Opis:
The article discusses the issue of soft law and its role in the functioning of supranational competition networks. It draws from the assumption that international cooperation is crucial for competition authorities around the world and that the most efficient and comprehensive form of such cooperation takes the form of supranational competition networks. For networks, establishing common standards in the form of soft law is essential for development of the network and the deepening of cooperation between network members. The article concludes that supranational soft law has its eminent advantages like informality, flexibility, and accessibility which allow it easily to respond to the changing needs of authorities and stakeholders, and to adapt to evolution of the economic and regulatory environment. However, the problems of legitimacy and transparency in the process of establishing soft law rules are yet to be resolved.

Competition Law is an important aspect of free market economy. It determines the functioning of the economic system based on the free market principles of supply and demand. Competition law is in the initial stage of its implementation in the Republic of Kosovo. Its development began in 2004 with the adoption of Kosovo’s Law on Competition, the country’s very first law passed to regulate the legal basis of free market competition. The Law on Competition of 2004 had many shortcomings both with respect to its content and implementation. New legislation was thus passed in 2010 under the name the Law on the Protection of Competition. The latter act is in force now along with an Amendment that entered into force in early 2014. Taken in its entirety, Kosovo’s competition law meets the standards and is in accordance with EU legislation. Kosovo, although it is only in the initial stage of its contractual relations with the EU, has aligned most of its laws with the requirements of EU legislation. Kosovo is Europe’s youngest country and as such, it has various problems when it comes to the functioning of the rule of law. This paper will discuss several topics related to the development of competition law in Kosovo including: the political, legal and economical situation in the field of competition law; the legal bases for the protection of competition in Kosovo; the Kosovo Competition Authority and the insufficiency in its capacities to combat competition law infringements; legal provisions on restrictive practices and merger control. The paper also includes comprehensive conclusions. A number of competition cases deal with by the Kosovo Competition Authority will be mentioned throughout the paper.

The aim of the paper is to present an insight into the challenges raised by digitalized and data-driven markets to competition policy and enforcement in the Big Data era. Focusing on the assessment of information exchange in the digitalized environment, traditional risk factors are analyized and it is argued that new risk factors can be identified. The paper provides an overview of relevant recent Hungarian case-law to examine the role of information exchange, taking place in a data environment that offers an increased amount of up-to-date and relevant market information for analysis. Further, the paper summarizes the enforcement responses to the demandside challenges raised by online platforms, user interfaces applying new approaches and practices that can directly influence consumer behavior. The consequence is drawn that the extended economic and IT-related argumentation may affect the nature of proceedings and some new phenomena, as the role of secondary intermediaries, integration of online and offline market segments open new fields for assessment.
L’objectif de cet article est de donner un aperçu des défis posés par les marchés de la numérisation et des données à la politique de la concurrence et à son application à l’ère des grandes données. En se concentrant sur l’évaluation de l’échange d’information dans l’environnement numérique, les facteurs de risque traditionnels sont analysés et on fait valoir que de nouveaux facteurs de risque peuvent être identifiés. Le texte donne un aperçu de la jurisprudence hongroise récente en la matière afin d’examiner le rôle de l’échange d’informations dans un environnement de données qui offre une quantité accrue d’informations actualisées et pertinentes sur le marché à analyser. En outre, l’article résume les mesures d’application de la loi prises pour relever les défis posés par les plateformes en ligne, dont les interfaces utilisateur appliquent de nouvelles approches et pratiques qui peuvent influencer directement le comportement des consommateurs. La conséquence en est que l’argumentation économique et informatique peut affecter la nature des procédures et certains phénomènes nouveaux, comme le rôle des intermédiaires secondaires, l’intégration des segments de marché en ligne et hors ligne ouvrant de nouveaux domaines d’évaluation.

Limitation periods represent a legal safeguard for a person who has once broken the law in order not to be put at risk of sanctions and other legal liabilities for an indefinite amount of time. By contrast, public interest can sometimes require that a person who has committed a serious breach of law cannot benefit from limitation periods and that it is necessary to declare that the law had indeed been infringed and that legal liability shall be expected irrespective of the passage of time. This article aims to answer the question whether limitation periods for sanctions attached to competition restricting practices by Slovak competition law also limit the powers of its competition authority to declare the illegality of illicit behaviour or to prohibit it. Although this question can arise, and has done so already, as a defence in antitrust proceedings, as well as the fact that an answer to this question can potentially, as well as actually, affect rights of undertakings which have broken competition rules, Slovak jurisprudence cannot be seen as explicit in answering this question.
Les délais de prescription représentent une garantie juridique pour éviter que celui qui a violé la loi soit pour toujours exposé à la contrainte d’une sanction ou d’un autre type de responsabilté juridique. Toutefois, dans certains cas, il est dans l’intérêt public que la personne qui a gravement enfreint la loi ne puisse pas bénéficier du délai de prescription et qu’il soit possible de constater la violation du droit et d’engager la responsabilité juridique. Le présent article essaie de répondre à la question fondamentale, celle de savoir si les délais de prescription prévus, dans le droit slovaque actuel, pour infliger des sanctions pour accords limitant la concurrence ou pour abus de position dominante sont, également, en situation de limiter la compétence de l’autorité slovaque de la concurrence de constater l’illégalité d’une démarche d’une entreprise ou sa compétence d’interdire une telle démarche. Même si cette question peut être posée, ou a déjà été posée, en défense contre les démarches anti-cartel et la réponse à la question peut, potentiellement mais aussi réellement, avoir une influence sur les droits de l’entreprise qui a violé les règles de concurrence, la jurisprudence slovaque donne une réponse claire à cette question.

The 2008 issue of YARS contained an overview of EU law developments in the period of time from 2004 to 2007. This overview covers the years 2008-2009. It confirms that State aid cases remained numerous (6 in total) and that the Commission’s enforcement activities in the area of State aid control continued at a similar pace as before. With respect to other areas of competition law and policy, the overall picture shows a relatively high level of scrutiny in mergers (5) and antitrust cases or inquiries (2). Moreover, EU Courts adopted several decisions in Polish cases, notably in the regulatory field (electronic communications) and State aid control (partial annulment in Huta Częstochowa (Operator) as well as the rejection of a request for interim measures in Technologie Buczek). The regulatory court cases show the Commission’s consistency in pursuing Member States in their failure to implement or to correctly implement the EU Electronic Communications package. In the state aid related Huta Częstochowa (Operator) judgement, the General Court (GC, formerly the Court of First Instance, CFI) partially annulled the scrutinised Commission decision since the Commission failed to identify the actual benefit related to the receipt of the aid in question. The jury is still out in the case concerning Technologie Buczek because the interim measures judgement says little about the potential outcome of the pending main appeals.
Le YARS de 2008 contenait un aperçu des développements du droit de l'UE pendant la période de 2004 à 2007, alors que celui-ci couvre les années 2008-2009. Il confirme que les cas d'aides d'État sont restés nombreux (6 au total) et que la mise en œuvre du contrôle des aides d'État par la Commission a continué au même rythme. En ce qui concerne les autres secteurs du droit de la concurrence et de la politique de concurrence, le nombre de contrôles des concentrations et des cas ou des enquêtes antitrust est relativement élevé (2). En outre, les cours de l'UE ont rendu plusieurs arrêts dans des cas polonais, notamment dans le domaine réglementaire (communications électroniques) et du contrôle d'aides d'État (l'annulation partielle dans Huta Częstochowa (opérateur) ainsi que le rejet d'une demande de mesures provisoires dans Technologie Buczek). Les arrêts dans le domaine réglementaire montrent la cohérence de la Commission dans les actions contre les États membres qui ont manqué à leur obligation de mettre en oeuvre, ou de mettre en œuvre correctement, le Paquet Télécom de l'UE. Dans l'arrêt Huta Częstochowa (opérateur) concernant les aides d'État, le Tribunal (précédemment le Tribunal de Première Instance, TPI) a partiellement annulé la décision de la Commission puisque la Commission n'a pas réussi à identifier l'avantage réel de la réception de l'aide en question. Le jury est toujours en train de délibérer dans le cas concernant Technologie Buczek parce que l'arrêt sur les mesures provisoires dit peu sur les résultats potentiels des appels principaux en cours.

Celem tego artykułu jest przybliżenie polskiemu prawnikowi, zainteresowanemu sprawami ochrony konkurencji, zasad działania fińskiego prawa konkurencji. Omówione są tutaj więc zarówno historia i obecny stan fińskiego prawa ochrony konkurencji, jak i ostatnie zmiany prawa. Artykuł przybliża także organy ochrony konkurencji działające w Finlandii, ich organizację oraz zakres obowiązków. Przybliżone są również w skrócie najbardziej dyskutowane w fińskim piśmiennictwie oraz prasie orzeczenia organów ochrony konkurencji w Finlandii.
The purpose of this article is to present the principles of Finnish competition law to Polish lawyers concerned with antitrust matters. For that reason, the paper focuses on the history and the current state of Finnish competition law, as well as on recent legal changes. It also provides an introduction to the competition authorities operating in Finland, their organization and responsibilities. Moreover, it briefly discusses these decisions and judgments of the competition authorities in Finland, which were most widely analyzed in domestic legal literature and press.
