One of the features of democracy is the constant battle for the protection or implementation of particular interests. This trend is inevitable and, according to many experts, also quite beneficial with regard to the efficiency of the functioning of the political system, as well as its social legitimization. Nevertheless, restrictions apply as there are as many ways of regulation, from a legal point of view, as there are countries in the world. Thus it ought to come as no surprise that lobbying exists in Poland, and in consequence we are observing attempts to establish a framework for it in legal terms. Some questions arise in this respect that require a serious response: what should be considered as lobbying? Is it actually legal in Poland? Does the legal framework allow for its controlling and monitoring? If, and possibly how, should such regulations influence the social reception of lobbying in Poland? These are but a few of the questions that this paper is aiming to provide answers to.

The aim of this paper is to present the main solutions adopted in Polish act of July 7, 2005 on lobbying activity in the law-making process, with particular emphasis on the dysfunctions of this regulation. Despite the hopes of reducing corruption in public life and ensuring the transparency of the decision-making process, the discussed act deserves a critical evaluation. Among the many weaknesses, some must be especially identified: the act ignores the possibility of lobbies influencing the law-making by the President, the parliament bodies, the National Broadcasting Council and the decision-making bodies of local self-government and local government administration bodies; public hearing procedure; defective definition of lobbying activity and the size of penalties for violation of the lobbying regulations. Moreover, actual effects of the act were presented, which prove the thesis that Polish lobbying act can be assessed as “apparent regulation”.

What proves to be characteristic of the democratic system is the fact that it constantly witnesses various tensions between authorities, opposition, citizens, diverse legal subjects, advocacy groups, etc. Their disputes concern changing or upholding the existing legal environment, which is unavoidable in this case. This situation is not surprising or improper as lobbying understood in this way is an immanent, often useful part of the system. However, what may be puzzling is the fact that democratic political systems are characterized by the variety of attitudes adopted by authorities toward the practice - from pretending it does not exist (and thus requires no regulations) to implementing regulations of a highly general nature. Poland experiences both the practice itself and the attempts to legally regulate it. The aim of the article is to critically analyze the existing situation.
Cechą charakterystyczną ustroju demokratycznego jest to, iż nieustannie dochodzi w nim do tarć. Ścierają się więc, w różnych konfiguracjach, władza, opozycja, obywatele, różnego typu podmioty prawa, grupy interesu itp. Spór zaś idzie o zmianę istniejącego stanu prawnego, bądź też jego zachowanie, a rozbieżność oczekiwań w tym względzie ma charakter zupełnie nieunikniony. Nic w tym szczególnie zaskakującego czy niestosownego, wszak tak pojmowany lobbing jest immanentną, często użyteczną, częścią systemu. To, co może natomiast zastanawiać, to fakt, że w demokratycznych systemach politycznych istnieje tak wiele różnych postaw ośrodków władzy wobec zjawiska - od pozorowania, że ono nie istnieje (i nie wymaga regulacji) do wdrażania regulacji o bardzo ogólnym bądź też niemal kazuistycznym charakterze. Także i w Polsce do czynienia mamy tak z samym zjawiskiem, jak i z próbą jego prawnego uregulowania, a poniższy artykuł ma na celu krytyczną analizę istniejącego stanu faktycznego.

This article examines the relationship between politics and public relations, based on recent developments in Sweden and Norway. It has become increasingly common for PR firms to offer well-paid job opportunities for former politicians. Then, after some years as advisors in public affairs, including lobbying activity, some of them return to politics as members of the government, press officers or advisors. The article discusses the background for this development, and poses some questions concerning integrity and the possible consequences for democracy.

Self-regulation initiatives are undertaken by many lobbying circles in various countries. The key element of those initiatives are codes of ethics including a postulated model of lobbying activities, a specific pattern of ethical standards of lobbying. The aim of the article is a reconstruction of this pattern on the basis of the analysis of eight codes representing American, Polish, British, European and German lobbying. The analysis leads to the following conclusions. An axiological base of the lobbyist profession is created by such values as honesty, reliability, integrity, trust, professionalism, civic responsibility, openness, transparency, loyalty, respect, courtesy. Norms included in the codes are concentrated on the following issues: legality, transparency of actions, care of reputation and dignity of the profession, avoiding corruption, conflict of interest, customer relationship, duties toward society, public relations. A weak element of lobbying self-regulation is a system of norm execution.

Le présent article aborde l’analyse de la persuasion argumentative et de la figuralité dans le discours en rapport avec le lobbying. Pour être convaincant face à leurs interlocuteurs, le lobbying utilise des techniques linguistiques afin de servir leurs intérêts. De son côté, l’opinion publique se sert de ces mêmes techniques langagières afin de dénoncer les activités du lobbying. Ces techniques langagières sont la persuasion et la figuralité, et elles ont pour objectif d’embellir, de critiquer ou d’atténuer le discours, en fonction de la perspective de l’émetteur. Cela permet aussi de caractériser, d’une part, la culture sociale d’une zone géographique déterminée, et de l’autre, le rôle du lobby dans cette société et l’image publique que ce dernier renvoie. C’est dans cette optique d’argumentativité que l’article offre une approche de ces stratégies discursives, par le biais d’écrits scientifiques et médiatiques.
This article discusses the analysis of argumentative persuasion and figurative language in a discourse related to lobbying. To be convincing to their interlocutors, lobbying uses linguistic techniques to serve their interests. For its part, public opinion uses these same language techniques to denounce lobbying activities. These language techniques include persuasion and figurative language. They aim to gild, criticise, or tone down the discourse, depending on the issuer’s perspective. This also makes it possible to characterise, on the one hand, the social culture of a specific geographical area and, on the other hand, the role of the lobby in this society as well as the public image that it reflects. It is in this perspective of argumentativeness that the article offers a report of these discursive strategies through scientific and media writings, such as blogs and dedicated websites on lobbying.

This study examines how the media and journalists are used in lobbying processes. To explore the topic a systematic review of the literature in peer-reviewed journals published between January 2000 to June 2018 was undertaken. The findings of this paper indicate that lobbyists and interest groups engage with a plethora of various strategies and systematic methods when influencing or trying to advocate the work of journalists and media organisations. The findings shed the mystery of lobbyists and interest group’s communicative attempts. This study increases the knowledge of the relationships between journalists and lobbyists in lobbying processes. Based on the literature review, the paper presents a categorised model of media influencing strategies in lobbying process.

The main purpose of this article is to show the forms of lobbying utilized by interest groups in the times of COVID-19 (ex-ante, ongoing, ex-post). A comparative approach was adopted to the forms of influence used in the pre-COVID and post-COVID times. In addition, the article discusses the articulated forms of influence and verifies the impact evolving from the impact of the SARS-CoV-2 pandemic used by interest groups towards public administration. The analysis was carried out aimed at a predictive look at the forms of influence used in relation to the current postpandemic situation, which are used by interest groups in lobbying campaigns in relations with decision-makers in public administration. In addition to the theoretical dimensions, practical insight are also offered into the functioning of interest groups through the presented sets of tools for lobbying campaign and exerting influence on public authorities.

Lobbying is one of the strategies applied by groups of interest. Like any other strategy it is to help achieve the goals that a particular group identifies and articulates. Paradoxically, the greatest value and the strongest enemy of lobbying is its popularity. On one hand lobbying is a series of activities that group elites willingly (e.g. in the U.S.) employ to achieve their interests. On the other hand, though, referring to the notion of lobbying in various contexts, whether in PR, marketing or journalism, it raises numerous questions. The latter, i.e. the journalistic context distorts it most severely. It is journalism that applies the name of lobbying to mysterious, to put it mildly, and dubious interactions between the private and the political sectors, thereby implying a rather derogatory ‘image’ of this instrument in public opinion, which is especially the case in Central and Eastern Europe, including Poland. However, lobbying is more than a handy tool to achieve particular, strictly business interests, it is also an important route to implement social interests. It can be easily used by large economic groups of interest, trade unions or business organizations, wrestling with the strong third party of industrial relations, the state. By this token lobbying becomes a component of industrial relations, and by no means is it a worse party, one that is less socially-oriented and more like an ‘old boys’ network’, but a party which can efficiently contribute to a specified social interest to be implemented in the labor market. In order to make it possible, though, appropriate regulations, conditions, and factors of a legal, organizational and cultural nature need to be developed. A profound change in this field does not seem feasible in Poland, which becomes clear when reading the long-awaited law on lobbying currently in the legislative process. Maybe we should not be very surprised, given that our industrial arena is highly susceptible to hybrid and ephemeral solutions, and the issue of making appropriate use of lobbying also leaves a margin for uncertainty and deformation. Despite these concerns and limitations caused by industrial relations it is worth improving and creating the proper environment for lobbying activity in Poland, which the authors of this paper try to demonstrate.

The printed press has the overt ambition to occupy a significant position in politics, making itself the fourth estate. This ambition is served by tools of social engineering, marketing, and PR. Their purpose is to make the position of the media particularly prominent in the social sphere. The press does not hesitate to enter the domain of various groups’ interests. The „Rzeczpospolita” and „Gazeta Wyborcza” dailies have undertaken a variety of projects to protect their (publisher’s) position on the market, resorting to tools that are typical of the protection o f interests. Depending on the situation, they have applied persuasion, used social relations, sought to influence decision-making processes, and formed coalitions to strengthen the pressure they can apply. To accomplish their particular interests they have involved public opinion and intemational bodies, presenting the intentions and actions of State authorities in a negative light, different from the actual picture. They have not shunned manipulation, threats and even blackmail, ultimately resorting to open confrontation. This aspect of media functioning usually goes unnoticed. Researchers have mainly focused on the cultural functions of the press, as well as the role of a political actor vested in the fourth estate. The cases analyzed in this paper are an attempt to fili a gap in the academic literature.
Prasa nie kryje ambicji zajmowania znaczącej pozycji w polityce, kreując się na IV władzę. Jest to roszczenie, któremu służą zabiegi o charakterze socjotechnicznym, marketingowym, PR-owskim. Mają na celu szczególne wyeksponowanie pozycji mediów w przestrzeni społecznej. Prasa nie waha się przed wkraczaniem na obszar, który jest domeną grup interesu. „Rzeczypospolita” i „Gazeta Wyborcza” podjęły różnorodne przedsięwzięcia, by chronić swą (wydawcy) pozycję na rynku, w czym posługiwały się narzędziami typowymi dla rzecznictwa interesów. W zależności od rozwoju sytuacji, stosowały perswazję, wykorzystywały relacje towarzyskie, starały się wywrzeć wpływ na proces decyzyjny, ponadto dla wzmocnienia presji tworzyły koalicje. Do realizacji swych partykularnych interesów angażowały opinię i instytucje międzynarodowe, ukazując intencje i działania władz państwowych w negatywnym, odbiegającym od rzeczywistości świetle. Nie stroniły od manipulacji, gróźb i szantażu, przechodząc wreszcie do jawnej konfrontacji. Ta strona funkcjonowania mediów jest zwykle niedostrzegana. Badacze koncentrują się głównie na kulturowych funkcjach prasy, a także roli aktora politycznego lokowanego w IV władzy. Poddane analizie przypadki są próbą wypełnienia luki w literaturze naukowej.

The article focuses on lobbying as an instrument of business influence on public administration, and vice versa. The author explores this phenomenon from various perspectives, emphasizing that lobbing is perceived either as the roots of corruption or as an immanent element of democracy. Providing and overview of the directions of lobbying legislation he claims that low effectiveness of the current law in Poland is a good reason for changing lawmakers’ approach to lobbying per se and methods of its control. The article concludes with some recommendations. The author proposes, inter alia, that instead of penalizing only some forms of lobbying, the legislators should ensure full openness and transparency of decision-making processes and become more focused on the real beneficiaries of lobbying: lobbyists’ targets and principals.
