an essential attribute of marriage derived from God's law, and the exclusion of indissolubility renders the marriage null and void (can. 1101 § 2 CIC). In proving exclusio boni sacramenti, an extremely important role is played by the indication of the cause (motive) of the simulation act, including the further cause (causa remota). Although this reason is not directly related to a particular marriage, it – to some extent – influences the will of the spouse rejecting the attribute of indissolubility. When it comes to the reasons for the further exclusion of the indissolubility of marriage, three basic ones can be discerned in the most recent rotal jurisprudence: a mentality favoring the institution of divorce, the lack of sufficient religious formation and the special personality of contractors. The postulate of priests, during the canonical pre-wedding examination, to pay close attention to the convictions and views of the spouses regarding the indissolubility of marriage seems fully justified.

    Opracowanie jest kolejnym przyczynkiem do zgłębienia, w drodze analizy, merytorycznego bogactwa orzeczeń sędziów Roty Rzymskiej w sprawach o stwierdzenie nieważności małżeństwa z tytułu wykluczenia nierozerwalności. Stanowi próbę zebrania i przedłożenia wybranych zasad prawnych dotyczących okoliczności sprawy, które formułują członkowie zwyczajnego trybunału ustanowionego przez Biskupa Rzymskiego dla przyjmowania apelacji (kan. 1443 KPK/83). Poniższe uwagi dotyczące dowodzenia w sprawach o nieważność małżeństwa ob exclusionem boni sacramenti z uwzględnieniem, jak chce Jan Paweł II, „konkretnych uwarunkowań każdego poszczególnego związku”1, stanowią kontynuację rozważań zawartych w artykule pt. „Badanie okoliczności, które pomagają ustalić myślenie i wolę domniemanego symulanta w sprawach o nieważność małżeństwa ob exclusionem indissolubilitatis”
    The study is another contribution to exploring, through an analysis, the substantive wealth of judgments of the Roman Rota judges in cases for nullity of marriage due to the exclusion of indissolubility. It is an attempt to collect and present selected legal principles concerning the circumstances of the case, which are formulated by the members of the ordinary tribunal established by the Roman Pontiff for receiving an appeal (can. 1443 CIC/83). The following remarks on proving in cases of nullity of marriage ob exclusionem boni sacramenti, taking into account, as John Paul II wants, "specific conditions of each individual relationship", constitute a continuation of the considerations contained in the article entitled "Study of the circumstances that help to establish the thinking and will of the alleged simulator in cases of nullity of marriage ob exclusionem indissolubilitatis".

    Autor artykułu podejmuje problematykę dowodu szczególnego w sprawach o stwierdzenie nieważności małżeństwa wynikającego z wyłączenia nierozerwalności, czyli okoliczności.Zgodnie z powszechnym i trwałym orzecznictwem Roty Rzymskiej dokładne zbadanie i uwzględnienie wszystkich okoliczności sprawy, tj. okoliczności małżeństwa, osoby, miejsca i czasu, pozwala pośrednio ustalić rozumowanie i wolę rzekomego symulanta zgody małżeńskiej.Na podstawie analizy orzeczeń wydanych przez sędziów Roty Rzymskiej autor porusza następujące kwestie szczegółowe: konieczność zbadania wielu różnych okoliczności obiektywnych i subiektywnych, osobistych i materialnych, które pomagają ustalić, czy rzekomy symulant wykluczył nierozerwalność małżeństwa; okoliczności małżeństwa z przyczyną zawarcia małżeństwa i przyczyną symulacji jako pierwszą; okoliczności osoby, miejsca i czasu. Wreszcie, mając na uwadze orzecznictwo Roty Rzymskiej, o której znaczeniu wspomina kan. 19 Kodeksu Prawa Kanonicznego odnotowuje się okoliczności, które należy zbadać w konkretnych przypadkach. W tym przypadku autor odnosi się do okoliczności, które mogą sprzyjać przekształceniu w akt woli usposobienia przeciwstawnego nierozerwalności małżeństwa, o czym mowa w kan. 1101 § 2 Kodeksu Prawa Kanonicznego oraz okoliczności, które należy zbadać w przypadku hipotetycznego wyłączenia nierozerwalności małżeństwa.
    The author of the article addresses the issue of the special evidence in cases concerning declaration of nullity of marriage resulting from exclusion of indissolubility, which are circumstances.In accordance with the common and permanent jurisprudence of the Roman Rota, careful examination and consideration of all the circumstances of the case, i.e. the circumstances of marriage, person, place and time, allows to indirectly establish the thinking and will of the alleged simulator of marital consent.On the basis of the analysis of the judgments issued by judges of the Roman Rota, the author addresses the following specific issues: the need to examine many and different objective and subjective, personal and material circumstances that help to determine whether the alleged simulator has ruled out the indissolubility of marriage; the circumstances of marriage with the cause of entering into marriage, and the cause of the simulation as the prime one; circumstances of the person, place and time. Finally, bearing in mind the jurisprudence of the Roman Rota, the meaning of which is mentioned in can. 19 of the Code of Canon Law, circumstances to be examined in specific cases are noted.In this case, the author relates to circumstances that may favor the transformation of the disposition of the mind opposing the indissolubility of marriage into an act of will, as mentioned in can. 1101 § 2 of the Code of Canon Law, and the circumstances to be examined in the case of the hypothetical exclusion of the indissolubility of marriage.
