Sądownictwo polubowne, często określane mianem arbitrażu, przedstawiane jest powszechnie w poglądach piśmiennictwa jako jedna z alternatywnych metod rozwiązywania sporów. Zastrzeżenia względem nieprawidłowości sądowego wymiaru sprawiedliwości oraz uzasadnione oczekiwania w zakresie redukcji czasu i kosztów postępowania gwarantują stronom realny dostęp do sądu i ochronę praw przez sporządzenie zapisu na sąd polubowny. W ramach wzajemnych relacji sądownictwa polubownego względem alternatywnych metod rozwiązywania sporów należy podkreślić, że arbitraż stanowi realną alternatywę dla wymiaru sprawiedliwości sprawowanego przez sądownictwo państwowe. Warto również wskazać na możliwości i potrzebę rozstrzygania sporów w ramach sądownictwa polubownego stanowiącego istotne uzupełnienie sądowego wymiaru sprawiedliwości. Odzwierciedlony w umowie arbitrażowej zgodny zamiar rozstrzygnięcia konfliktu oraz wyjątkowe możliwości partycypacji stron w prowadzonym postępowaniu arbitrażowym stanowią o nowej treści kultury i świadomości prawnej obywateli oraz kreowaniu nowoczesnych wzajemnych relacji stron szeroko rozumianych stosunków cywilnoprawnych. Zapis na sąd polubowny, realizacja postępowania arbitrażowego i rozstrzygnięcie sporu w ramach sądownictwa polubownego mogą i powinny stanowić nową jakość w zakresie wymierzania sprawiedliwości.
Arbitration judiciary, often referred to as arbitration, is commonly presented in the literature as one of the alternative methods of dispute resolution. The objections to the irregularities of the judicial state system and legitimate expectations in terms of reducing the time and costs of the proceedings guarantee the parties real access to court and protection of their rights by drawing up an arbitration clause. As part of the mutual relations of arbitration with respect to alternative dispute resolution methods, it should be emphasized that arbitration is a real alternative to the state justice administered by the common courts. It is also worth pointing to the possibilities and the need for disputes resolution by arbitration constituting as an important addition to the course of justice made by courts. The consistent intention to resolve the conflict reflected in the arbitration agreement and the exceptional opportunities for the parties to participate in the arbitration proceedings constitute a new content of the culture and legal awareness of citizens and the creation of modern mutual relations between the parties of broadly understood civil law relations. An arbitration clause, the implementation of arbitration proceedings and the resolution of a dispute within the framework of arbitration may and should therefore constitute a new quality in the administration of justice.

In this paper we try to construct a two-attribute group disutility function for two conflicting decision makers, taking into account the property of utility independencev and/or convex dependence between them. Two variables in the group utility function are disutility levels of two conflicting decision makers. The disutility level of each decision maker is modeled using multiple attributes, that is disutility function of each decision maker is formulated as a multi-attribute disutility function. By using a group disutility function for two conflicting agents, we can model the mutual concessions of the two conflicting agents taking into account ethical preference of each decision maker, and hence we can expect fairer multiple agents decision making for realizing better social welfare.

This study investigated the relationships between emotional intelligence (EI) and conflict resolution strategies in romantic heterosexual couples. 164 couples solved the Test of Emotional Intelligence (TIE), a Polish measure based on the ability model of EI, and the Problem-Solving Strategies Inventory (PSSI) in two versions: self-report and a report of partner’s behavior. We assumed that individuals high in EI should have superior confl ict resolution skills and engage in active and constructive strategies, avoiding those characterized as passive and destructive. These hypotheses were supported for women, but not for men. Females’ EI was consistently positively related to self-report measures of Voice, and negatively related to self-reports of Neglect. Emotionally intelligent men did not declare use of more constructive or positive confl ict resolution styles; however, their female partners judged them as more prone to use of those strategies. The results also revealed a positive assortative mating effect with regard to EI. Additionally, the study demonstrated an interesting disparity between male and female’s reports on relationship behaviors.

Importance of building and rebuilding relations between different actors of international politics, from the level of individuals and the smallest social groups to those biggest ones organized in the form of states, has recently become the object of more extended research in the area of both diplomacy and conflict resolution. Along with the well-known and thoroughly analyzed notions such as power, interests, freedoms, norms and many other some new concepts resulting from the evolving nature of international politics are included into political discourse. One of them is reconciliation meaning the rebuilding of relations both at internal and international level. Another interesting example is the relational approach to conflict resolution which can be perceived as the proposal situating itself between two most traditional approaches in the area of international relations namely the realist and the liberal schools. While the realist approach is criticized for not paying enough attention to non-state actors and their role in conflct resolution, the liberal one is perceived as too much oriented into the issues of individual freedoms and institutions and lack of relational „community thinking”. Relational approach which is discussed by increasing number of experts in the area of con{ ict resolution points out the necessity of focusing on the interactions between di erent actors of international relations or more precisely transformation of these relations in such a way that the con{ ict between them is not only settled but truly resolved. Such a transformation is also connected with deeper change in the approach to politics itself meaning fuller inclusion of citizens and their initiatives which are necessary in the process of moving from signing peace agreement to building lasting peace. The article discusses the scope and contents of relational approach and reconciliation stating that reconciliation is both a fundamental aim and instrument of conflict resolution.

In the rich and evolving research of trust there are two opposite theoretical approaches. One in the tradition of Alexis de Tocqueville (1835), Robert Putnam (1993), Francis Fukuyama (1995) and many others considers trust as a quality of interpersonal relations emerging from below, turning into shared cultural resource and producing viable democracy and prosperous economy. The causal vector is from micro to macro, from interpersonal networks to organizations, institutions and the state. This is the dominant approach. But there is also an alternative perspective which claims that trust is facilitated or even enforced by the “civilized public sphere” (Papakostas 2012), or “institutionalized skepticism” (Cleary and Stokes 2006), i.e. the rational political and economic organization, and particularly the clear, stable, transparent and consistent law universalistically and efficiently applied and executed. Here the causal vector is from the state, organizations and institutions toward interpersonal trust, from macro to micro. Both approaches should not be considered as competing but rather as complementary. They have also different but complementary implications concerning the resolution of intergroup conflicts by building trust. For example, the earlier suggests cultivating trust from below by encouraging personal contacts, mutual acquaintance, cooperation, participation in common voluntary ventures by hostile groups. The latter approach would rather emphasize the need for enforcing trustworthiness by overarching, higher-level structure of organizations, institutions and laws assuring accountability, stability, transparency of social relations, through control and surveillance of both feuding parties. It is only the parallel employment of emergence and enforcement of trust that opens the possibility of gradual resolving of intergroup conflict.
W bogatych i rozwijających się badaniach na temat zaufania można wyróżnić dwa kontrastujące ze sobą podejścia teoretyczne. Pierwsze, zakorzenione w tradycji autorów takich jak Alexis de Tocqueville (1835), Robert Putnam (1993) czy Francis Fukuyama (1995), ujmuje zaufanie jako jakość relacji międzyludzkich, która pojawia się oddolnie by następnie stać się kulturowym zasobem niezbędnym do utrzymania trwałej demokracji i dobrze prosperującej gospodarki. Wektor przyczynowy przebiega tu w kierunku od mikro do makro – od sieci międzyludzkich po organizacje, instytucje i państwo. To podejście jest podejściem dominującym. Ale istnieje też ujęcie alternatywne, zgodnie z którym zaufanie powstaje dzięki, lub w całości za sprawą, „cywilizowanej sfery publicznej” (Papakostas, 2012) czy też „zinstytucjonalizowanego sceptycyzmu (Cleary and Stokes, 2006), na który składa się racjonalna organizacja polityczno-gospodarcza, a w szczególności przejrzyste, stabilne i konsekwentne prawo, które jest powszechnie i skutecznie wdrażane i egzekwowane. Tutaj wektor przyczynowy biegnie w kierunku makro-mikro, od państwa, organizacji i instytucji do zaufania na poziomie interpersonalnym. Te dwa pojęcia należy traktować nie jako sprzeczne, lecz uzupełniające się. Co ważne ich implikacje w zakresie rozwiązywania konfliktów grupowych za pomocą budowania zaufania też się uzupełniają. I tak na przykład pierwsze podejście zakłada kultywowanie zaufania oddolnie poprzez promowanie kontaktów międzyludzkich, współpracy i dobrowolnego udziału członków wrogich grup we wspólnych przedsięwzięciach. Drugie natomiast kładzie raczej nacisk na potrzebę wzmacniania zaufania przy pomocy odgórnych struktur organizacji i instytucji oraz praw gwarantujących odpowiedzialność, stabilność i przejrzystość relacji społecznych poprzez kontrolę i uważne obserwowanie członków zwaśnionych grup. Bowiem tylko połączenie przejrzystości i konsekwentnego budowania zaufania daje możliwość stopniowego rozwiązywania konfliktów grupowych.

The presented article is aimed at reflecting usage of mediation as a form of international conflicts settlement and at revealing its factors, at the example of the case of conflict in Abkhazia, Georgia. The article is a hypothesis on to what extend international or regional organizations act as effective mediators during mediation process. Attempt of conflict regulation and work of the mediation platform created after Russian-Georgian war are discussed. The theory discussing main variables for evaluating international mediation represented in mediation literature have been used for evaluating mediation factors. The article shows the level of mediation effectiveness in international conflicts, when it is not clear which are the conflicting sides; it shows that when there is an influential country, considering its capabilities, it has enough power to act as effective mediator, only in case if it does not have direct interest in the conflict. We have concluded that mediation can be effective only when it is clear which the conflicting sides are. It is considered that international organizations cannot be effective in conflict resolution when a conflict is in cold phase.

The object of the analysis of this paper is Qatari mediation. The role of facilitation as a tool of conflict management in Doha’s foreign policy as well as its modus operandi and the conditions for successful facilitation are the main issues examined here. In conclusion, it is revealed that mediation is only one tool of the Qatari foreign policy among many others. Moreover, the presence of the window of opportunity, the conflict parties’ inclusion and cohesion, and the acceptability of an intermediary are crucial for the successful conflict mediation. The use of reward power, the absence of the follow-up mechanism, the trained administrative staff of the foreign policy apparatus, and the war-weariness are the main obstacles for the transformations of Qatari conflict mediation into conflict resolution.

The article reports the results of a study conducted in the form of structured interviews. The goal of the study was to find out about the nature of this institution, the objectives of academic ombudsmen, the cases they deal with, their role in the academic community, in particular their role in resolving disputes at universities, and the type of methods they apply in their work. The institution of an academic ombudsman is considered to use an ADR method which is more appropriate in resolving problems and conflicts that appear at the universities, in comparison with formal procedures. The academic ombudsman takes into account important elements of the mission of universities which include respect for the other party, diversity, tolerance, and application of more inclusive and democratic methods in university governance. The introduction of ombudsman institutions at the universities is Poland is dictated not only by the necessity for more effective management and dispute resolution, but also shows a change in the attitude of the university administration towards the academic community. The need for research into the function of academic ombudsman arises from the relatively dynamic growth in the last three years in the number of academic ombudsmen as well as other institutions with similar names and goals. The emergence and significant increase in number of these institutions in the last few years at the universities in Poland raises the question of their nature and role at the universities.

Aim. Peer mediation is a tool for the prevention of socio-pathological phenomena occurring in the school environment, is an opportunity to resolve conflicts through reconciliation. The paper focuses on the perception of the importance of peer mediation and on the presentation of the results of a questionnaire survey, the aim of which was to determine the respondents’ preferences after completion of the project process. Methods. The aim of the questionnaire survey was to determine how pupils and students perceive peer mediation. The survey sample consisted of selected pupils from 6 primary schools aged 10 to 15 years and students from 6 secondary schools aged 15 to 18 years. The questionnaire was completed at the beginning (year 2020 - N = 189, including 90 primary school pupils) and end of the project implementation (year 2021 - N = 124, including 56 primary school pupils). Results. The responses in the entry and exit questionnaires, the respondents declared after participating in the project process an increase in their experience with peer mediation, expressed an interest in becoming peer mediators and resolving personal and school conflicts through peer mediation. Conclusion. Peer mediation engages pupils in a common dialogue to resolve conflicts at school through reconciliation and is a suitable way to prevent undesirable social phenomena in the school environment. The results of the research showed that respondents preferred peer mediation and perceived it as an appropriate form of conflict resolution in the school environment.

The main question to be addressed while discussing post-revolutionary and in particular, post-EuroMaidan Revolution reforms being implemented in Ukraine is – how significant can be essentially neoliberal reforms being conducted in Ukraine in terms of overcoming first of all military-political, but also economic crisis and providing peace in the country, which could positively impact international security as well? Why can we assess post-EuroMaidan reforms as in fact neoliberal? Not only Georgian, but also other foreign libertarians’ direct active participation in the Ukrainian Government makes these reforms neoliberal, but first of all Ukrainian President – Petro Poroshenko’s broadly announced “4-Ds Program”. However, it is noteworthy to mention that there is still an important gap and internal controversy within the current Ukrainian leadership when it comes to the implementation of this program. There is also a meaningful controversy in addition to attempt assuming generally that neoliberal, and specifically, neoliberal economic policy in Ukraine as well, is an efficient strategy for internal or external conflict resolution and/or has conflict preventive function if we take into consideration much specific in many regards Georgian-Russian War of 2008 and current factual Russian-Ukrainian War, both conflicts taking place in parallel with the neoliberalization of Georgia and Ukraine.

From the formal sight it express as a figure of divorce or separation. Each divorce confirmed by low means emotional, psychical, economic and parental divorce. In a consequence weakens or annihilates emotional ties, the division of property follows among getting divorced sides and disconnection one of them from caring over juvenile children. Moreover the age, state of the child’s health, degree of emotional sensibility, fear about new condition of life can decide about positive or negative the child’s behavior to divorce of its parents. Counteraction would depends disintegrating conflicts on creating family community, spread in a proper family communication but mainly for preparation of a young person to life in a society, at marriage or in family.
