Polish and British legislature - Opis:
- The article presents the idea and most important targets of the institution of information and consultation of emloyees introduced by Directive 2002/14/EEC that obliged member states of the EU to inforce new legislature regarding rules of infroming and consulting in undertakings where more than 50 people are employed. Invocation of the Directive describes economic, social and politcal background that caused need for creating new regulations in labour law area. There are also examples of implementation of Directive 2002/14/EEC by Polish and British Parliament. They differ from each other broadly not only because of the systems of law operating in these two states (common law and continental law) but also because of tradition of labour unions that have existed in the United Kingdom of Grait Britain over 100 years longer than in Poland. Accoring to statutory indcations “information” means means transmission by the employer to the employees' representatives of data in order to enable them to acquaint themselves with the subject matter and to examine it. While consultation means the exchange of views and establishment of dialogue between the employees' representatives and the employer.
