Opis:
An issue that is characteristic of AI is data processing on a massive scale (giga data, Big Data). This issue is also important because of the proposition to require manufacturers to equip AI systems with a means to record information about the operation of the technology, in particular the type and magnitude of the risk posed by the technology and any negative effects that logging may have on the rights of others. Data gathering must be carried out in accordance with the applicable laws, particularly data protection laws and trade secret protection laws. Therefore, it is necessary to determine the applicable law in line with existing conflict-of-law regulations.

Opis:
The paper examines the fundamental issues regarding the interests in private international law. The goal of the present investigation is to attempt an answer to the question whose interests does the conflict-of-laws rules (narrowly understood) protect. This question is discussed in particular in reference to the theory created in the German doctrine by G. Kegel and developed by his follower K. Schurig. The paper systematizes the conflict-of-laws interests, giving the Polish law examples of the solutions that incorporate them. To be conscious that these interests exist and how they are allocated is necessary, both when drafting and enacting private international law legislation, as well as at the time of its application.

This article focuses on mobility of companies in the European Union in the light of the Court of Justice’s judgment in the C-106/16 Polbud – Wykonawstwo sp. z o.o. case. The Court of Justice has once again interpreted the treaty provisions relating to the EU freedom of establishment in the context of cross-border conversion of companies. The in-depth analysis of the case from the substantive law perspective as well as from the conflict-of-law perspective has raised some doubts with regard to the background of the judgment. Therefore, the article assesses whether the cross-border transfer of a seat took place in the Polbud case or the cross-border conversion, or possibly a new company has come into existence. Most of the analysis is aimed at exposing the risks related to the companies’ mobility under the rules adopted in the Polbud judgment, in particular in the absence of respective European and national regulation.
