Opis:: The article is an attempt to show the structure, competences and procedure of the realization of the competences of the mediation council. The legal basis for the establishment of this council is in the Code of Canon Law of 1983 in can. 1733 § 2. In the article there are presented entities which are competent to establish the mediation council: conference of bishops and diocesan bishop. Functions of the council are to seek and suggest equitable solutions. Detailed competences of this mediation body, its structure and procedure should be specified in the statutes which erect the mediation council. The author proposes for the establishment of the mediation council in polish particular law following particular law of the other countries, in which this kind of solution led to the reduction of administrative disputes. What is more, it seems advisable to adopt basic rules of the mediation procedure from the state law in force to the ecclesiastical law.

Opis:: Ustawodawca w Kodeksie Prawa Kanonicznego z 1983 r. stanowi, że konferencja biskupów albo biskup diecezjalny mogą erygować radę lub urząd wyposażony w kompetencje mediacyjne (kan. 1733 § 2). Organ mediacyjny zwłaszcza wówczas powinien działać, gdy ktoś prosi o odwołanie dekretu zgodnie z kan. 1734. Ponadto, jeżeli przeciwko dekretowi jest wniesiony rekurs, sam przełożony, który ma rozpatrzyć rekurs, powinien zachęcić wnoszącego rekurs i autora dekretu, do szukania tego rodzaju rozwiązania, ilekroć dostrzega nadzieję na dobry wynik (kan. 1733 § 3). W związku z tym, że polski ustawodawca partykularny nie utworzył stałych organów mediacyjnych, można skorzystać z ustawodawstwa partykularnego innych państw. Dlatego też Autor w artykule analizuje organy pojednawcze funkcjonujące w innych państwach i uzasadnia potrzebę ich erygowania w Kościołach partykularnych w Polsce.
The legislator in the 1983 Code of Canon Law states that the conference of bishops or the diocesan bishop can establish a council or office with mediation competences (can. 1733 § 2). The mediation organ is especially to be of assistance when the revocation of a decree has been requested according to can. 1734. Furthermore, if recourse has been proposed against a decree, however, the superior who deals with the recourse is to urge the person making recourse and the author of the decree to seek a solution of this kind whenever he sees hope of a favorable outcome (can. 1733 § 3). Due to the fact that the Polish particular legislator did not establish permanent mediation organs, it might be necessary to use the particular legislation of other states. Therefore, the Author in the article analyzes the conciliation organs functioning in other countries and justifies the need to establish them in the particular Churches in Poland.

Opis:: The obligation of residence is the obligation to reside in a specific territory on a permanent basis in connection with holding an ecclesiastical office. The delict of violation of the obligation of residence is penalized under can. 1396 of the 1983 Code of Canon Law and is strictly linked to the entrusted ecclesiastical office such as: cardinals holding specific offices in the Roman Curia, diocesan bishop, coadjutor bishop, auxiliary bishop, diocesan administrator, pastor, parochial administrator and a group of clerics administering the parish in solidum, parochial vicar. Violation of the obligation of residence is subject to a mandatory penalty. The gravest penalty provided for by the ecclesiastical legislator is the privation of ecclesiastical office.
