    Opis:
    Separating Roman law from the theory of applicable private law inspires - from the beginning of 20th century – the questions pertaining to the meaning, aims, and methods of researching Roman law. This article analyses these issues in the context of the changes of the evaluation of research resulted from the Polish higher education and science act enacted in 2018. The core of this analysis is the comparison of the traditional understanding of the internationalization of the study of Roman law by Polish researchers and the understanding of world-class research according to the new Polish law. The tension between traditional approach of Romanists and bibliometric criteria of evaluation has significant implication for whether and how the Roman law should be studied and taught on the Polish faculties of law. The paper stresses the role of the impact of Polish researches of Roman law on the European debate about basic problems of private law and legal method today. The future of Roman law in Polish legal education interacts with today’s fundamental dispute about what is Western civilization and how it is to be understood.

    Opis:
    The article focuses on the diagnosis of Management learning state in the best Polish technical universities on Civil Engineers faculties. The authors pose the thesis that in the Polish technical universities there are too few Management courses, so that some of the civil engineers are unable to effectively carry out their tasks in managerial positions. The authors are looking for the confirmation of the thesis analysing twenty programs of Civil Engineering faculties. The average share of hourly subjects of Management in the total number of hours in the analysed faculties was 3%, which the authors deem a very low value. Based on the analysis of literature, the authors recognize that Management knowledge is essential for civil engineers from a certain stage of their careers. The competency gap associated with social and interpersonal competencies can be completed through the tools of lifelong learning, so that engineers with very good technical knowledge will be also able to effectively carry out management tasks.

    Celem tekstu jest ukazanie problemów związanych z procesem przemian w szkolnictwie wyższym, szczególnie z parametryzacją, której przedmiotem staje się naukowy dorobek akademików. Wśród dających się zaobserwować reakcji środowiska na tę sytuację, godną uwagi jest postawa, którą na wzór terminu „obywatelskie nieposłuszeństwo” autorzy tekstu nazywają nieposłuszeństwem akademickim. Przywołane w tekście przykłady dotyczą działań, które są wyrazem niegodzenia się z rzeczywistością i szukania dróg jej zmiany, co – w myśl wniosków, do których dochodzą autorzy – jest przywilejem i obowiązkiem naukowców.
    The purpose of the text is to show the problems associated with the process of changes in higher education, in particular parametrization that takes the academic achievements of scholars as its object. Among the reactions to that situation in academic circles, there is the attitude similar to “civil disobedience”. Examples, which are given by the authors, relate to actions that express disagreement with reality and search for ways to change it. In accordance with the conclusions of the text, this attitude is the privilege and duty of scientists.

    Branża budowlana należy do obszarów o znacznych wahaniach koniunkturalnych. Jednak w ostatnim okresie zauważalny jest wzrost, który wymusza kształcenie sił roboczych na szczeblu szkolnictwa wyższego. Ustawiczne kształcenie w zawodach związanych z branżą budowlaną takich jak architekt, czy inżynier budownictwa jest warunkiem koniecznym do utrzymania się w zawodzie.
    The construction industry is an area with significant economic fluctuations. However, in recent years there is a noticeable increase which requires the education of the labor force on the level of higher education. Graduates-specialists should be prepared for changing market conditions, of which the content is much greater than the one taught in primary and secondary school. Thanks to the division of studies into bachelor and master programs new possibilities have arisen. For industry workers with professional experience it means further education in order to meet market needs as well as equal the educational level of current graduates. Continual education in professions connected with the construction industry such as architect or civil engineer is a condition necessary to remain part of the profession.
    Die Baubranche gehört zu einem konjunkturell stark schwankenden Bereich. Dennoch beobachtet man in den vergangenen Jahren ein starkes Wachstum. Das Wachstum fordert von der Hochschullandschaft neues Fachpersonal. Die neuen Akademiker sollen auf die sich stark verändernden Marktanforderungen vorbereitet sein. Die geforderte Spezialisierung können die Grundausbildungen nicht abbilden. Es entstehen dank der Teilung der akademischen Ausbildung in Bachelor und Master neue Möglichkeiten. Für die im Beruf etablierten Absolventen bedeutet dies ständige Weiterbildung, um nicht von den teils hervorragend ausgebildeten Jungakademikern überholt zu werden. Das lebenslange Lernen ist in Hauptberufen der Baubranche, den Architekten und den Bauingenieuren unerlässlich.
