The subject matter of the article is notarial preventive jurisdiction and its rules provided in the Polish law, with an emphasis laid on refusal of performing a notarial transaction, pursuant to Art. 81 of the Law on Institution of Notary Public and Notarial Services. The issue under analysis boils down to answering the question whether the prerequisite for refusing a notarial transaction in the form of ‘contradiction with the law’ covers only the statutory law or also the principles of community life. According to the essential thesis of the article, the systemic and functional reasons advocate taking a stand on having the concept of law limited exclusively to a statute. A Notary Public, for being a person of public trust, is to be a guardian of the legitimacy of a notarial act conceived not only as a conflict with the statutory law, but also with the axiology resulting from other normative systems, including principles of community life. The objective of notarial preventive jurisdiction is to make institutional and procedural frameworks for legal entities which make declarations, which should, in turn, secure the safety of legal transactions, including protection of parties of legal transactions, the efficiency of execution of their rights, as well as that of the rights of third parties and the State. It means that in the course of a ‘notarial procedure’, the Notary Public is obliged not only to apply simply the statutory rules, but also to investigate and to examine the circumstances which might imply the illegitimacy of a notarial action due to a conflict with the law or with the principles of community life.

The paper discusses the problem of reopening of proceedings ended in a judgment of the Supreme Court on extraordinary appeal. It examines the admissibility of reopening of proceedings ended in a judgment on extraordinary appeal, court jurisdiction, court panel and cases in which the Supreme Court decides on the admissibility of the reopening. The study also focuses on the appealability of particular judgments on extraordinary appeal and possible decisions on the admissibility of reopening of proceedings using this procedure. The issues of the Supreme Court’s examination of the findings of fact and the power to file a petition for bringing extraordinary appeal proceedings are also addressed. It is concluded that the Supreme Court has jurisdiction to reopen proceedings ended in a judgment of the Supreme Court on extraordinary appeal in three cases: (i) when only the Supreme Court has applied a provision declared to be non-compliant with the Constitution of the Republic of Poland; (ii) when the proceedings have been invalid only before the Supreme Court; (iii) with respect to the restitutionary ground – when, adjudicating the extraordinary appeal, the Court has ruled on the merits of the case.

In the modern history of the Polish administrative court system, an important legal issue that still needs to be clearly resolved is the jurisdiction of courts over acts and actions taken by the public administration other than administrative decisions or rulings. This issue arises in the area of the process of applying for public funds for the performance of educational tasks by public and non-public units of the system of education (with regard to the so-called education subsidies provided from the budgets of local and regional government units), as well as in the area of receiving from the state budget the educational part of the general subvention by local and regional government units themselves. The dispute concerning the jurisdiction over the determination and transfer of education subsidies, which started with the dispute over the legal nature (civil or administrative law) of the relationship arising from the education subsidy, continued for more than 20 years and was only brought to an end by the 2016 amendment to the Act on the system of education. In contrast, the analogous dispute concerning jurisdiction of courts in cases involving the determination of the value and transfer of the educational part of the general subvention to local and regional government units actually remains unresolved to this day. This paper presents an analysis of the evolution of the case law of administrative courts in the cases mentioned above. The primary purpose of this analysis was to formulate conclusions de lege ferenda, the consideration of which would lead to the real and effective exercise of their rights (including the constitutional right to a trial) by the bodies that run public or non-public units of the system of education, as well as by local and regional government units.

Zaproponowane opracowanie zostało przygotowane z myślą o współczesnej refleksji nad aktualnym stanem regulacji związanych z prawem do urlopów pracowniczych. Treść opracowania dotyczy bowiem pierwotnego brzmienia ustawy, która została wydana dokładnie 100 lat temu, bo w 1922 r. Artykuł, oprócz skrótowej analizy najistotniejszych rozwiązań wprowadzonych po raz pierwszy do polskiego porządku prawnego, zawiera także odesłanie do ówczesnego orzecznictwa wskazującego na obowiązujące wówczas mankamenty praktyczne.
The proposed elaboration has been prepared with a view to a contemporary consideration of the current state of regulations related to the right to employee leave. The content of the study refers to the original version of the Act, which was enacted exactly 100 years ago, in 1922. The Article, apart from a short analysis of the most significant solutions introduced for the first time into the Polish legal order, also contains a reference to the jurisprudence of that time indicating the practical shortcomings of that time.
