    Opis:
    The geological information is data and geological samples together with the results of their processing and interpretation, particularly given in the geological documentation and recorded on data carriers. The right to the geological information is held by the State Treasury. The use of the geological information, for which the right is held by the State Treasury is free of charge, except for the use of data and geological samples, performing geological information without a charge. In the period of 3 years from the date of obtaining activities within the scope of: exploiting minerals from deposits, underground non-reservoir storage of substances, underground storage of waste and activites, in which the water permit is required. In these situations the contract with the Ministry of the Environment or Voivodship Marshal is needed. However the person incurring the cost of the work carried out in result of decisions issued under Act of 9 June 2011 Geological and Mining Law, has already obtained the decision approving the geological documentation of the deposits, he/she is entitled to the exclusive use of the geological information in order to apply for performance of the activities referred in Art. 100 Act, for example for exploiting the minerals from the deposits.

    Opis:
    Artykuł jest poświęcony przedstawieniu relacji pomiędzy informacją geologiczną, jako prawem majątkowym podmiotowym przysługującym Skarbowi Państwa, a formami, kategoriami jej utrwaleń w postaci dokumentów i dokumentacji geologicznych. Artykuł zawiera przedstawienie od strony prawnej zakresu danych geologicznych, ich przetworzeń, interpretacji, jako elementów informacji geologicznej utrwalonych w dokumentach i dokumentacjach geologicznych. Jest również podjęciem próby wypracowania metody identyfikacji innych praw majątkowych podmiotów z tytułu własności intelektualnej im przysługującej do utworów, które mogą być utrwalone w tych dokumentach i dokumentacjach.
    This paper focuses on presenting relationship occurring between geological information as a property right owned by State Treasury and the forms, categories of its consolidation in a form of documents and geological documentations. This paper also presents from a legal point of view the range of geological data, geological data processing and its interpretation as the elements of geological information consolidated in documents and geological documentation. It is also an attempt to find methodology suitable to identify other property rights owned by entities in terms of intellectual property rights assigned to their works, which can be consolidated in these documents and documentations.

    Opis:
    W artykule przedstawiono problemy związane z rozpoznawaniem i definiowaniem dokumentacji stanowiących źródło danych i informacji geologicznych, zagadnienia relacji informacji geologicznej w stosunku do dokumentacji geologicznej w aspekcie źródeł danych geologicznych i interpretacji, składających się na informację geologiczną. Omówiono klasyfikację dokumentacji geologicznych, wskazano na ich katalog zamknięty, a także na podstawie obowiązującego prawa wskazano, iż na informację geologiczną składają się także informacje zawarte w innych dokumentach niż dokumentacje geologiczne pozyskiwane także poza poszukiwaniem i rozpoznawaniem złóż kopalin na podstawie projektów robót geologicznych, a w szczególności na etapie eksploatacji.
    The paper presents problems related to identifying and defining the geological documentations (reports), which are sources of the geological data and the geological information. The paper also concerns the relation between the geological information and the geological documentation in terms of sources of the geological data and results of their interpretation, of which the geological information consist. The Author discusses the classification of geological documentations’ types and indicates its closed character (that their list is enumerative). On the basis of applicable law geological information can include also information contained in other documents than geological documentation, obtained also outside of the prospecting for or exploration of mineral deposits performed on the basis of geological works projects - for example at the stage of exploiting mineral deposits.

    Opis:
    Prawo do informacji geologicznej jest majątkowym prawem podmiotowym i stanowi aktywo, czyli mienie. Na gruncie prawa geologicznego i górniczego informacja geologiczna, w tym dokumentacja geologiczna i koncesje, stanowią aktywa geologiczno-górnicze. W artykule scharakteryzowano to prawo od strony przedmiotowej i podmiotowej oraz treści prawa. Nowa ustawa z 9 czerwca 2011 r. wprowadza istotne zmiany co do definicji informacji geologicznej, zasad rozporządzania i wykonywania tego prawa. W artykule wskazano na nowe rozwiązania ustawowe i dokonano próby ich wykładni.
    The right to geological information is a valuable geological law subject and it is asset of property. On the ground of geological and mining law, geological information, including documentation and geological concessions, constitutes geological-mining assets. The author characterizes the right in the subjective and objective approach and in terms of the content of the law. The new law of 09 June 2011 introduces significant changes to the definition of the geological information, regulation and execution of this right. The paper points to a new statutory resolution and attempts to provide interpretation.
