    Opis:
    The subject of this article is the discussion of infrastructure for spatial information as an example of opening public sector data. The main aim of this paper is to identify the concept of opening public data. All areas of public administration activities at the national and local government level are more or less related to the use of spatial data. The article discusses the concepts of: spatial data, spatial information system. The article focuses on the work of the European Union on increasing the integration of spatial information systems. Polish public administration is becoming increasingly aware of the benefits of opening access to public data. This paper presents an enormous value of opening data, which should be disposed of appropriately and properly implement.

    Opis:
    Artykuł zawiera rozważania na temat infrastruktury informacji przestrzennej. Celem publikacji jest wskazanie, w jakim stopniu wdrożono przepisy unijne w zakresie infrastruktury informacji przestrzennej w Polsce. W zasadzie wszystkie obszary działalności administracji publicznej na szczeblu krajowym, jak i samorządowym wiążą się w mniejszym lub większym stopniu z wykorzystaniem danych przestrzennych. W artykule omówiono pojęcia: dane przestrzenne, system informacji przestrzennej. Ponadto zwrócono uwagę na prace Unii Europejskiej nad zwiększeniem integracji systemów informacji przestrzennej, a także dokonano analizy polskich przepisów prawnych w tym zakresie. Przedstawiono i oceniono stan obecny w zakresie wdrażania infrastruktury informacji przestrzennej.
    The subject of this article is the discussion of infrastructure for spatial information. The main aim of this paper is to identify how EU regulations in the field of infrastructure for spatial information have been implemented in Poland. All areas of public administration activities at the national and local government level are more or less related to the use of spatial data. The article discusses the concepts of: spatial data, spatial information system. The article focuses on the work of the European Union on increasing the integration of spatial information systems, and analyzes national legal provisions in this area. This paper presents and assesses the current state of implementation of infrastructure for spatial information.

    Opis:
    Nadrzędnym celem wprowadzenia w życie Dyrektywy INSPIRE było stworzenie narzędzi do pełnego i kompleksowego zbierania informacji o środowisku naturalnym. Całość oparta została na idei interoperacyjności zbiorów danych, czyli możliwości płynnej ich wymiany pomiędzy zainteresowanymi podmiotami. Treść Dyrektywy podzielono na trzy załączniki grupujące poszczególne zakresy tematyczne. Za najbardziej istotne dla górnictwa można spośród nich uznać geologię, zasoby mineralne i zasoby energetyczne. Transpozycję INSPIRE stanowi ustawa z dnia 4 marca 2010 r. o infrastrukturze informacji przestrzennej. Wymusiła ona szereg zmian w innych aktach prawnych. Znowelizowano m.in. pięć ustaw, a ustawę z dnia 4 lutego 1994 r. Prawo geologiczne i górnicze uchylono i zastąpiono ustawą z dnia 9 czerwca 2011 r. o takim samym tytule. W przypadku tematów INSPIRE związanych z zagadnieniami takimi, jak np. adresy czy systemy odniesień przestrzennych istnieje szereg wprowadzonych bądź znowelizowanych aktów prawnych, które w teorii odpowiednio dostosowały polskie przepisy. Nadal jednak można znaleźć obszary, które nie w pełni spełniają wymagania stawiane przez samą ideę INSPIRE, jak i przez wydane do niej przepisy wykonawcze. W zakresie ww. trzech tematów związanych z górnictwem Dyrektywa wprowadza narzędzia i rozwiązania pozwalające na możliwie pełne dokumentowanie złóż poprzez np. obliczanie ich zasobów, prowadzenie dokumentacji na temat ich wydobycia, czy też obliczanie energii potencjalnie zmagazynowanej w tego rodzaju zasobach. Przedmiotowe opracowanie skupia się na zbadaniu kwestii realizacji zapisów dotyczących właśnie tych tematów po stronie polskiej oraz narzędzi, jakie w tym celu zostały wprowadzone do stosowania.
    The primary goal of implementing the INSPIRE Directive was to create a toolkit aimed at gathering environmental data in a complete and comprehensive way. The whole idea was set up on the paradigm concerning interoperability of datasets, thus the ability of exchanging them between local and European partners. The content of the Directive is split up into three Annexes which group every theme. Geology and mineral as well as energy resources should be considered as the most important for mining industry. Equivalent to the Directive is its transposition – an act issued on the 4 March 2010 and named „Act on spatial data infrastructure” (pol. ustawa o infrastrukturze informacji przestrzennej). Thus, numerous amendments have been made to other Polish Legal Acts, as well as Law of geology and mining act issued on the 4 February 1994 was replaced by the new one issued on the 9 June 2011. In case of themes concerning such questions as e.g. addresses or spatial reference systems, several newly issued or amended acts can be found. Theoretically these caused Polish law to be consistent with the INSPIRE expectations. However, there are still some areas which do not fully comply with the INSPIRE Directive or relevant executive acts. When it comes to the three themes related to mining industry, the Directive provides tools and solutions which make it possible to e.g. prepare full documentation of deposits containing calculation of their resources as well as the information about how the deposit is, was or will be exploited. Also, information on the energy potential of the deposit can be provided. The present research paper focuses especially on a study performed to determine how accurate the Polish legal acts are when it comes to fulfilling the INSPIRE objectives concerning these three themes.

    The article presents the issues linked to the implementation of the INSPIRE Directive in Poland, within the scope of the spatial data ‘land use’ theme. We present legal regulations in the field of Spatial Information Infrastructure, the tasks of the lead authority in this topic, the participation of other bodies and agencies in the implementation of the tasks of the lead authority, the manner of implementation of these tasks, as well as reflections of the authors upon the changes in competencies and responsibilities, related in particular to the placement of the Chief State Surveyor under the supervision of the minister responsible for construction, planning, zoning, and housing.
