    Opis:
    The article focuses on the construction of public roads in Poland. In the introductory section the basic rules for financing such investments are discussed. It is highlighted that investment in road infrastructure is very expensive for the state budget and local government, even with financial support from the EU funds. In this context, public legal partnership (PPP) has become a very useful and cost-effective institution for carrying out public tasks. This article describes the possible partners of PPP and the legal nature of the related contract, highlighting the three main types of public-law partnerships that can be applied to the construction of public roads in Poland. The article concludes with recommendations regarding legislation governing the construction of public roads and public-private partnership.

    Opis:
    Strategic partnerships or public-private partnerships (hereinafter referred to as PPPs), as a model for long-term cooperation between the public and private sectors, are increasingly being applied in today’s unpredictable times due to the speed and efficiency of preparation as well as implementation of various projects. In local and regional activities where the public sector is confronted with various issues related to the implementation of domestic and EU projects, the PPP model is an example of how the private sector can be involved in addressing insurmountable challenges and activities with its rapid and smart adaptation. The aim of this paper is to explain the theoretical significance of the PPP model with particular emphasis on local and regional self-government, as well as to demonstrate its positive and negative aspects. The theoretical framework provides a clear definition of PPP or strategic partnership and explains its growing role and importance in Croatia. A concrete example of a PPP model of a local government and a Higher Education Institution from Zagreb is presented through the paper. The above example is presented as a model of strategic cooperation and shows how a more efficient and effective public service such as studying in one city can be obtained. The role and importance of such and similar projects is increasingly expressed precisely in the light of the needs of the local population, who are ultimately the ones creating the offer and demanding for their money the highest level of public services in their local communities.
    Strateško partnerstvo ili javno-privatno partnerstvo (u daljnjem tekstu: JPP) kao model dugoročne suradnje između javnoga i privatnog sektora sve više dobiva primjenu u današnjem nepredvidivom vremenu zbog brzine i učinkovitosti pripreme te provedbe raznih projekta. U lokalnim i regionalnim aktivnostima gdje se javni sektor suočava s raznom problematikom realizacije tuzemnih i EU projekta, model JPP je primjer kako se privatni sektor svojom brzom i vještom prilagodbom može uključiti u rješavanje nepremostivih izazova odnosno aktivnosti. Cilj ovoga rada je objasniti teorijski značaj modela JPP s posebnim naglaskom na lokalnu i regionalnu samoupravu te je svrha objasniti njegove pozitivne i negativne aspekte. Teorijski okvir rada daje isto tako jasnu definiciju JPP ili strateškog partnerstva te objašnjava njegovu sve veću ulogu i značaj u Hrvatskoj. Kroz rad je prikazan konkretan primjer modela JPP jedne lokalne samouprave i Visokoobrazovne institucije iz Zagreb. Navedeni primjer prikazan je kao model strateške suradnje te kako se može doći do učinkovitije i efikasnije javne usluge kao što je studiranje u jednom gradu. Uloga, važnost i značaj ovakvih i sličnih projekta sve je više izražena upravo u vidu potreba lokalnog stanovništva koji su u konačnici oni koji kreiraju ponudu te zahtijevaju za svoj novac najvišu razinu javnih usluga u svojim lokalnim sredinama.

    The aim of the article is to present the issue of a public-private partnerschip contract as a form of privatization of the performance of public tasks of a commune, considering the legal nature of this contract. Systemic trasformation intensified privatization processes in the economy including the economy of local government. The public private partnership agreement has become an important instrument for the implementation of public tasks.
    Celem artykułu jest przestawienie problematyki umowy o partnerstwie publiczno-prywatnym jako formy prywatyzacji wykonywania zadań publicznych gminy, ze szczególnym uwzględnieniem charakteru prawnego tej umowy. Transformacja ustrojowa nasiliła procesy prywatyzacyjne w gospodarce, w tym w gospodarce samorządu terytorialnego. Umowa o partnerstwie publiczno-prywatnym stała się ważnym instrumentem realizacji zadań publicznych.

    The article presents deliberations on the impact of public-private partnership on the implementation of the principle of sustainable development in local government units. The theoretical and empirical considerations are based on normative acts, specialist literature and data relating to public-private partnership. The legislator imposes the obligation to perform public tasks on the local government units. They include duties that fall into the category of spatial and ecological order. The statutory obligation results in the necessity to undertake activities dependent on the currently binding law on the one hand, and on the capabilities and needs of a specific local government unit on the other hand. The potential of the local government unit determines the scope and speed of changes. Public-private partnership, as a form of cooperation between a public entity and a private partner, allows a division of tasks and risks between the parties, and thus uses the potential of a private partner and relieves the public body in the field of activities taken over by the private partner. Cooperation in performing public tasks allows implementing the assumptions of sustainable development based on the cooperation of socio-economic and ecological solutions, also in relation to the quality and economic conditions. The aim of the publication is to examine to what extent public-private partnership can contribute to the implementation of the principle of sustainable development in local government units. The study indicates that public-private partnership affects the implementation of the principle of sustainable development by combining process management and control of public tasks in order to prevent and reduce the waste of human resources, raw materials and energy.
    Przedmiotem artykułu są rozważania na temat wpływu partnerstwa publiczno-prywatnego na realizację zasady zrównoważonego rozwoju w jednostkach samorządu terytorialnego. Ustawodawca nakłada na jednostki samorządowe obowiązek wykonywania zadań publicznych, wśród których są także zadania mieszczące się w kategorii zadań ładu przestrzennego i ekologicznego. Obowiązek ustawowy rodzi konieczność podejmowania działań uzależnionych z jednej strony od treści przepisów prawa powszechnie obowiązującego, a z drugiej od możliwości i potrzeb konkretnej jednostki samorządowej. Potencjał jednostki samorządowej determinuje więc zakres i szybkość wdrażanych zmian. Partnerstwo publiczno-prywatne, jako forma współpracy pomiędzy podmiotem publicznym a partnerem prywatnym, umożliwia podział zadań i ryzyk z nimi związanych pomiędzy strony, a więc wykorzystuje potencjał partnera prywatnego oraz odciąża podmiot publiczny w zakresie przejętych przez partnera prywatnego działań. Dzięki współpracy w wykonywaniu zadań publicznych możliwa jest realizacja założeń zasady zrównoważonego rozwoju w oparciu o kooperację rozwiązań społeczno-gospodarczych i ekologicznych, powiązanych także z rachunkiem jakościowo-ekonomicznym. Celem publikacji jest zbadanie, w jakim stopniu partnerstwo publiczno-prywatne może przyczynić się do wdrożenia zasady zrównoważonego rozwoju w jednostkach samorządu terytorialnego. Badanie wykazało, że partnerstwo publiczno-prywatne wpływa na wdrażanie zasady zrównoważonego rozwoju poprzez połączenie procesu zarządzania i sterowania wykonywaniem zadań publicznych, w celu zapobiegania marnotrawstwu zasobów ludzkich, surowców i energii.

    There is a widespread and increasing interest in public-private partnership (PPP) in Poland as a mean of implementing public investment projects, resulting from the fact that the funds that are available to local governments, or EU funding, are not sufficient to meet all the investment needs. In the paper a comparative analysis of the size and structure of the public-private partnerships in the EU countries, with a particular focus on the Polish market is presented. Possibilities of investments based on public-private partnerships on rural areas are specified. The paper examines the recent trends in the PPP's market and describes how these changes and development may affect the infrastructural improvement on rural areas.

    The aim of this article is to introduce non‑budgetary methods of financing public investments. The author bases her insights on professional experience from Poznań City Hall. In the first section the alternative forms of funding and implementation for public services are discussed. Next, the author presents the approach which was adopted by the city of Poznań regarding public‑private partnership projects. The examples of municipal investments implemented in Poznań within the public‑private partnership formula, such as Thermal Recycling Facility for Municipal Waste are given. The author also discusses legal basis, financial schemes and identifies challenges to such investments.
