    Michał Kulesza, Jerzy Regulski, and Jerzy Stępień are three co-authors of polish self-government reform (1990 – 1998). The author of the article searches their roles as experts as well as politicians in shaping self-government system. Final conclusion is as follows: although they were “scientific owners” of the problem, their important part in resolving it was more political (bureaucratic) than professional. The matter of their professional role was generally out of question. Practically, the most difficult task was not the shape of future self-government system but the implementation of it. Key in resolving this problem was the political position of aforementioned co-authors, their participation in bureaucratic power, and openness for lobbying. It is a meaningful lesson for the future reformers, each and every one of them.

    Goal – the goal of the paper is to put into perspective the institutional and legal framework of the decentralization reform in Ukraine, as well as to identify problems, explore trends, and provide proposals in reference to the relevant foreign experience in the field. It argues that the decentralization reform in Ukraine has positive results and is an important step towards increasing the autonomy of local authorities. In concludes with arguing that Ukraine should apply the relevant experience of foreign countries while conducting its decentralization reform. Research methodology – the methods used in the article are analysis of official docu ments coming from the Ministry of finance, the Ministry of Economics and the Tax Service of Ukraine, as well as analysis of the factors that promote the autonomy of local government in Ukraine. Score/results – the article is distinguished by a sufficient level of scientific analysis and has provisions, suggestions and practical recommendations that can be used for further research on decentralization issues. Originality/value – the article presents the original complex approach to the problem of decentralization reform in Ukraine and provides substantial analysis of its legal and institutional framework.

    Local self-government constitutes a part of executive power in the state, with the state’s law underlying its functioning. Local government remains under the state’s supervision, representing a form of the political system within the decentralized public administration. 2018 marks 20 years of the functioning of local self-government based on a three-tier structure. The aim of the paper is an attempt at finding the answer to the question whether or not the organizational solutions adopted by the legislator and established in practice need to undergo reforms and if so, to what extent? The question thus formulated relates directly to the argument that the organization of local government system is not sound while the criteria assumed in the territorial breakdown of the local government organization do not correspond to the conditions in which those units operate, and therefore what appears necessary is for the system to be reorganized and the number of units at individual tiers to be reduced. The paper presents selected problems of the local administration in the context of a systemic organization and suggest possible (or necessary) changes which, in the author’s view, should become a subject of discussion (and in practice are such) between local selfgovernment and government administration.

    Opis:
    The last elections in Poland have substantially changed the political discourse. The new government has started to implement numerous reforms. Many of them aroused great controversy, including the one introducing changes in the local government system. This discussion can be considered as an invitation to broader considerations on the future of local government in Poland. It contains statements of six sociologists who are professionally interested in local government issues. They were inspired by three questions (asked by the editors of the text) about: (i) the possible outcome of the reform of the territorial self-government (ii) the functioning of the territorial self-government (iii) the evaluation of the discussion on the announced changes. The answers to these questions were based on the research knowledge and research experiences of the respondents and are therefore more science-based that general opinions typical for a public discussion which often manifest the worldview (or political attitudes) of the debating parties.
    Ostatnie wybory w Polsce mocno zmieniły sytuację polityczną. Nowe władze przystąpiły do realizacji licznych reform. Wiele z nich wzbudziło duże kontrowersje. Dotyczy to także zapowiedzi związanych ze zmianami w systemie samorządu terytorialnego. Artykuł można potraktować jako zaproszenie do dyskusji na temat przyszłości samorządności terytorialnej w Polsce. Zawiera wypowiedzi sześciu socjologów zajmujących się problematyką samorządową. Były one inspirowane trzema pytaniami, które dotyczyły: (1) bilansu polskiej reformy samorządowej, (2) problemów funkcjonowania samorządów, (3) oceny przebiegu dyskusji poświęconej zapowiedzianym zmianom. Wypowiedzi (odpowiedzi na pytania) opierają się na kompetencjach badaczy i ich doświadczeniu badawczym, są zatem w większym stopniu odwzorowaniem wiedzy naukowej i doświadczeń badawczych niż opinii, czy światopoglądu, które właściwe są dyskursowi publicznemu.

    Artykuł prezentuje analizę ewolucyjnych zmian w funkcjonowaniu jednostek pomocniczych tworzonych w polskich gminach. Zawiera również rozważania dotyczące wzmocnienia ich znaczenia w ustroju wewnętrznym gminy. Przedmiotem badań jest również rola jednostek pomocniczych jako czynnika wzrostu poziomu partycypacji społecznej wspólnot lokalnych. Z uwagi na uwarunkowania ustrojowe artykuł koncentruje się jedynie na jednostkach pomocniczych tworzonych w gminach oraz miastach na prawach powiatu. Rozważania nie obejmują jednostek pomocniczych – dzielnic - miasta stołecznego Warszawy ze względu na ich specyficzny charakter prawny.
    The working paper presents the analysis of sub-territorial unit in Poland from the utilitarian point of view. It also includes potential perspectives for such form of social participation in local society. The core idea consists of sub-territorial units in communities and municipalities due to the provisions of the law. The analysis excludes the sub-territorial units in Warsaw – capital city of Republic of Poland because of their unique status provided by the dedicated law. Besides that, the working paper includes the question about the problem of the local communities’ activity and participation in the public sphere.

    Artykuł poświęcony jest problemom decentralizacji, dokonującej się na Ukrainie po roku 2014. Analizie poddany został pierwszy etap reformy administracyjno-terytorialnej – reforma samorządu lokalnego i terytorialnej organizacji władz. Na tym etapie tworzone są podstawy pod budowę funkcjonowania pełnoprawnego samorządu lokalnego – sprawnej wspólnoty lokalnej. Pod pojęciem tym rozumie się wspólnoty terytorialne siół (osiedli i miast), które w rezultacie dobrowolnego łączenia się są zdolne samodzielnie lub za pośrednictwem odpowiednich organów jednostek samorządu lokalnego zapewnić członkom wspólnoty odpowiedni poziom usług w zakresie: edukacji, kultury, ochrony zdrowia, pomocy społecznej, gospodarki komunalnej, z uwzględnieniem zasobów kadrowych, finansów, rozwoju infrastruktury w jednostkach administracyjno-terytorialnych. Autor rozważa dotychczasowe osiągnięcia w zakresie łączenia wspólnot terytorialnych i odnotowuje wzmocnienie potencjału finansowego i zasobów w połączonych wspólnotach. Jednocześnie autor zwraca uwagę na szereg obiektywnych i subiektywnych czynników wpływających na tempo reformy. Do czynników obiektywnych zalicza niedoskonałość uregulowań prawnych funkcjonowania nowych instytucji i stosunków, pojawiających się w procesie zmian. Czynniki subiektywne to przede wszystkim brak woli politycznej po stronie decydentów państwowych, w pierwszej kolejności deputowanych Rady Najwyższej, ale także sprzeciw ze strony elit lokalnych politycznych i administracyjnych. Negatywny wpływ na proces łączenia wspólnot ma stosunek samych wspólnot do proponowanych zmian, a także sprzeczność poglądów w tej sprawie pomiędzy wspólnotami a organami władzy państwowej.
    The article considers the issues of decentralization, implemented in Ukraine after 2014, and the reforms of local self-government and territorial authority organization in Ukraine as the first stage of the administrative reform. The goal of this stage is creation of capable territorial communities as the basis for the fully functional local self-government. A capable territorial community is a voluntary association of territorial communities of villages (towns, settlements), which is be able to provide the proper level of services, particularly in the fields of education, culture, health protection, social services, housing and communal services, independently or through appropriate local government, in view of human resources, financial provision and development of the infrastructure of the respective administrative-territorial unit. The author considers the intermediate results of the process of association of territorial communities and observes the improvement of financial and resource opportunities in the connected communities. At the same time, he focuses on a number of objective and subjective factors affecting the reforms rate. Objective factors include the lack of legislative regu-lation of new institutions and relations arising in the process of change. Subjective factors are the lack of political will on the part of decision makers, primarily among the members of Parliament, as well as opposition from local political and administrative elites. Another important factor is the disinclination of the communities to unite or a substantial difference of approach to association between state authorities and communities. Identification and analy-sis of such factors are important for prognostication and preventing delays in the territorial communities association process, as well as for the implementation of the entire reform.
