    Opis:
    Scharakteryzowano akty prawne dotyczące ochrony informacji, obowiązujące przedsiębiorstwa. Przeprowadzono badania aktów prawnych celem określenia odpowiedzialności i obowiązków przedsiębiorców przetwarzających informacje chronione na podstawie przepisów prawa. Podjęto próbę określenia działań niezbędnych do zaimplementowania w przedsiębiorstwach dokumentacji dotyczą-cej ochrony informacji prawnie chronionych oraz próbę przedstawiania skutków dla przedsiębiorstwa spowodowanych niewłaściwą ochroną tych informacji.
    The author characterised the legal acts concerning information protection obligatory for enterprises. There were carried out surveys of legal acts to determine the responsibility and duties of the entrepreneurs processing information protected pursuant to the provisions of law. The author undertook an attempt to determine the actions indispensable for implementation at enterprises of the documentation concerning protection of legally protected information as well as an attempt to present the consequences for the enterprise caused by improper protection of that information.

    Opis:
    In this article, the author conducts a comparative analysis of international and Ukrainian legislation in the field of regulation of rights and obligations of trademark owners and domain names, protection mechanisms and their legislative consolidation. The imperfection of the legislative enshrinement of the domain name concept, the consequences of the lack of legal regulation by the state of the legal status of persons who have the right of ownership of the domain name, the lack of legal consolidation of mechanisms for acquiring and terminating domain name ownership and the legal consolidation of trademark and domain name. The differences between the current methods of protection of the right to a domain name in Ukraine and at the international level were revealed, and the prescriptions of the rules governing and resolving domain disputes in international and Ukrainian legal practice were compared. Based on the analyzed legislation, rules and scientific materials, ways to improve the legal status of domain name owners in Ukraine are proposed, including the separation of the domain name as a separate object of intellectual property rights, with typical for intellectual property rights guarantees for protection and enforcement on the domain name on the part of the state, development of the uniform mechanism regulated by the state of registration and acquisition of the property rights to the domain name and separation of legal ways and means of protection of the right to the domain name.
    У цій статті автором проводиться порівняльний аналіз міжнародного та українського законодавства у сфері регулювання прав і обов’язків влас- ників торговельних марок та доменних імен, механізмів захисту та за- конодавчого їх закріплення. Висвітлено недосконалість законодавчого закріплення поняття доменного імені, наслідки відсутності правового ре- гулювання з боку держави правового статусу осіб, що мають право влас- ності на доменне ім’я, відсутності юридичного закріплення механізмів набуття та припинення права власності на доменне ім’я та законодавчого закріплення розмежування понять торговельної марки та доменного імені. Було виявлено відмінності актуальних способів захисту права на доменне ім’я в Україні і на міжнародному рівні та порівняно приписи правил, яки- ми регулюються та на підставі яких вирішуються доменні спори в міжна- родній юридичній практиці та українській. На підставі проаналізованого законодавства, правил та наукових матеріалів запропоновано шляхи для вдосконалення правового становища власників доменних імен в Україні, серед яких – виокремлення доменного імені як окремого об’єкта права інтелектуальної власності, з характерними для об’єктів права інтелекту- альної власності гарантій щодо захисту і охорони права на доменне ім’я з боку держави, вироблення єдиного регульованого з боку держави меха- нізму реєстрації і набуття прав власності на доменне ім’я та виокремлення юридичних способів та засобів захисту права на доменне ім’я.

    Opis:
    The regulations of new Directive (EU) 2016/943 of 8 June 2016 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure provide employers as the holders of trade secrets with a higher level of legal protection. Employers will have protective measures against the disclosure of employer's secrets at their disposal, which are laid down in Labour Code and in Unfair Competition Act. This Directive stipulates that data constituting the trade secret are not widely known or easily accessible to people who work in a given trade and process this type of information on a daily basis. This secret may constitute every confidential piece of information that the employer considers to have any, even potential, commercial value. However, the domestic law still does not provide a sufficient level of protection of employers-whistle blowers, that is people who inform about irregularities in the company. Therefore, the introduction of special legal protection of whistle blowers will be an absolute innovation. To that end, the legislator should state in the labour law the boundaries of protection of whistle blowers who act in good faith, having regard to public interest protection and employer’s interests.
