Opis:
The smart grid is a concept for the development of power distribution grids that offers great promise for the realization of the ambitious objectives of European Energy Policy. In its Third Energy Liberalization Package, European energy law has introduced the concept of intelligent grids and intelligent metering systems. A new directive of EPBD (energy performance of buildings) is to press ahead with this trend. At the same time work is underway at the European Commission and with European Regulators concerning standardization and the new shape of regulatory policy in the implementation stage. The EU legislation and regulatory policy of the National Regulatory Authorities will have to take into consideration the current trends in the modernization of the networks. Among other things, this means revising the existing regulatory model, and that will have to take into account the performance and output of industry networks.
Smart Grid est le concept du développement des réseaux de la distribution de l’électricité, qui donne la chance de réaliser des objectifs de grande importance de la perspective des Politiques Européennes de l’Énergie. Le droit européen de l’énergie a introduit, dans son troisième paquet de libéralisation, le concept des réseaux intelligents et des systèmes de compteurs intelligents. La nouvelle directive sur la performance énergétique des bâtiments (EPBD) constitue une continuation de cette tendance. Au même temps, les travaux des la Commission Européenne et des Régulateurs Européens concernant la standardisation et la nouvelle forme des politiques de régulation, sont réalisés. La législation de l’UE et la politique de régulation des autorités réglementaires, doivent prendre en considération les tendances contemporaines de la modernisation des réseaux. Cela signifie, entre autre, une révision du modèle de régulation existant, qui doit prendre en considération la performance et les effets des réseaux de l’industrie.

The energy sector is a strategic industry of each state. Energy industry is one of the most important regulated fields at the EU level and a crucial direction of cooperation between the EU and Ukraine. EU legislation, primarily directives and regulations from the Third Energy Package, prescribe requirements in respect of the legal status of national regulatory authorities in the fields of energy and natural gas. Ukraine, as a full-fledged member of the Energy Community, as well as in line with the EU‒Ukraine Association Agreement, shall institute laws and regulations necessary for the implementation of those requirements. In particular, EU legislation stipulates requirements with regard to the independence of national regulatory authorities from other state authorities during the exercise of their regulatory powers. In recent years, Ukrainian public authorities have undertaken steps to develop and approve a legal framework in order to implement the requirements of EU energy legislation, in particular those related to the legal status of national regulatory authorities. The approval of the Law of Ukraine on the National Energy and Communal Services Regulatory Commission in 2016 was one of the critical achievements in this direction. However, the new Law has not solved the problem of the constitutional legal status of the energy regulator. The Constitution of Ukraine’s provisions specifying the powers of the President of Ukraine and the Verkhovna Rada of Ukraine as against permanent independent regulatory authorities (e.g., pertaining to the establishment, appointment and dismissal of members, accountability) shall be amended in order to bolster the principle of independence of national regulatory authorities in the energy sector as prescribed by EU legislation.

EU Directives included in the ‘Clean Energy for All Europeans’ package introduced Renewable Energy Communities ECs (RECs) and Citizen ECs (CECs) into the legal framework, sharing commonalities, but with distinctions. The aim of this paper is to examine whether EU law provides for a single model of ECs or, in fact, two distinct models, and to characterize ECs as new participants in the energy market. The publication focuses on the field of legal studies and includes a literature review, an interpretation of EU provisions defining ECs, a characterization of ECs as new market participants, and a case study. The paper concludes that EU law indeed encompasses two models of ECs – RECs and CECs. The characterization of ECs as participants in the energy market is complex, and the case study illustrates that significant differences can exist among different examples of ECs, influencing their legal characteristics.
Les directives du paquet “Clean Energy for All Europeans” ont introduit les communautés d’énergies renouvelables et les communautés d’énergie citoyenne dans le cadre juridique de l’UE, partageant des caractéristiques communes mais présentant également des différences. Cette publication examine si le droit de l’UE prévoit un modèle unique ou deux modèles distincts de communautés d’énergie, et caractérise ces communautés comme de nouveaux participants sur le marché de l’énergie. Elle se concentre sur le domaine juridique, comprenant une revue de littérature, une interprétation des dispositions, une caractérisation et une étude de cas, ainsi qu’une discussion et des conclusions. Selon les conclusions, le droit de l’UE englobe deux modèles de communautés d’énergie. La caractérisation des communautés d’énergie en tant que participants sur le marché est complexe, avec d’importantes différences entre les exemples, influençant leurs caractéristiques juridiques.

Decarbonisation of the European economy is one of the most important megatrends that will shape economic and social development in the coming years. This paper discusses the basic concepts of decarbonisation in terms of climate change, the history of this idea development and the legal basis introduced in the European Union, including key European documents and tools influencing the process, like ETS or CO2 emission allowances. Background on decarbonisation has been presented as a European roadmap to achieve a low-carbon economy in Europe. In the article the main assumptions of the EU strategy papers like Clean Energy for All Europeans or the European Green Deal are presented. Casus Silesia indicates the basic problematic issues that coal regions will have to tackle to due to the transition away from coal. For European societies, the new environmental policy of the European Commission means the intensification of activities to reduce greenhouse gas emissions and switching the economy to low- or zero-carbon energy sources and technologies. The decarbonisation of the economy is an ongoing process which has been gaining momentum in recent years. The coal transition is a huge challenge, particularly for Poland.
