Jusqu'au XVIème siècle la législation dans l'Empire éthiopien était principalement fondée sur les règles du droit canonique, les commandements bibliques, et des éléments du droit coutumier. Il a fallu attendre l'apparition du premier écrit code juridique pour voir l’intégration du droit romain et byzantin dans la législation éthiopienne. La codification du droit en Ethiopie, qui a eu lieu dans les années 1924-1933 et 1950-1960, a exigé des codificateurs l’application des législations des pays du monde occidental. Pour la création du code criminel et du code civil, on a utilisé les codes des pays dont la législation s’appuyait sur le droit romano-germanique, aussi bien que ceux des pays dont la législation reposait sur le droit anglo-saxon. Le texte ci-dessous tente de repondre à la question: à quelle famille juridique appartient la législation éthiopienne contemporaine?

The integration of legal systems in European is one of the most important issues. This process has started by the fact that there are significant differences between the civil law and common law system and between the legal families in it. A law (at domestic or international level) should not be viewed against the backdrop of the historical, political, cultural, social and economic context in which they function. In order to shed further light for our readers, we analyze by emphasizing the significant differences between the civil law and common law system on one side and the legal families that are part of the same legal system, either “Civil” or “Common,” on the other side. The Europeanization of law refers to the communization of the law by EU institutions and to a process that aims at creating a common Europe legal system. In the end, either in medium or long term, the Europeanization is contributing to the so-called non-mandatory or soft harmonization of private law. It is in the best interest of the EU to seek adequate judicial instruments to accommodate the massive numbers of laws deriving from different Civil Law and the Common law systems.

This paper focuses on a highly specialized field of law, namely nuclear law. This is characterized, on the one hand, by strong national competences and the primary position of national law, but also, on the other hand, by the international dimension, which has a major impact on national law. For a European Union Member State, the picture is even more wide-ranging, as European Union law, in this case the Euratom Treaty, adds another important layer to the legal-regulatory framework in the nuclear energy sector. The point of departure for this paper is therefore that of an EU Member State, which in nuclear energy issues functions in a legal field consisting of three interdependent main elements – national law, European Union law and international law. Thus, the article seeks to answer the question of which of these three legal systems is the primary one for an EU Member State in the area of nuclear safety, and also to shed light on their interrelationships. he theoretical framework for this analysis aimed at systematization is Hans Kelsen’s classical theory of legal systems. The argument presented here is that for an EU Member State the primary legal system from a legal-hierarchical point of view is the legal system composed of EU law. This is the case mainly because the EU has competence in the area of nuclear safety, albeit shared with the EU Member States. Although the EU/Euratom has not yet significantly expanded regulation in this field, this will most likely change as EU energy policy and legislation develops further in the future. This evolution will most likely have both legislative and enforcement impacts, despite the fact that the substantive content of legislation on all three levels is quite similar. In spite of this, the three legal systems co-exist in constant interaction and without major collisions. Kelsen’s perspective can prove beneficial for understanding the boundaries of the three interdependent legal systems and the shift of the basic norm towards EU law over the past two decades.

This paper addresses the problem of organized crime using the example of the Sicilian Mafia. The main purpose of the argument is to present the Mafia’s activity as a pathology of the system, which has a negative effect on both the economy and the legal situation of southern Italy. The study is largely concerned with national and EU regulations related to organized crime. Attention is also devoted to the United Nations Convention on the subject in question. In addition, the paper discusses the impact of the Mafia on economic processes and society. In particular, the Mafia’s activities in the security industry are examined. The overall aim is to present the Mafia as a system error and to explore extensively the topic of the Mafia in Italian Sicily from a legal and economic viewpoint, with an emphasis placed on organized crime as a global problem.

The civil law system entered the codification path during the 19th century, enabling the creation of uniformity, such as drafting a civil code and building a new (national) identity. The structure of the code suggests that it provides a comprehensive, internally coherent set of rules for private law. The adopted civil codes secure lawyers a systematic and coherent foundation for the legal system and legal reasoning. Codification allowed laws to be in an easily identified document easily. Traditionally, the civil law system has been subject to several codification and consolidation processes during different periods in time, influenced from political, social or economic reforms. In Albania after the proclamation of the Monarchy, work began on the preparation of various codes, with the crucial one being the Civil Code. The first Albanian Civil Code entered in force on the 1st of April 1929. This process was the first step for the Albanian Legislator to compare the secularity of the European legal framework to that of the Ottoman Empire. In 1991, the end of the communist era in Albania was marked by bringing the transformation of the economy into a market-oriented system and the creation of a legal system that protected the right of private property. The Albanian system as a continental system has developed a system based on systematic approach to laws, a procedure known as dogmatic approach. It has created an internal system of laws based on generally codified norms and principles. The purpose of this paper is to explain the impact of political, social or economic reforms in the codification process and the nature of legal sources in Albania.

The subject of this article is the institution of the constitutional complaint, which is analysed in connection with European integration. It should be noted that Poland’s membership of the European Union has had a great influence, not only on the system of national law, but also on the jurisprudence of the Polish Constitutional Tribunal; therefore considerations are carried out here mainly in relation to the Constitutional Tribunal.            In examining the issue of the constitutional complaint, the following assumptions may be stated. First, the constitutional-complaint procedure, is in fact, the examination of the compliance of legal norms with the Constitution, any deviation being related to the entities initiating proceedings before the Constitutional Tribunal, Article 191(1)(6), of the Constitution[1], and to the material scope of the complaint, as determined in Article 79 of the Constitution. Second, there is no doubt that the constitutional complaint can become an important legal instrument shaping the jurisprudence of the Polish Constitutional Tribunal, which has to face constitutional issues related to European integration[2]. Following the example of the practice of other Member States, e.g. Germany, the Tribunal may use the institution of the constitutional complaint as a means of controlling the compliance of the secondary law of the European Union with the Constitution of the Republic of Poland.   [1] The Constitution of the Republic of Poland, Journal of 2 April 1997, Journal of Law 1997, No. 78, item 483, as amended. Paper’s aim deals with defining the role of the category of the system both in the essence of the law and in its implementation and interpretation. The course of deliberations starts with the notion of the legal system, being followed by the analysis of basic dimensions of the systemic analysis of law (systematization of the normative acts as well as vertical and horizontal structure of law) and of the role of the systemic (both structural and axiological) rules of the legal interpretation conducted in the process of the application of law. The results of these considerations are then confronted with the various divisions of the legal system, taking especially the position of the administrative law into account.
Opracowanie ma na celu określenie roli kategorii systemu w postrzeganiu istoty prawa oraz jego wykładni i stosowaniu. Stąd, po zasygnalizowaniu kwestii pojęciowo-konstrukcyjnych, przedmiotem analiz stały się podstawowe wymiary systemowości prawa (systematyka aktu normatywnego oraz struktura pionowa i pozioma systemu), które pozwalają na dostrzeżenie roli reguł systemowych w wykładni prawa dokonywanej w procesie decyzyjnym stosowania prawa. Ustalenia co do powyższych zagadnień zostały następnie skonfrontowane z przedmiotowymi podziałami systemu prawa, ze szczególnym uwzględnieniem w jego ramach pozycji prawa administracyjnego.

The countries that have experienced the phenomenon of terrorism have established appropriate institutional and legal systems to counteract this threat. France, Germany and the Russian Federation all have a history of terrorist attacks on their territory. Each of these countries has proper legal and institutional arrangements. Democratic states use these tools to protect democratic values, while the Russian Federation also uses them to suppress political opposition and as a part of a larger system of armed struggle against Ukraine. Regardless of the political regime, each country has a ‘self-defence’ structure which ensures the stability of the system.

The aim of this article is to present a general forecast of the development of processes of legal integration in the European Union in the coming years. The European Union is in ‘multi-crisis’, which may force the member states to adopt an organizational development scenario based on differentiation. The selectivity of this differentiation is understood both in terms of the heterogeneity of integration in some areas and the reduction in the number of states fully participating in integration. An analysis of the current trends and solutions proposed and taken by EU decision-makers shows that the EU legal system is not subject to federalization, but in fact the tendency to deepen integration does not conflict with intergovernmentalism. The multiplicity of problems resulting from the multi-crisis will most likely require the deepening of the current differentiation mechanisms and the emergence of new ones.

The purpose of this study is not a detailed analysis of the proposed legal solutions concerning Courts of the peace, especially since at the time of writing this article the legislative process is at an early stage. On November 4, 2021, the Sejm received the draft Act on Magistrates' Courts presented by the President of the Republic of Poland, the first reading of which took place on December 2, 2021, as well as the draft provisions introducing the Act on Magistrates' Courts. The presidential project is not the only one being processed. Despite this, it is worth making a preliminary analysis of the proposed assumptions, as well as possible future objections that may be raised after the adoption of the regulations, because the basic issues are unlikely to change radically. Regardless of this, the study is an attempt to initially determine the possible consequences of introducing the described legal solutions to the legal system for the judiciary.

Trybunał Konstytucyjny postanowił o utracie mocy przepisu już nieobowiązującego w systemie prawnym. Na mocy orzeczenia sygn. akt P 1/18 art. 57 § 5 pkt 2 Ustawy z dnia 14 czerwca 1960 r. – Kodeks Postępowania Administracyjnego został uznany za niezgodny Konstytucją. Przepisy te mają wymiar historyczny, chociaż przez chwilę były częścią systemu prawa oraz mogły być właściwie stosowane przez organy władzy publicznej. Orzeczenie zostało wydane w dniu 30 października 2019 r., czyli po wejściu w życie nowelizacji tego artykułu. Niezależnie od działań ustawodawcy Trybunał Konstytucyjny musiał wydać wyrok jako orzeczenie historyczne, które jest logiczną zasadą wypracowaną na podstawie art. 190 Konstytucji.
The Constitutional Tribunal has ruled that a regulation which is no longer binding in the legal system – expires. By way of the Decision file no. P 1/18, Art. 57 § 5 point 2 of the Act dated 14 June 1960 – Administrative Procedure Code was found incompatible with the Constitution. These regulations are of historical character, although they were temporarily part of the legal system and could be adopted by the public authorities. The judgement was pronounced on 30 October 2019, that is after the amendment to this article had come into force. Irrespective of the legislator’s actions, the Constitutional Tribunal had to issue a judgment as a historical decision which is a logical principle elaborated on the basis of Art. 190 of the Constitution.

One of the aspects of considerations regarding the legal system are the features of this system. The aim of the article was to attempt theoretical reflection and answer the basic question, namely – can the Polish legal system be considered uniform in the context of multicentrism. Nowadays, the feature of uniformity of the legal system is one of the most problematic. According to the typical understanding, the legal system is uniform if the normative acts come from state authorities. However, integration processes in which the state participates cause the creation of supranational structures with their own legal systems. In the European legal space, they include the Council of Europe and the European Union. The legal systems of these organizations are linked by formal relationships with the legal systems of the member states. As a result, the legal systems of European countries are evolving, they cease to be monocentric and become multicentric. In such a situation, normative acts of supranational structures start to operate on the territory of a state. This raises a theoretical issue regarding the possibilities and, perhaps, the scope of recognition of the uniformity of the legal system.
Jednym z aspektów rozważań dotyczących systemu prawnego są cechy tego systemu. Celem artykułu było podjęcie teoretycznej refleksji i udzielenie odpowiedzi na podstawowe pytanie, mianowicie czy polski system prawny można uznać za jednolity w kontekście wielości centrów decyzyjnych. Obecnie cecha jednorodności systemu prawnego jest jedną z najbardziej problematycznych. Zgodnie z typowym rozumieniem system prawny jest jednolity, jeśli akty normatywne pochodzą od władz państwowych. Jednak procesy integracyjne, w których uczestniczy państwo, powodują powstawanie struktur ponadnarodowych z własnymi systemami prawnymi. W europejskiej przestrzeni prawnej obejmują one Radę Europy i Unię Europejską. Systemy prawne tych organizacji są połączone formalnymi relacjami z systemami prawnymi państw członkowskich. W rezultacie systemy prawne państw europejskich ewoluują, przestają być monocentryczne i stają się multicentryczne. W takiej sytuacji na terytorium państwa zaczynają obowiązywać akty normatywne struktur ponadnarodowych. Rodzi to teoretyczne pytanie o możliwości i być może zakres uznania jednolitości systemu prawnego.

Public prosecution service has an irreplaceable place in the system of state authorities. However, the years of authoritarian regimes transformed independent public prosecution authorities existing on the territory of Slovakia and the Czech Republic into authorities protecting primarily the regime and persecuting all persons who were non-compliant with this regime. It was not until the fall of Communism in 1989 that a change came – a return to the original mission of public prosecution service (the independent protection of law). However, after the division of the Czechoslovakia in 1993 opinion plurality and the lack of a clear opinion on the nature of the public prosecution service resulted in the creation of two relatively different models – the model of prokuratúra in Slovakia and the model of státní zastupitelství in the Czech Republic. This is the reason why the author of this paper deals with the constitutional status of public prosecution service in the Czech Republic and Slovakia. He analyses public prosecution service as a constitutional institution in general and then by comparison he focuses on constitutional regulation of the Slovak and Czech public prosecution service. The final parts contain brief evaluation of the current legal status and some possible considerations de constitutione ferenda.

The model of liability of collective entities for acts prohibited under penalty, introduced into the Polish legal system by the Act of 28 October 2002 (consolidated text, Journal of Laws of 2020, item 358, as amended), which entered into force on 28 November 2003, was criticized from the beginning. Time has shown that the scepticism of the representatives of the legal commentary regarding the solutions adopted at that time was fully justified. After nearly 20 years of this act being in force – systemically important yet playing a marginal role in practice – the time has come for radical changes in the model of penal liability of collective entities. The model of the so-called consequential liability of a collective entity, which depends on a preliminary ruling, i.e. on prior confirmation by a final judgment that an offense or a fiscal offense has been committed by a specific natural person, is replaced by direct liability. This was reflected in the changes introduced to the Act of 2002, which entered into force on 1 September 2022. An analysis of these changes will be used to assess the new model of criminal liability of collective entities for acts prohibited as offenses against the environment, in the normative and practical aspect.

The influence of legal regulations in the area of protection of cultural property on the cultural security of the second Polish Republic in the years 1918-1939

The article attempts to analyse the significance of the legal output in the area of protection of cultural property enacted in the period of development of the Second Polish Republic. The paper advances the thesis that the years 1918-1939 were characterised by the crucial legislative out-put regarding the protection of cultural property, which guaranteed the possibility of protecting the tangible cultural heritage of the Polish nation in the difficult period of restoring the foundations of its statehood. The defence of the above thesis relies on both the literature and source materials, including mainly the materials stored in the Central Archives of Modern Records (Archiwum Akt Nowych) in Warsaw and archival materials published in Wojskowe Teki Archiwalne. Taking account of the specific nature of the selected topic, the key material comprised legal acts concerning the protection of historic monuments in the period of the Second Polish Republic and the adopted research method was the analysis of such materials. On the basis of the presented information it can be stated that the Second Polish Republic was a period of particular significance for the development of the Polish legal system in the area of protection of cultural assets. In the years 1918-1939, the legal protection of cultural property represented the way of enhancing the cultural security, consisting in the systematic development of legal norms. The development of the cultural property protection law was based on a number of legal acts passed both in the 1920s and in the 1930s. In the Second Polish Republic the cultural property protection law made it possible to combine the social function of safeguarding historic monuments with the public function in the protection of historic monuments, which had a favourable impact on the protection of the national heritage.
