Opis:
The aim of this article was to assess to what extent self-regulation within the CSR framework contributes to improving workers’ rights worldwide. Transnational company agreements, corporate codes of conduct, NGOs’ social accountability standards, ISO standards, the Dow Jones Sustainability Index and the Global Reporting Initiative were critically analysed us- ing logical-linguistic, historical and comparative legal methods. The research showed some evidence of a limited impact of CSR instruments on labour rights and proved that CSR tools can be perceived only as additional value to law.

Opis:
The article is devoted to the issue of human trafficking in legal and criminological terms, with particular emphasis on the exploitation of victims of the crime for work or forced services. The author introduces the essence of forced labour by reaching for many of its legal definitions contained in legal acts in the rank of conventions, as well as ordinary laws. At the same time, it highlights the factors that characterize the type of work indicated and allow to distinguish it from other types of violations, including violation of employee rights. The phenomenon of human trafficking is shown through the prism of its current evaluation tendencies, both globally and regionally (European, and especially EU). To this end, the author presents statistical data collected in recent years by, inter alia, the United Nations Office on Drugs and Crime, the International Labour Organization, the International Organization for Migration and the European Commission. She emphasizes, however, that the actual scale of the aforementioned crime remains unknown. A significant part of the discussion focuses on the issue of human trafficking in modern Poland, showing the scale of the dealings in question, diagnosed in recent years by law enforcement agencies. A lot of attention is also paid to the spectrum of crime threats on the Polish labour market from the perspective of foreigners. Thus, with particular care, she considers the problem of violating the employment rights of Ukrainian citizens as the largest group of foreigners illegally employed in Poland. She also shows the legal situation in this area of the citizens of Belarus, Moldova, India and Russia. She discusses this issue in the context of activities of the National Labour Inspectorate included in the audit report for 2017. The author further scientific interest includes the issue of criminalization of human trafficking in selected countries around the world. In this respect, it refers primarily to legal regulations contained in the Latvian, Hungarian, Swiss, Finnish, Ukrainian and Liechtenstein penal codes. The author’s ambition was to present the indicated issues in a concise manner, while also taking into account its most important aspects.

The paper aims to provide theoretical insights and explore the comparative legal practice of approaching mental health and well-being at the workplace by applying legal normative and comparative methods in a digitalized world of work. In this regard, subordination vs autonomy needs to be considered as a starting theoretical point accompanied by an overview of comparative legal approaches that have recently introduced some novel legal mechanisms, such as the right to disconnect to deal better with the exercise of fundamental labor rights. Additionally, introducing a psychosocial risk management model in occupational health and safety could significantly improve workers’ mental health and well-being in the digital age. Therefore, the proactive, holistic, and integrated approach to workers’ rights and status in the digital environment must be analyzed by exploring the bounding point between organizational management views on the subject and labor law standpoints.

Zjawisko mobbingu jest ważnym problemem w krajach wysoko rozwiniętych, w szczególności zachodnioeuropejskich. Regulacje prawne tych państw w różnym zakresie odnoszą sie do tego problemu. W takich krajach, jak Szwecja, Francja czy Belgia mobbing uznany jest za naruszanie podstawowych praw pracowniczych i uregulowany w ogólnokrajowych aktach normatywnych. W innych krajach, jak Hiszpania, Włochy, czy Niemcy nadal nie ma regulacji prawnych bezpośrednio dotyczących mobbingu. W artykule przedstawiono sposób, w jaki regulowane są problemy związane z mobbingiem w wybranych krajach Europy Zachodniej. Do kwestii tych należy przeciwdziałanie mobbingowi, orzekanie o zaistnieniu mobbingu, karanie mobberów, czy pomoc ofiarom tego zjawiska. W artykule zwrócono również uwagę na ciekawe rozwiązania, stosowane w krajach regulujących prawnie problem mobbingu.
Bullying is a major problem in industrially developed countries, especially in Western Europe. Their legal framework addresses the problem in various ways. Countries like Sweden, France or Belgium recognize bullying as a violation of the employees basic rights; therefore, the issue has been regulated at the level of bills. However, the problem at hand is still lacking in terms of legal acts directly addressing it in Spain, Italy and Germany. This article presents ways in which the issue of bullying has been dealt with in various European countries. It discusses problems such as preventing bullying, ruling against bullying, acknowledging bullying and helping victims. It also presents some proper codes of conduct.
